»הֲרֵי זוֹ תְּמוּרַת עוֹלָה וּתְמוּרַת שְׁלָמִים» — הֲרֵי זוֹ תְּמוּרַת עוֹלָה, דִּבְרֵי רַבִּי מֵאִיר. אָמַר רַבִּי יוֹסֵי: אִם לְכֵן נִתְכַּוֵּן מִתְּחִלָּה, הוֹאִיל וְאִי אֶפְשָׁר לִקְרוֹת שְׁנֵי שֵׁמוֹת כְּאֶחָת — דְּבָרָיו קַיָּמִין. וְאִם מִשֶּׁאָמַר «תְּמוּרַת עוֹלָה» נִמְלַךְ וְאָמַר «תְּמוּרַת שְׁלָמִים» — הֲרֵי זוֹ תְּמוּרַת עוֹלָה.
[If one declares,] “This [animal] is hereby a temurah for an olah, a temurah for a shelamim,” it is thereby a temurah for an olah; [these are] the words of R’ Meir. R’ Yose said: If he intended to [say] this from the outset, since it is impossible to utter two designa- tions simultaneously, his declarations stand. However, if after he declared, “This is hereby a temurah for an olah,” he [then] reconsidered and declared “a temurah for a shelamim,” it is a temurah for an olah.
Temurah5: 5
»הֲרֵי זוֹ תַּחַת זוֹ», «תְּמוּרַת זוֹ», «חֲלִיפַת זוֹ» — הֲרֵי זוֹ תְּמוּרָה. «זוֹ מְחֻלֶּלֶת עַל זוֹ» — אֵינוֹ תְּמוּרָה. וְאִם הָיָה הֶקְדֵּשׁ בַּעַל מוּם — יוֹצֵא לְחֻלִּין, וְצָרִיךְ לַעֲשׂוֹת דָּמִים.
[If one declares,] “This [unconsecrated ani-mal] is hereby in place of this [offering],” “the substitute of this,” [or], “the exchange of this,” [the unconsecrated animal] thereby becomes a temurah. [However, if he declares,] “This [offering] is hereby deconsecrated onto that [unconsecrated animal],” [the unconsecrated animal] is not a temurah. But if the consecrated animal was blemished, then it becomes unconsecrated, but he must make up its value.
Temurah5: 6
»הֲרֵי זוֹ תַּחַת חַטָּאת», וְ»תַחַת עוֹלָה» — לֹא אָמַר כְּלוּם. «תַּחַת חַטָּאת זוֹ», וְ»תַחַת עוֹלָה זוֹ», «תַּחַת חַטָּאת» וְ»תַחַת עוֹלָה שֶׁיֶּשׁ לִי בְתוֹךְ הַבַּיִת»; הָיָה לוֹ — דְּבָרָיו קַיָּמִין.
אִם אָמַר עַל בְּהֵמָה טְמֵאָה, וְעַל בַּעֲלַת מוּם: «הֲרֵי אֵלּוּ עוֹלָה» — לֹא אָמַר כְּלוּם. «הֲרֵי אֵלּוּ לְעוֹלָה» — יִמָּכְרוּ וְיָבִיא בִדְמֵיהֶם עוֹלָה.
[If one declares,] “This [animal] is hereby in place of a chatas,” or, “in place of an olah,” he has not said anything. [However, if he declares,] “In place of this chatas,” or “in place of this olah,” or “in place of a chatas,” or “in place of an olah” “that I have in the house”; if he had [such an offering], his words stand. If one declared regarding a nonkosher animal or blemished animal, “These are hereby an olah,” he has not said anything. “These are hereby for an olah,” [then] they are sold and he brings with their proceeds an olah.
Temurah6: 1
כָּל הָאֲסוּרִין עַל גַּבֵּי הַמִּזְבֵּחַ — אוֹסְרִים כָּל שֶׁהֵן: הָרוֹבֵעַ, וְהַנִּרְבָּע, וְהַמֻּקְצֶה, וְהַנֶּעֱבָד, וְאֶתְנָן, וּמְחִיר, וְהַכִּלְאַיִם, וְהַטְּרֵפָה, וְיוֹצֵא דֹפֶן.
אֵיזֶה הוּא מֻקְצֶה? הַמֻּקְצֶה לַעֲבוֹדָה זָרָה. הוּא אָסוּר, וּמַה שֶּׁעָלָיו מֻתָּר.
אֵיזֶהוּ נֶעֱבָד? כֹּל שֶׁעוֹבְדִין אוֹתוֹ. הוּא וּמַה שֶּׁעָלָיו אָסוּר.
זֶה וָזֶה מֻתָּרִין בַּאֲכִילָה.
All [animals] that are forbidden [to be offered] on the Altar render forbidden [other animals] in any amount: [an animal] that sodomized, [an animal] that was sodomized, a designated animal, one that was worshiped, a [harlot’s] wage, a [dog’s] exchange, a hybrid, a tereifah, and one delivered through Caesarean section. What is a designated animal? One that was designated for idolatrous [purposes]. It itself is prohibited, but what is upon it is permitted. What is one that was worshiped? Any animal that was worshiped [as an idol]. It and what is upon it is forbidden. Both this and this are permitted to be eaten.
Temurah6: 2
אֵיזֶהוּ אֶתְנָן? הָאוֹמֵר לַזּוֹנָה: ,,הֵא לִיךְ טָלֶה זֶה בִּשְׂכָרֵךְ”, אֲפִילּוּ מֵאָה — כֻּלָּן אֲסוּרִין. וְכֵן הָאוֹמֵר לַחֲבֵרוֹ: ,,הֵא לְךָ טָלֶה זֶה וְתָלִין שִׁפְחָתְךָ אֵצֶל עַבְדִּי” — רַבִּי אוֹמֵר: אֵינוֹ אֶתְנָן, וַחֲכָמִים אוֹמְרִים: אֶתְנָן.
What is a [harlot’s] wage? If one says to a harlot, “Take this lamb for your wage,” even [if he gives her] one hundred [lambs], they all are forbidden. Similarly if one says to his fellow, “Take this lamb and let your maidservant spend the night with my slave,” Rebbi says it is not a [harlot’s] wage, but the Sages say it is a [harlot’s] wage.
Temurah6: 3
אֵיזֶה הוּא מְחִיר כֶּלֶב? הָאוֹמֵר לַחֲבֵירוֹ: ,,הֵא לְךָ טָלֶה זֶה תַּחַת כֶּלֶב זֶה”. וְכֵן שְׁנֵי שֻׁתָּפִין שֶׁחָלְקוּ, אֶחָד נָטַל עֲשָׂרָה, וְאֶחָד נָטַל תִּשְׁעָה וְכֶלֶב, שֶׁכְּנֶגֶד הַכֶּלֶב — אֲסוּרִים, שֶׁעִם הַכֶּלֶב — מֻתָּרִים.
אֶתְנַן כֶּלֶב וּמְחִיר זוֹנָה — הֲרֵי אֵלּוּ מֻתָּרִים, שֶׁנֶּאֱמַר: ,,שְׁנַיִם”, וְלֹא אַרְבָּעָה. וַלְדוֹתֵיהֶן מֻתָּרִים, שֶׁנֶּאֱמַר: ,,הֵן”, וְלֹא וַלְדוֹתֵיהֶן.
What is a dog’s exchange? If one says to his fellow, “Take this lamb in exchange for this dog.” Similarly, [if] two partners divided [their animals between them], one took ten [lambs] and one took nine [lambs] and a dog, [the lambs] that are [taken] against the dog are prohibited, [while those] that are [taken] with the dog are permitted. A dog’s wage and a harlot’s exchange, these are permitted, as it is stated: “two,” and not four. The offspring [of an esnan and of a mechir kelev] are permitted, as it is stated: “they,” and not their offspring.
Temurah6: 4
נָתַן לָהּ כְּסָפִים — הֲרֵי אֵלּוּ מֻתָּרִין. יֵינוֹת, שְׁמָנִים, וּסְלָתוֹת, וְכָל דָּבָר שֶׁכְּיּוֹצֵא בוֹ קָרֵב עַל גַּבֵּי מִזְבֵּחַ — אָסוּר.
נָתַן לָהּ מֻקְדָּשִׁין — הֲרֵי אֵלּוּ מֻתָּרִין. עוֹפוֹת — הֲרֵי אֵלּוּ אֲסוּרִין. שֶׁהָיָה בַדִּין: מָה אִם הַמֻּקְדָּשִׁין שֶׁהַמּוּם פּוֹסֵל בָּהֶם, אֵין אֶתְנָן וּמְחִיר חָל עֲלֵיהֶן, עוֹפוֹת שֶׁאֵין הַמּוּם פּוֹסֵל בָּהֶן, אֵינוֹ בַדִּין שֶׁלֹּא יְהֵא אֶתְנָן וּמְחִיר חָל עֲלֵיהֶן? תַּלְמוּד לוֹמַר: ,,לְכָל־נֶדֶר”, לְהָבִיא אֶת הָעוֹף.
[If] he gave [the harlot] coins, they are per-mitted. Wine, oil, flour, or any similar item that can be offered on the Altar, is prohibited. [If] he gave [the harlot] consecrated items, they are permitted. [If he gave her] birds, they are prohibited. For logic would dictate, if consecrated [animals], which a blemish disqualifies, are not subject to [the disqualification of] a [harlot’s] wage and a [dog’s] exchange, birds, which a blemish does not disqualify, is it not logical [to assume] that they are not subject to [the disqualification of] a harlot’s wage and a dog’s exchange? Scripture therefore states: For any vow, to include a bird.
Temurah6: 5
כָּל הָאֲסוּרִים עַל גַּבֵּי הַמִּזְבֵּחַ — וַלְדוֹתֵיהֶן מֻתָּרִים. וְלַד טְרֵפָה — רַבִּי אֱלִיעֶזֶר אוֹמֵר: לֹא יִקְרַב עַל גַבֵּי הַמִּזְבֵּחַ, וַחֲכָמִים אוֹמְרִים: יִקְרַב.
רַבִּי חֲנִינָא בֶּן אַנְטִיגְנוֹס אוֹמֵר: כְּשֵׁרָה שֶׁיָּנְקָה מִן הַטְּרֵפָה — פְּסוּלָה מֵעַל גַּבֵּי הַמִּזְבֵּחַ.
כָּל הַקֳּדָשִׁים שֶׁנַּעֲשׂוּ טְרֵפָה — אֵין פּוֹדִין אוֹתָם, שֶׁאֵין פּוֹדִים אֶת הַקֳּדָשִׁים לְהַאֲכִילָן לַכְּלָבִים.
[Regarding] all [animals] that are prohibited for the Altar, their offspring are per- mitted. [Regarding] the offspring of a tereifah, R’ Eliezer says: It may not be offered on the Altar. But the Sages say: It [may be] offered. R’ Chanina the son of Antignos says: A non-tereifah that suckled from a tereifah is disqualified from [being offered] on the Altar. [Regarding] all consecrated [animals] that be- came tereifos, we may not redeem them, because one may not redeem consecrated [animals] in order to feed them to dogs.
Temurah7: 1
יֵשׁ בְּקָדְשֵׁי מִזְבֵּחַ מַה שֶׁאֵין בְּקָדְשֵׁי בֶדֶק הַבַּיִת, וְיֵשׁ בְּקָדְשֵׁי בֶדֶק הַבַּיִת מַה שֶּׁאֵין בְּקָדְשֵׁי מִזְבֵּחַ, שֶׁקָּדְשֵׁי מִזְבֵּחַ עוֹשִׂים תְּמוּרָה, וְחַיָּבִין עֲלֵיהֶם מִשּׁוּם פִּגּוּל, נוֹתָר, וְטָמֵא, וְלָדָן וַחֲלָבָן אָסוּר לְאַחַר פִּדְיוֹנָם, וְהַשׁוֹחֲטָם בַּחוּץ חַיָּב, וְאֵין נוֹתְנִין מֵהֶם לָאֻמָּנִין בִּשְׂכָרָן, מַה שֶּׁאֵין כֵּן בְּקָדְשֵׁי בֶדֶק הַבָּיִת.
There are [laws pertaining] to items consecrated to the Altar that are not [applicable] to items consecrated for the upkeep of the Temple, and there are [laws pertaining] to items consecrated for the upkeep of the Temple that are not [applicable] to items consecrated to the Altar. Items consecrated to the Altar can produce a temurah, and we are liable on their account for piggul, nossar, and tamei. Their offspring and milk are prohibited after their redemption, one who slaughters them outside [the Temple] is liable, and we do not give of them to craftsmen for their fee. This is not the case with things consecrated for the upkeep of the Temple.
Temurah7: 2
יֵשׁ בְּקָדְשֵׁי בֶדֶק הַבַּיִת מַה שֶּׁאֵין בְּקָדְשֵׁי מִזְבֵּחַ, שֶׁסְּתָם הֶקְדֵּשׁוֹת לְבֶדֶק הַבָּיִת. הֶקְדֵּשׁ בֶּדֶק הַבַּיִת חָל עַל הַכֹּל, וּמוֹעֲלִין בְּגִדּוּלֵיהֶן, וְאֵין בָּהֶם הֲנָאָה לַכֹּהֲנִים.
There are [laws pertaining] to items consecrated for Temple upkeep that are not [applicable] to items consecrated to the Altar [as follows]: Unspecified consecrations are [assumed to be] for Temple upkeep, Temple-upkeep sanctity takes effect upon all things, we transgress me’ilah [by benefit- ing] from that which grows from them, and there is in them no benefit for the Kohanim.
Temurah7: 3
אֶחָד קָדְשֵׁי מִזְבֵּחַ וְאֶחָד קָדְשֵׁי בֶדֶק הַבַּיִת — אֵין מְשַׁנִּין אוֹתָן מִקְּדֻשָּׁה לִקְדֻשָּׁה, וּמַקְדִּישִׁין אוֹתָן הֶקְדֵּשׁ עִלּוּי, וּמַחֲרִימִין אוֹתָן. וְאִם מֵתוּ — יִקָּבֵרוּ. רַבִּי שִׁמְעוֹן אוֹמֵר: קָדְשֵׁי בֶדֶק הַבַּיִת, אִם מֵתוּ — יִפָּדוּ.
[Concerning] both Altar consecrations and Temple-upkeep consecrations, we cannot change them from one sanctity to another sanctity. [However,] we may consecrate them with a consecration of appraisal, and we may make them [the object of] a cherem vow. And if they died, they must be buried. R’ Shimon says: [With regard to animals] consecrated for the upkeep of the Temple, if they died, they may be redeemed.
Temurah7: 4
וְאֵלּוּ הֵן הַנִּקְבָּרִים: קָדָשִׁים שֶׁהִפִּילוּ — יִקָּבֵרוּ. הִפִּילָה שִׁלְיָא — תִּקָּבֵר. שׁוֹר הַנִּסְקָל, וְעֶגְלָה עֲרוּפָה, וְצִפֳּרֵי מְצוֹרָע, וּשְׂעַר נָזִיר, וּפֶטֶר חֲמוֹר, וּבָשָׂר בְּחָלָב, וְחֻלִּין שֶׁנִּשְׁחֲטוּ בָעֲזָרָה. רַבִּי שִׁמְעוֹן אוֹמֵר: חֻלִּין שֶׁנִּשְׁחֲטוּ בָעֲזָרָה — יִשָּׂרֵפוּ, וְכֵן חַיָּה שֶׁנִּשְׁחֲטָה בָעֲזָרָה.
And these are the [things] that are buried: If a consecrated [animal] aborted [a fetus], [the aborted fetus] is buried. If it discharged an afterbirth, [the afterbirth] is buried. [And so is] the ox that is stoned, and the decapi- tated calf, and the birds of a metzora, and the hair of a nazir, and a firstborn donkey, and meat with milk, and chullin [animals] that were slaughtered in the [Temple] Courtyard. R’ Shimon says: Chullin [animals] that were slaughtered in the [Temple] Courtyard must be burned, and so too a chayah that was slaughtered in the [Temple] Courtyard.
Temurah7: 5
וְאֵלּוּ הֵן הַנִּשְׂרָפִים: חָמֵץ בַּפֶּסַח — יִשָּׂרֵף. וּתְרוּמָה טְמֵאָה, וְהָעָרְלָה, וְכִלְאֵי הַכֶּרֶם, אֵת שֶׁדַּרְכּוֹ לִשָּׂרֵף — יִשָּׂרֵף, וְאֵת שֶׁדַּרְכּוֹ לִקָּבֵר — יִקָּבֵר. וּמַדְלִיקִין בְּפַת וּבְשֶׁמֶן שֶׁל תְּרוּמָה.
And these are the [things] that are burned: Cha-metz on Pesach is burned, and [so is] terumah that is tamei, and [fruits of] orlah, and kilayim of the vineyard. That which it is usual to burn is burned, and that which it is usual to bury is buried. And [the Kohanim] may kindle [a fire] with bread or oil of terumah.
Temurah7: 6
כָּל הַקֳּדָשִׁים שֶׁנִּשְׁחֲטוּ חוּץ לִזְמַנָּן, וְחוּץ לִמְקוֹמָן — הֲרֵי אֵלּוּ יִשָּׂרֵפוּ. אָשָׁם תָּלוּי — יִשָּׂרֵף. רַבִּי יְהוּדָה אוֹמֵר: יִקָּבֵר. חַטַּאת הָעוֹף הַבָּאָה עַל סָפֵק — תִּשָּׂרֵף. רַבִּי יְהוּדָה אוֹמֵר: יַטִּילֶנָּה לָאַמָּה. כָּל הַנִּשְׂרָפִין — לֹא יִקָּבֵרוּ, וְכָל הַנִּקְבָּרִים — לֹא יִשָּׂרֵפוּ. רַבִּי יְהוּדָה אוֹמֵר: אִם רָצָה לְהַחְמִיר עַל עַצְמוֹ לִשְׂרוֹף אֶת הַנִּקְבָּרִים — רַשַּׁאי. אָמְרוּ לוֹ: אֵינוֹ מֻתָּר לְשַׁנּוֹת.
[Concerning] all consecrated [animals] that are slaughtered [with intent for] beyond their time and outside their place —- these must be burned. An [unnecessary] asham talui must be burned. R’ Yehudah says: It must be buried. A bird chatas that is brought out of doubt must be burned. R’ Yehudah says: One must throw it into the stream. All items that must be burned may not be buried, and all items that must be buried may not be burned. R’ Yehudah says: If one wishes to be stringent with himself to burn [items] that must be buried, he is permitted. They said to him: It is not permitted to deviate.
