שְׁבוּעַת הַדַּיָּנִין — הַטַּעֲנָה שְׁתֵּי כֶסֶף וְהַהוֹדָאָה בְּשָׁוֶה פְרוּטָה; וְאִם אֵין הַהוֹדָאָה מִמִּין הַטַּעֲנָה — פָּטוּר. כֵּיצַד? ,,שְׁתֵּי כֶסֶף לִי בְיָדְךָ”, ,,אֵין לְךָ בְיָדִי אֶלָּא פְרוּטָה” — פָּטוּר. ,,שְׁתֵּי כֶסֶף וּפְרוּטָה לִי בְיָדְךָ”, ,,אֵין לְךָ בְיָדִי אֶלָּא פְרוּטָה” — חַיָּב. ,,מָנֶה לִי בְיָדְךָ”, ,,אֵין לְךָ בְיָדִי” — פָּטוּר. ,,מָנֶה לִי בְיָדְךָ”, ,,אֵין לְךָ בְיָדִי אֶלָּא חֲמִשִּׁים דִּינָר” — חַיָּב. ,,מָנֶה לְאַבָּא בְיָדְךָ”, ,,אֵין לוֹ בְיָדִי אֶלָּא חֲמִשִּׁים דִּינָר” — פָּטוּר, מִפְּנֵי שֶׁהוּא כְמֵשִׁיב אֲבֵדָה.
The oath of the judges [is for] a claim of two silver and an admission of the value of a perutah; but if the admission is not of the same kind as the claim —- he is exempt. How so? [If one claims,] “Two silver of mine are in your possession,” [and the other replies,] “You have in my possession only a perutah” —- he is exempt. [But if he claims,] “Two silver and a perutah of mine are in your possession,” [and the other replies,] “You have in my possession only a perutah” —- he is liable.  [If he claims,] “I have a maneh in your possession,” [and the other replies,] “You have nothing in my possession” —- he is exempt. [But if he claims,] “I have a maneh in your possession,” [and the other replies,] “You have in my possession only fifty dinars” —- he is liable. [If he claims,] “A maneh of my father's is in your possession,” [and the other replies,] “Only fifty dinars of his are in my possession” —- he is exempt, because he is as one who returns a lost object.

,,מָנֶה לִי בְיָדֶךָ”, אָמַר לוֹ בִפְנֵי עֵדִים: ,,הֵן”. לְמָחָר אָמַר לוֹ: ,,תְּנֵהוּ לִי”, ,,נְתַתִּיו לָךְ” — פָּטוּר. ,,אֵין לְךָ בְיָדִי” — חַיָּב. ,,מָנֶה לִי בְיָדְךָ”, אָמַר לוֹ: ,,הֵן”; ,,אַל תִּתְּנֵהוּ לִי אֶלָּא בְעֵדִים”. לְמָחָר אָמַר לוֹ: ,,תְּנֵהוּ לִי”, ,,נְתַתִּיו לָךְ” — חַיָּב, מִפְּנֵי שֶׁצָּרִיךְ לִתְּנוֹ לוֹ בְעֵדִים.
“I have a maneh in your possession,” [and] he replied before witnesses, “Yes.” On the next day, [when] he said to him, “Give it to me,” [the other replied,] “I gave it to you” —- he is exempt. [But if he replied,] “You have nothing in my possession” —- he is liable.  “I have a maneh in your possession,” [and] he re-plied, “Yes”; [to which the other responded,] “Do not give it to me except before witnesses.” On the next day, [when] he said to him, “Give it to me,” [the other replied,] “I gave it to you” —- he is liable, because he is required to give it to him with witnesses.
