Demai6: 4
יִשְׂרָאֵל שֶׁקִּבֵּל מִכֹּהֵן וּמִלֵּוִי — הַמַּעַשְׂרוֹת לַבְּעָלִים. רַבִּי יִשְׁמָעֵאל אוֹמֵר: הַקַּרְתָּנִי שֶׁקִּבֵּל שָׂדֶה מִירוּשַׁלְמִי — מַעֲשֵׂר שֵׁנִי שֶׁל יְרוּשַׁלְמִי. וַחֲכָמִים אוֹמְרִים: יָכוֹל הוּא הַקַּרְתָּנִי לַעֲלוֹת וּלְאָכְלוֹ בִּירוּשָׁלָיִם.
[If] a Yisrael contracted a field [as a sharecropper] from a Kohen or Levite, the tithes be-long to the landowner. R’ Yishmael says: [If] a villager contracted a field as a sharecropper from a Jerusalemite, the second tithe belongs to the Jerusalemite. But the Sages say: The villager himself is able to go up and eat it in Jerusalem.
Demai6: 5
הַמְקַבֵּל זֵיתִים לְשֶׁמֶן — כְּשֵׁם שֶׁחוֹלְקִין בַּחֻלִּין כָּךְ חוֹלְקִין בַּתְּרוּמָה. רַבִּי יְהוּדָה אוֹמֵר: יִשְׂרָאֵל שֶׁקִּבֵּל מִכֹּהֵן וּמִלֵּוִי זֵיתִים לְשֶׁמֶן לְמַחֲצִית שָׂכָר — הַמַּעַשְׂרוֹת לַבְּעָלִים.
One who contracts olives [as a sharecropper] for [the production of] oil — just as they divide the chullin, so do they divide the terumah. R’ Yehudah says: A Yisrael who con-tracts olives [as a sharecropper] from a Kohen or Levite for [the production of] oil, [or if he contracts] for half the profit, the tithes [belong] to the owner.
Demai6: 6
בֵּית שַׁמַּאי אוֹמְרִים: לֹא יִמְכֹּר אָדָם אֶת זֵיתָיו אֶלָּא לְחָבֵר. בֵּית הִלֵּל אוֹמְרִים: אַף לַמְעַשֵּׂר. וּצְנוּעֵי בֵית הִלֵּל הָיוּ
נוֹהֲגִין כְּדִבְרֵי בֵית שַׁמַּאי.
Beis Shammai say: A person should not sell his olives except to a chaver. Beis Hillel say: Also to one who tithes. But the pious of Beis Hillel
conducted themselves according to the opinion of Beis Shammai.
Demai6: 7
שְׁנַיִם שֶׁבָּצְרוּ אֶת כַּרְמֵיהֶם לְתוֹךְ גַּת אֶחָת, אֶחָד מְעַשֵּׂר וְאֶחָד שֶׁאֵינוֹ מְעַשֵּׂר — הַמְעַשֵּׂר מְעַשֵּׂר אֶת שֶׁלּוֹ וְחֶלְקוֹ בְּכָל מָקוֹם שֶׁהוּא.
Two [people] who harvested their vineyards into one winepress, [and] one tithes while the other does not tithe, the one who tithes must tithe his and his [fellow’s] share wher-ever it is.
Demai6: 8
שְׁנַיִם שֶׁקִּבְּלוּ שָׂדֶה בַאֲרִיסוּת, אוֹ שֶׁיָּרְשׁוּ אוֹ שֶׁנִּשְׁתַּתְּפוּ — יָכוֹל הוּא לוֹמַר: ,,טֹל אַתָּה חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי; אַתָּה יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי.“ אֲבָל לֹא יֹאמַר לוֹ: ,,טֹל אַתָּה חִטִּים וַאֲנִי שְׂעוֹרִים; טֹל אַתָּה יַיִן וַאֲנִי אֶטֹּל שָׁמֶן.“
Two [people] who received a field as sharecroppers, or who inherited [it], or who be-came partners [in it], one can say [to the other]: ‘‘You take the wheat that is in such-and-such place, and I [will take] the wheat that is in such-and-such place; you the wine that is in such-and-such place, and I the wine that is in such-and-such place.’’ But he should not say to him: ‘‘You take the wheat and I the barley; you take the wine and I will take the oil.’’
Demai6: 9
חָבֵר וְעַם הָאָרֶץ שֶׁיָּרְשׁוּ אֶת אֲבִיהֶם, עַם הָאָרֶץ — יָכוֹל הוּא לוֹמַר לוֹ: ,,טֹל אַתָּה חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי; אַתָּה יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי.“ אֲבָל לֹא יֹאמַר לוֹ: ,,טֹל אַתָּה חִטִּים וַאֲנִי שְׂעוֹרִים; טֹל אַתָּה הַלַּח וַאֲנִי אֶטֹּל אֶת הַיָּבֵשׁ.“
[If] a chaver and an am haaretz inherited their father, an am haaretz, [the chaver] may say to [the am haaretz]: ‘‘You take the wheat that is in such-and-such place, and I the wheat that is in such-and-such place; you the wine that is in such-and-such place, and I the wine that is in such-and-such place.’’ But he may not say to him: ‘‘You take the wheat and I the barley; you take the wet and I will take the dry.’’
Demai6: 10
גֵּר וְעוֹבֵד כּוֹכָבִים שֶׁיָּרְשׁוּ אֶת אֲבִיהֶם עוֹבֵד כּוֹכָבִים, יָכוֹל הוּא לוֹמַר: ,,טֹל אַתָּה עֲבוֹדָה זָרָה וַאֲנִי מָעוֹת; אַתָּה יַיִן וַאֲנִי פֵרוֹת.“ וְאִם מִשֶּׁבָּאוּ לִרְשׁוּת הַגֵּר — אָסוּר.
[If] a convert and an idolater inherited their father, an idolater, [the convert] may say: ‘‘You take the idols and I the money; you the wine and I the produce.’’ However, if [the idols and wine] have already come into the possession of the convert, it is forbidden.
Demai6: 11
הַמּוֹכֵר פֵּרוֹת בְּסוּרְיָא, וְאָמַר: ,,מִשֶּׁל אֶרֶץ יִשְׂרָאֵל הֵן“ — חַיָּב לְעַשֵּׂר. ,,מְעֻשָּׂרִין הֵן“ — נֶאֱמָן, שֶׁהַפֶּה שֶׁאָסַר הוּא הַפֶּה שֶׁהִתִּיר. ,,מִשֶּׁלִּי הֵן“ — חַיָּב לְעַשֵּׂר. ,,מְעֻשָּׂרִין הֵן“ — נֶאֱמָן, שֶׁהַפֶּה שֶׁאָסַר הוּא הַפֶּה שֶׁהִתִּיר. וְאִם יָדוּעַ שֶׁיֶּשׁ לוֹ שָׂדֶה אַחַת בְּסוּרְיָא — חַיָּב לְעַשֵּׂר.
[If] someone sells fruits in Surya, and says: ‘‘They are from the Land of Israel,’’ one is ob-ligated to tithe [them]. [But if he adds:] ‘‘They are tithed,’’ he is believed, because the very mouth that has forbidden is the mouth that has permitted. [If he says:] ‘‘They are from my property,’’ one is obligated to tithe [them]. [But if he adds:] ‘‘They are tithed,’’ he is believed, because the very mouth that has forbidden is the mouth that has permitted. If, however, it is known that he has [at least] one field in Surya, one is obligated to tithe [the fruits].
Demai6: 12
עַם הָאָרֶץ שֶׁאָמַר לְחָבֵר: קַח לִי אֲגֻדַּת יָרָק, קַח לִי גְלֻסְקָן אֶחָד — לוֹקֵחַ סְתָם וּפָטוּר.
וְאִם אָמַר: ,,שֶׁלִּי זֶה, וְזֶה שֶׁל חֲבֵרִי,“ וְנִתְעָרְבוּ
— חַיָּב לְעַשֵּׂר, וַאֲפִלּוּ הֵן מֵאָה.
[If] an am haaretz said to a chaver: ‘‘Buy me a bundle of vegetables,’’ (or) ‘‘Buy me a loaf,’’ he buys without specification and is exempt.
But if he said: ‘‘This is mine, and this is my fellow’s,’’ and they became intermin-gled, he is
obligated to tithe, even if there are a hundred.
Demai7: 1
הַמַּזְמִין אֶת חֲבֵרוֹ שֶׁיֹּאכַל אֶצְלוֹ, וְהוּא אֵינוֹ מַאֲמִינוֹ עַל הַמַּעַשְׂרוֹת — אוֹמֵר מֵעֶרֶב שַׁבָּת: ,,מַה שֶּׁאֲנִי עָתִיד לְהַפְרִישׁ מָחָר — הֲרֵי הוּא מַעֲשֵׂר, וּשְׁאָר מַעֲשֵׂר סָמוּךְ לוֹ. זֶה שֶׁעָשִׂיתִי מַעֲשֵׂר — עָשׂוּי תְּרוּמַת מַעֲשֵׂר עָלָיו; וּמַעֲשֵׂר שֵׁנִי בִּצְפוֹנוֹ אוֹ בִדְרוֹמוֹ, וּמְחֻלָּל עַל הַמָּעוֹת.“
[If] one invites his fellow to eat with him, and [his fellow] does not trust him regarding tithes, [his fellow] says on the eve of the Sabbath: ‘‘What I will separate tomorrow, let it be maaser [rishon], and the rest of the maaser [rishon] is next to it. This [portion] that I have made maaser [rishon] is made into terumas maaser for it; the maaser sheni is on its northern or southern [side], and is deconsecrated on the coins.’’
Demai7: 2
מָזְגוּ לוֹ אֶת הַכּוֹס — אוֹמֵר: ,,מַה שֶּׁאֲנִי עָתִיד לְשַׁיֵּר בְּשׁוּלֵי הַכּוֹס — הֲרֵי הוּא מַעֲשֵׂר, וּשְׁאָר מַעֲשֵׂר סָמוּךְ לוֹ. זֶה שֶׁעָשִׂיתִי מַעֲשֵׂר — עָשׂוּי תְּרוּמַת מַעֲשֵׂר עָלָיו; וּמַעֲשֵׂר שֵׁנִי בְּפִיו, וּמְחֻלָּל עַל הַמָּעוֹת.“
[When] they pour him a cup, he says: ‘‘What I will leave at the bottom of the cup, let it be maaser [rishon], and the rest of the maaser [rishon] is next to it. That [portion] that I have made maaser [rishon] is made into terumas maaser for it; and maaser sheni [is] in its mouth, and is deconsecrated on the coins.’’
Demai7: 3
פּוֹעֵל שֶׁאֵינוֹ מַאֲמִין לְבַעַל הַבַּיִת —
נוֹטֵל גְּרוֹגֶרֶת אַחַת וְאוֹמֵר: ,,זוֹ וְתֵשַׁע הַבָּאוֹת אַחֲרֶיהָ — עֲשׂוּיוֹת מַעֲשֵׂר עַל תִּשְׁעִים שֶׁאֲנִי אוֹכֵל. זוֹ — עֲשׂוּיָה תְרוּמַת מַעֲשֵׂר עֲלֵיהֶן; וּמַעֲשֵׂר שֵׁנִי בָּאַחֲרוֹנָה, וּמְחֻלָּל עַל הַמָּעוֹת.“ וְחוֹשֵׂךְ גְּרוֹגֶרֶת אֶחָת. רַבָּן שִׁמְעוֹן בֶּן גַּמְלִיאֵל אוֹמֵר: לֹא יַחְשׂךְ, מִפְּנֵי שֶׁהוּא מְמַעֵט מְלַאכְתּוֹ שֶׁל בַּעַל הַבָּיִת. רַבִּי יוֹסֵי אוֹמֵר: לֹא יַחְשׂךְ, מִפְּנֵי שֶׁהוּא תְנַאי בֵּית דִּין.
A laborer who does not trust [his] employer
takes one dried fig and says: ‘‘This and nine [dried figs] that come after it are made into maaser rishon for the ninety [dried figs] that I will eat. This one is made into terumas maaser for them; and maaser sheni [is] in the later [ones], and is deconsecrated on the coins,’’ and he refrains [from eating] one dried fig. Rabban Shimon ben Gamliel says: He should not refrain, because he [thereby] reduces his labor for the employer. R’ Yose says: He should not refrain, because it is a proviso of the court.
Demai7: 4
הַלּוֹקֵחַ יַיִן מִבֵּין הַכּוּתִים — אוֹמֵר: ,,שְׁנֵי לֻגִּין שֶׁאֲנִי עָתִיד לְהַפְרִישׁ — הֲרֵי הֵן תְּרוּמָה; וַעֲשָׂרָה — מַעֲשֵׂר; וְתִשְׁעָה — מַעֲשֵׂר שֵׁנִי;“ מֵחֵל וְשׁוֹתֶה.
One who purchases wine from Cutheans says: ‘‘Two lugin that I will eventually separate, they are terumah; ten [lugin are] maaser [rishon], and nine [are] maaser sheni;’’ [and] he begins to drink.
Demai7: 5
הָיוּ לוֹ תְאֵנִים שֶׁל טֶבֶל בְּתוֹךְ בֵּיתוֹ, וְהוּא בְּבֵית הַמִּדְרָשׁ אוֹ בַשָּׂדֶה — אוֹמֵר: ,,שְׁתֵּי תְאֵנִים שֶׁאֲנִי עָתִיד לְהַפְרִישׁ — הֲרֵי הֵן תְּרוּמָה; וְעֶשֶׂר — מַעֲשֵׂר רִאשׁוֹן; וְתֵשַׁע — מַעֲשֵׂר שֵׁנִי.“
הָיוּ דְמַאי — אוֹמֵר: ,,מַה שֶּׁאֲנִי עָתִיד לְהַפְרִישׁ לְמָחָר — הֲרֵי הוּא מַעֲשֵׂר, וּשְׁאָר מַעֲשֵׂר סָמוּךְ לוֹ. זֶה שֶׁעָשִׂיתִי מַעֲשֵׂר — עָשׂוּי תְּרוּמַת מַעֲשֵׂר עָלָיו; וּמַעֲשֵׂר שֵׁנִי — בִּצְפוֹנוֹ אוֹ בִדְרוֹמוֹ, וּמְחֻלָּל עַל הַמָּעוֹת.“
[If] he has figs that are tevel in his home and he is in the study hall or in the field, he says: ‘‘Two figs that I will eventually separate, they are terumah; ten [figs are] maaser rishon, and nine [are] maaser sheni.’’
[If the figs] are demai, he says: ‘‘What I will separate tomorrow, let it be maaser [rishon], and the rest of the maaser [rishon] is next to it. That which I made maaser [rishon] is made into terumas maaser for it; and maaser sheni is on its northern or southern [side], and is deconsecrated on the coins.’’

הָיוּ לְפָנָיו שְׁתֵּי כַלְכָּלוֹת שֶׁל טֶבֶל, וְאָמַר: ,,מַעַשְׂרוֹת זוֹ בָזוֹ“ — הָרִאשׁוֹנָה מְעֻשֶּׂרֶת.
,,שֶׁל זוֹ בָזוֹ וְשֶׁל זוֹ בָזוֹ“ — הָרִאשׁוֹנָה מְעֻשֶּׂרֶת.
,,מַעַשְׂרוֹתֵיהֶן, מַעַשְׂרוֹת כַּלְכָּלָה בַחֲבֶרְתָּהּ“ — קָרָא שֵׁם.
[If] one has before him two baskets of tevel, and he said: ‘‘The tithe for this [basket] are in that [basket],’’ the first [basket] is tithed.
[If he said:] ‘‘[The tithes] for this [basket are] in that [basket] and [those] for that [basket are] in this [one],’’ the first [basket] is tithed.
[If he said:] ‘‘[Regarding] their tithes, the tithes [for each] basket [are] in the other] one,’’ he has verbally designated [tithes].
