קוֹצְרִים בֵּית הַשְּׁלָחִים שֶׁבָּעֲמָקִים, אֲבָל לֹא גוֹדְשִׁין. אַנְשֵׁי יְרִיחוֹ קוֹצְרִין בִּרְצוֹן חֲכָמִים וְגוֹדְשִׁין שֶׁלֹּא בִרְצוֹן חֲכָמִים, וְלֹא מִחוּ בְיָדָם חֲכָמִים. קוֹצֵר לַשַּׁחַת וּמַאֲכִיל לַבְּהֵמָה. אָמַר רַבִּי יְהוּדָה: אֵימָתַי? בִּזְמַן שֶׁהִתְחִיל עַד שֶׁלֹּא הֵבִיאָה שְׁלִישׁ. רַבִּי שִׁמְעוֹן אוֹמֵר: אַף יִקְצֹר וְיַאֲכִיל אַף מִשֶּׁהֵבִיאָה שְׁלִישׁ.
We may reap the irrigated fields in the valleys, but we may not stack. The people of Jericho reaped with the approval of the Sages and stacked against the Sages’ wishes, but the Sages did not issue a protest against them. One may reap unripe grain and feed it to animals. Said R’ Yehudah: When? When he began before it reached a third. R’ Shimon says: He may reap and feed [it] even after it has reached a third.
Menachos10: 9
קוֹצְרִין מִפְּנֵי הַנְּטִיעוֹת, מִפְּנֵי בֵית הָאֵבֶל, מִפְּנֵי בִטּוּל בֵּית הַמִּדְרָשׁ. לֹא יַעֲשֶׂה אוֹתָן כְּרִיכוֹת; אֲבָל מַנִּיחָן צְבָתִים. מִצְוַת הָעֹמֶר לָבֹא מִן הַקָּמָה; לֹא מָצָא, יָבִיא מִן הָעֳמָרִים. מִצְוָתוֹ לָבֹא מִן הַלַּח; לֹא מָצָא, יָבִיא מִן הַיָּבֵשׁ. מִצְוָתוֹ לִקְצוֹר בַּלַּיְלָה; נִקְצַר בַּיּוֹם, כָּשֵׁר. וְדוֹחֶה אֶת הַשַּׁבָּת.
We may reap for the benefit of the saplings, for a place of mourning, [and] in order to [avoid] a cessation of study. He may not make them into bundles; rather, he leaves them in heaps. The commandment of the omer is that it should come from standing grain; if he did not find, he may bring from the sheaves. Its commandment is that it come from the fresh; if he did not find, he may bring from the dry. Its commandment is that it be reaped by night; if it is reaped by day it is valid. And it overrides the Sabbath.
