Temurah7: 1
יֵשׁ בְּקָדְשֵׁי מִזְבֵּחַ מַה שֶׁאֵין בְּקָדְשֵׁי בֶדֶק הַבַּיִת, וְיֵשׁ בְּקָדְשֵׁי בֶדֶק הַבַּיִת מַה שֶּׁאֵין בְּקָדְשֵׁי מִזְבֵּחַ, שֶׁקָּדְשֵׁי מִזְבֵּחַ עוֹשִׂים תְּמוּרָה, וְחַיָּבִין עֲלֵיהֶם מִשּׁוּם פִּגּוּל, נוֹתָר, וְטָמֵא, וְלָדָן וַחֲלָבָן אָסוּר לְאַחַר פִּדְיוֹנָם, וְהַשׁוֹחֲטָם בַּחוּץ חַיָּב, וְאֵין נוֹתְנִין מֵהֶם לָאֻמָּנִין בִּשְׂכָרָן, מַה שֶּׁאֵין כֵּן בְּקָדְשֵׁי בֶדֶק הַבָּיִת.
There are [laws pertaining] to items consecrated to the Altar that are not [applicable] to items consecrated for the upkeep of the Temple, and there are [laws pertaining] to items consecrated for the upkeep of the Temple that are not [applicable] to items consecrated to the Altar. Items consecrated to the Altar can produce a temurah, and we are liable on their account for piggul, nossar, and tamei. Their offspring and milk are prohibited after their redemption, one who slaughters them outside [the Temple] is liable, and we do not give of them to craftsmen for their fee. This is not the case with things consecrated for the upkeep of the Temple.
Temurah7: 2
יֵשׁ בְּקָדְשֵׁי בֶדֶק הַבַּיִת מַה שֶּׁאֵין בְּקָדְשֵׁי מִזְבֵּחַ, שֶׁסְּתָם הֶקְדֵּשׁוֹת לְבֶדֶק הַבָּיִת. הֶקְדֵּשׁ בֶּדֶק הַבַּיִת חָל עַל הַכֹּל, וּמוֹעֲלִין בְּגִדּוּלֵיהֶן, וְאֵין בָּהֶם הֲנָאָה לַכֹּהֲנִים.
There are [laws pertaining] to items consecrated for Temple upkeep that are not [applicable] to items consecrated to the Altar [as follows]: Unspecified consecrations are [assumed to be] for Temple upkeep, Temple-upkeep sanctity takes effect upon all things, we transgress me’ilah [by benefit- ing] from that which grows from them, and there is in them no benefit for the Kohanim.
Temurah7: 3
אֶחָד קָדְשֵׁי מִזְבֵּחַ וְאֶחָד קָדְשֵׁי בֶדֶק הַבַּיִת — אֵין מְשַׁנִּין אוֹתָן מִקְּדֻשָּׁה לִקְדֻשָּׁה, וּמַקְדִּישִׁין אוֹתָן הֶקְדֵּשׁ עִלּוּי, וּמַחֲרִימִין אוֹתָן. וְאִם מֵתוּ — יִקָּבֵרוּ. רַבִּי שִׁמְעוֹן אוֹמֵר: קָדְשֵׁי בֶדֶק הַבַּיִת, אִם מֵתוּ — יִפָּדוּ.
[Concerning] both Altar consecrations and Temple-upkeep consecrations, we cannot change them from one sanctity to another sanctity. [However,] we may consecrate them with a consecration of appraisal, and we may make them [the object of] a cherem vow. And if they died, they must be buried. R’ Shimon says: [With regard to animals] consecrated for the upkeep of the Temple, if they died, they may be redeemed.
Temurah7: 4
וְאֵלּוּ הֵן הַנִּקְבָּרִים: קָדָשִׁים שֶׁהִפִּילוּ — יִקָּבֵרוּ. הִפִּילָה שִׁלְיָא — תִּקָּבֵר. שׁוֹר הַנִּסְקָל, וְעֶגְלָה עֲרוּפָה, וְצִפֳּרֵי מְצוֹרָע, וּשְׂעַר נָזִיר, וּפֶטֶר חֲמוֹר, וּבָשָׂר בְּחָלָב, וְחֻלִּין שֶׁנִּשְׁחֲטוּ בָעֲזָרָה. רַבִּי שִׁמְעוֹן אוֹמֵר: חֻלִּין שֶׁנִּשְׁחֲטוּ בָעֲזָרָה — יִשָּׂרֵפוּ, וְכֵן חַיָּה שֶׁנִּשְׁחֲטָה בָעֲזָרָה.
And these are the [things] that are buried: If a consecrated [animal] aborted [a fetus], [the aborted fetus] is buried. If it discharged an afterbirth, [the afterbirth] is buried. [And so is] the ox that is stoned, and the decapi- tated calf, and the birds of a metzora, and the hair of a nazir, and a firstborn donkey, and meat with milk, and chullin [animals] that were slaughtered in the [Temple] Courtyard. R’ Shimon says: Chullin [animals] that were slaughtered in the [Temple] Courtyard must be burned, and so too a chayah that was slaughtered in the [Temple] Courtyard.
Temurah7: 5
וְאֵלּוּ הֵן הַנִּשְׂרָפִים: חָמֵץ בַּפֶּסַח — יִשָּׂרֵף. וּתְרוּמָה טְמֵאָה, וְהָעָרְלָה, וְכִלְאֵי הַכֶּרֶם, אֵת שֶׁדַּרְכּוֹ לִשָּׂרֵף — יִשָּׂרֵף, וְאֵת שֶׁדַּרְכּוֹ לִקָּבֵר — יִקָּבֵר. וּמַדְלִיקִין בְּפַת וּבְשֶׁמֶן שֶׁל תְּרוּמָה.
And these are the [things] that are burned: Cha-metz on Pesach is burned, and [so is] terumah that is tamei, and [fruits of] orlah, and kilayim of the vineyard. That which it is usual to burn is burned, and that which it is usual to bury is buried. And [the Kohanim] may kindle [a fire] with bread or oil of terumah.
Temurah7: 6
כָּל הַקֳּדָשִׁים שֶׁנִּשְׁחֲטוּ חוּץ לִזְמַנָּן, וְחוּץ לִמְקוֹמָן — הֲרֵי אֵלּוּ יִשָּׂרֵפוּ. אָשָׁם תָּלוּי — יִשָּׂרֵף. רַבִּי יְהוּדָה אוֹמֵר: יִקָּבֵר. חַטַּאת הָעוֹף הַבָּאָה עַל סָפֵק — תִּשָּׂרֵף. רַבִּי יְהוּדָה אוֹמֵר: יַטִּילֶנָּה לָאַמָּה. כָּל הַנִּשְׂרָפִין — לֹא יִקָּבֵרוּ, וְכָל הַנִּקְבָּרִים — לֹא יִשָּׂרֵפוּ. רַבִּי יְהוּדָה אוֹמֵר: אִם רָצָה לְהַחְמִיר עַל עַצְמוֹ לִשְׂרוֹף אֶת הַנִּקְבָּרִים — רַשַּׁאי. אָמְרוּ לוֹ: אֵינוֹ מֻתָּר לְשַׁנּוֹת.
[Concerning] all consecrated [animals] that are slaughtered [with intent for] beyond their time and outside their place —- these must be burned. An [unnecessary] asham talui must be burned. R’ Yehudah says: It must be buried. A bird chatas that is brought out of doubt must be burned. R’ Yehudah says: One must throw it into the stream. All items that must be burned may not be buried, and all items that must be buried may not be burned. R’ Yehudah says: If one wishes to be stringent with himself to burn [items] that must be buried, he is permitted. They said to him: It is not permitted to deviate.
