הַנֶּחְבָּל כֵּיצַד? הָיָה מְעִידִים אוֹתוֹ שֶׁנִּכְנַס תַּחַת יָדוֹ שָׁלֵם וְיָצָא חָבוּל, וְאָמַר לוֹ: ,,חָבַלְתָּ בִי”, וְהוּא אוֹמֵר: ,,לֹא חָבַלְתִּי” — הֲרֵי זֶה נִשְׁבָּע וְנוֹטֵל. רַבִּי יְהוּדָה אוֹמֵר: עַד שֶׁתְּהֵא שָׁם מִקְצָת הוֹדָאָה. כֵּיצַד? אָמַר לוֹ: ,,חָבַלְתָּ בִי שְׁתַּיִם”, וְהַלָּה אוֹמֵר: ,,לֹא חָבַלְתִּי בְךָ אֶלָּא אֶחָת”.
The one who was wounded, how so? They testified about him that he entered his do-main uninjured and emerged wounded; and he says to him, “You wounded me,” while he says, “I did not wound [you]” —- he swears and collects. R' Yehudah says: Only if there is a partial admission. How so? He says to him, “You inflicted two wounds on me,” while he replies, “I inflicted on-ly one wound on you.''

וְשֶׁכְּנֶגְדּוֹ חָשׁוּד עַל הַשְּׁבוּעָה כֵּיצַד? אַחַת שְׁבוּעַת הָעֵדוּת, וְאַחַת שְׁבוּעַת הַפִּקָּדוֹן, וַאֲפִלּוּ שְׁבוּעַת שָׁוְא; הָיָה אֶחָד מֵהֶן מְשַׂחֵק בְּקֻבְיָא, וּמַלְוֶה בְרִבִּית, וּמַפְרִיחֵי יוֹנִים, וְסוֹחֲרֵי שְׁבִיעִית — שֶׁכְּנֶגְדּוֹ נִשְׁבָּע וְנוֹטֵל. הָיוּ שְׁנֵיהֶן חֲשׁוּדִין — חָזְרָה הַשְּׁבוּעָה לִמְקוֹמָהּ; דִּבְרֵי רַבִּי יוֹסֵי. רַבִּי מֵאִיר אוֹמֵר: יַחֲלֹקוּ.
The one whose opponent is not trusted to swear, how so? No matter whether [he had falsely sworn] an oath of a testimony, or an oath of deposit, or even a vain oath; [or if] one of them was a dice-player, or one who lends on interest, or [they were] pi-geon flyers, or Sheviis-merchants —- his opponent swears and collects. [If] they were both suspect —- the oath returns to its place; [these are] the words of R' Yose. R' Meir says: They divide.

וְהַחֶנְוָנִי עַל פִּנְקָסוֹ כֵּיצַד? לֹא שֶׁיֹּאמַר לוֹ: ,,כָּתוּב עַל פִּנְקָסִי שֶׁאַתָּה חַיָּב לִי מָאתַיִם זוּז”. אֶלָּא, אָמַר לוֹ: ,,תֵּן לִבָנַי סָאתַיִם חִטִּין”, ,,תֵּן לְפוֹעֲלַי בְּסֶלַע מָעוֹת”. הוּא אוֹמֵר: ,,נָתַתִּי”, וְהֵן אוֹמְרִים: ,,לֹא נָטַלְנוּ” — הוּא נִשְׁבָּע וְנוֹטֵל, וְהֵן נִשְׁבָּעִין וְנוֹטְלִין. אָמַר בֶּן נַנָּס: כֵּיצַד אֵלּוּ בָאִין לִידֵי שְׁבוּעַת שָׁוְא וָאֵלּוּ בָאִין לִידֵי שְׁבוּעַת שָׁוְא? אֶלָּא הוּא נוֹטֵל שֶׁלֹּא בִשְׁבוּעָה, וְהֵן נוֹטְלִין שֶׁלֹּא בִשְׁבוּעָה.
The storekeeper over his account book, how so? Not that he says to him, “It is written in my account book that you owe me two hundred zuz.” Rather, he said to him, “Give my sons two seahs of wheat,” [or] “Give my workers a sela's worth of maos.” [If] he [now] says, “I gave,” but they say, “We did not collect” —- he swears and collects, and they swear and collect. Said Ben Nannas: How can these come to a vain oath and these come to a vain oath? Rather, he collects without an oath, and they col-lect without an oath.

אָמַר לְחֶנְוָנִי: ,,תֶּן לִי בְדִינָר פֵּרוֹת”, וְנָתַן לוֹ; אָמַר לוֹ: ,,תֶּן לִי אֶת הַדִּינָר”, אָמַר לוֹ: ,,נְתַתִּיו לְךָ וּנְתַתּוֹ בְאָנְפָּלִי” — יִשָּׁבַע בַּעַל הַבַּיִת. נָתַן לוֹ אֶת הַדִּינָר, אָמַר לוֹ: ,,תֶּן לִי אֶת הַפֵּרוֹת”, אָמַר לוֹ: נְתַתִּים לְךָ וְהוֹלַכְתָּן לְתוֹךְ בֵּיתְךָ” — יִשָּׁבַע הַחֶנְוָנִי. רַבִּי יְהוּדָה אוֹמֵר: כָּל שֶׁהַפֵּרוֹת בְּיָדוֹ — יָדוֹ עַל הָעֶלְיוֹנָה.
אָמַר לְשֻׁלְחָנִי: ,,תֶּן לִי בְדִינָר מָעוֹת”, וְנָתַן לוֹ; אָמַר לוֹ: ,,תֶּן לִי אֶת הַדִּינָר”, אָמַר לוֹ: ,,נְתַתִּיו לְךָ וּנְתַתּוֹ בְאָנְפָּלִי” — יִשָּׁבַע בַּעַל הַבַּיִת. נָתַן לוֹ אֶת הַדִּינָר, אָמַר לוֹ: ,,תֶּן לִי אֶת הַמָּעוֹת”, אָמַר לוֹ: ,,נְתַתִּים לְךָ וְהִשְׁלַכְתָּם לְתוֹךְ כִּיסְךָ” — יִשָּׁבַע הַשֻּׁלְחָנִי. רַבִּי יְהוּדָה אוֹמֵר: אֵין דֶּרֶךְ שֻׁלְחָנִי לִתֵּן אִסָּר עַד שֶׁיִּטֹּל דִּינָרוֹ.
[If] one said to a storekeeper, “Give me produce for a dinar,” and he gave it to him; [but when] he said to him, “Give me the dinar,” he replied, “I gave it to you and you put it into the till” —- the householder swears. [If] he gave him the dinar, [and] said to him, “Give me the produce,” [and] he replied, “I gave it to you and you took it home” —- the storekeeper swears. R' Yehu-dah says: Whoever has the produce in his possession has the upper hand. [If] one said to a money changer, “Give me a dinar's worth of maos,” and he gave [them] to him; [but when] he said to him, “Give me the dinar,” he replied, “I gave it to you and you put it into the till” —- the householder swears. [If] he gave him the dinar, [and] said to him, “Give me the maos,” [and] he replied, “I gave them to you and you threw them into your purse” —- the money changer swears. R' Yehudah says: It is not customary for a money changer to give an issar until he receives his dinar.

כְּשֵׁם שֶׁאָמְרוּ הַפּוֹגֶמֶת כְּתֻבָּתָהּ לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה; וְעֵד אֶחָד מְעִידָהּ שֶׁהִיא פְרוּעָה לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה; מִנְּכָסִים מְשֻׁעְבָּדִים וּמִנִּכְסֵי יְתוֹמִים לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה; וְהַנִּפְרַעַת שֶׁלֹּא בְפָנָיו לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה — וְכֵן הַיְתוֹמִים לֹא יִפָּרְעוּ אֶלָּא בִשְׁבוּעָה: ,,שְׁבוּעָה שֶׁלֹּא פְקָדָנוּ אַבָּא, וְלֹא אָמַר לָנוּ אַבָּא, וְשֶׁלֹּא מָצִינוּ בֵּין שְׁטָרוֹתָיו שֶׁל אַבָּא שֶׁשְּׁטָר זֶה פָּרוּעַ”. רַבִּי יוֹחָנָן בֶּן בְּרוֹקָה אוֹמֵר: אֲפִלּוּ נוֹלַד הַבֵּן לְאַחַר מִיתַת הָאָב — הֲרֵי זֶה נִשְׁבָּע וְנוֹטֵל. אָמַר רַבָּן שִׁמְעוֹן בֶּן גַּמְלִיאֵל: אִם יֵשׁ עֵדִים שֶׁאָמַר הָאָב בִּשְׁעַת מִיתָתוֹ: ,,שְׁטָר זֶה אֵינוֹ פָרוּעַ” — הוּא נוֹטֵל שֶׁלֹּא בִשְׁבוּעָה.
Just as they said [that] a woman who impairs her kesubah is not paid except with an oath; and [that] one against whom a sin-gle witness testifies that it is paid is not paid except with an oath; [and that] from mortgaged property or from the property of orphans, she is not paid except with an oath; and [that] one who receives payment in his absence is not paid except with an oath —- so too orphans are not paid except with an oath [viz.]: “We swear that our father did not enjoin us, neither did our father tell us, nor have we found among our father's documents that this note is paid.” R' Yochanan ben Berokah says: Even if the son is born after the father's death —- he swears and collects. Said Rabban Shimon ben Gamliel: If there are witnesses that the father said at the time of his death, “This note is not paid” —- he collects without an oath.

וְאֵלּוּ נִשְׁבָּעִים שֶׁלֹּא בְטַעֲנָה: הַשֻּׁתָּפִין, וְהָאֲרִיסִין, וְהָאַפּוֹטְרוֹפִּין, וְהָאִשָּׁה הַנּוֹשֵׂאת וְהַנּוֹתֶנֶת בְּתוֹךְ הַבַּיִת, וּבֶן הַבַּיִת. אָמַר לוֹ: ,,מָה אַתָּה טוֹעֲנֵנִי?” ,,רְצוֹנִי שֶׁתִּשָּׁבַע לִי” — חַיָּב.
חָלְקוּ הַשֻּׁתָּפִין וְהַאֲרִיסִין — אֵין יָכוֹל לְהַשְׁבִּיעוֹ. נִתְגַּלְגְּלָה לוֹ שְׁבוּעָה מִמָּקוֹם אַחֵר — מְגַלְגְּלִין עָלָיו אֶת הַכֹּל. וְהַשְּׁבִיעִית מְשַׁמֶּטֶת אֶת הַשְּׁבוּעָה.
The following must swear although no claim is lodged: partners, sharecroppers, administrators, the wife who manages the af-fairs of the house, and the son of the house. [If] he said to him, “What claim do you lodge against me?” [and he replied,] “I want you to swear to me” —- he is liable. Once the partners or the sharecroppers divided —- he cannot make him swear. [If] an oath was im-posed upon him from elsewhere —- they impose upon him an oath for the entire claim. The Shemittah year releases [one from] an oath.
Shevuos8: 1
אַרְבָּעָה שׁוֹמְרִין הֵן: שׁוֹמֵר חִנָּם, וְהַשּׁוֹאֵל, נוֹשֵׂא שָׂכָר, וְהַשּׂוֹכֵר. שׁוֹמֵר חִנָּם נִשְׁבָּע עַל הַכֹּל; וְהַשּׁוֹאֵל מְשַׁלֵּם אֶת הַכֹּל; נוֹשֵׂא שָׂכָר וְהַשּׂוֹכֵר נִשְׁבָּעִין עַל הַשְּׁבוּרָה, וְעַל הַשְּׁבוּיָה, וְעַל הַמֵּתָה, וּמְשַׁלְּמִים אֶת הָאֲבֵדָה וְאֶת הַגְּנֵבָה.
There are four [types of] shomerim: the un-paid shomer, the borrower, the paid shomer, and the renter. The unpaid shomer swears for everything; the borrower pays for everything; the paid shomer and the renter swear concern-ing an animal that broke a limb, an animal that was captured, and an animal that died, but they pay for loss or theft.

אָמַר לְשׁוֹמֵר חִנָּם: ,,הֵיכָן שׁוֹרִי”? אָמַר לוֹ: ,,מֵת” — וְהוּא שֶׁנִּשְׁבַּר, אוֹ נִשְׁבָּה, אוֹ נִגְנַב, אוֹ אָבַד; ,,נִשְׁבַּר” — וְהוּא שֶׁמֵּת, אוֹ נִשְׁבָּה, אוֹ נִגְנַב, אוֹ אָבַד; ,,נִשְׁבָּה” — וְהוּא שֶׁמֵּת, אוֹ נִשְׁבַּר, אוֹ נִגְנַב, אוֹ אָבַד; ,,נִגְנַב” — וְהוּא שֶׁמֵּת, אוֹ נִשְׁבַּר, אוֹ נִשְׁבָּה, אוֹ אָבַד; ,,אָבַד” — וְהוּא שֶׁמֵּת, אוֹ נִשְׁבַּר, אוֹ נִשְׁבָּה, אוֹ נִגְנַב; ,,מַשְׁבִּיעֲךָ אֲנִי”, וְאָמַר: ,,אָמֵן”, — פָּטוּר.
[If] one said to an unpaid shomer, “Where is my bull?” [and] he replied, “It died” —- whereas [in fact] it broke a limb, was captured, stolen, or lost; [or he replied,] “It broke a limb” —- whereas [in fact] it died, was captured, stolen, or lost; [or he re-plied,] “It was captured” —- whereas [in fact] it died, broke a limb, was stolen, or lost; [or he replied,] “It was stolen” —- whereas [in fact] it died, broke a limb, was captured, or lost; [or he replied,] “It was lost” —- whereas [in fact] it died, broke a limb, was captured, or stolen; [and he said to him,] “I adjure you,” and he replied, “Amen!” —- he is exempt.

[If he said to him,] “Where is my bull?” [and] he replied, “It was lost”; [and he said to him,] “I adjure you,” and he replied, “Amen!”, but witnesses testify against him that he ate it —- he must pay the principal. [If] he confessed on his own —- he must pay the principal, plus a fifth, and a guilt-offering. [If he said to him,] “Where is my bull?” [and] he replied, “It was sto-len”; [and he said to him,] “I adjure you,” and he replied, “Amen!”, but witnesses testify against him that he stole it —- he must pay the twofold payment. [If] he confessed on his own —- he must pay the principal, plus a fifth, and a guilt-offering.

אָמַר לְאֶחָד בַּשּׁוּק: ,,הֵיכָן שׁוֹרִי שֶׁגָּנַבְתָּ?” וְהוּא אוֹמֵר: ,,לֹא גָנַבְתִּי”, וְהָעֵדִים מְעִידִין אוֹתוֹ שֶׁגְּנָבוֹ — מְשַׁלֵּם תַּשְׁלוּמֵי כֶפֶל. טָבַח וּמָכַר — מְשַׁלֵּם תַּשְׁלוּמֵי אַרְבָּעָה וַחֲמִשָּׁה. רָאָה עֵדִים שֶׁמְּמַשְׁמְשִׁין וּבָאִין, אָמַר: ,,גָּנַבְתִּי, אֲבָל לֹא טָבַחְתִּי וְלֹא מָכַרְתִּי” — אֵינוֹ מְשַׁלֵּם אֶלָּא קֶרֶן.
[If] he said to someone in the street, “Where is my bull that you stole?” and he replied, “I did not steal [it],” but witnesses tes-tify against him that he stole it —- he pays the twofold payment. [If] he slaughtered [it] —- or sold [it] —- he must pay a four-fold or fivefold payment. [If] he saw witnesses approaching, [and] he said, “I stole, but I did not slaughter or sell” —- he pays only the principal.
