אֲבָל לֹא מָכַר לֹא אֶת הָאֲבָנִים שֶׁאֵינָן לְצָרְכָּהּ, וְלֹא אֶת הַקָּנִים שֶׁבַּכֶּרֶם שֶׁאֵינָן לְצָרְכּוֹ, וְלֹא אֶת הַתְּבוּאָה שֶׁהִיא תְלוּשָׁה מִן הַקַּרְקַע. בִּזְמַן שֶׁאָמַר לוֹ ,,הִיא, וְכָל מַה שֶּׁבְּתוֹכָהּ” — הֲרֵי כֻלָּן מְכוּרִין. בֵּין כָּךְ וּבֵין כָּךְ, לֹא מָכַר לֹא אֶת מְחִצַּת הַקָּנִים שֶׁהִיא בֵית רֹבַע, וְלֹא אֶת הַשּׁוֹמֵרָה שֶׁהִיא עֲשׂוּיָה בְטִיט, וְלֹא אֶת הֶחָרוּב הַמֻּרְכָּב, וְלֹא אֶת סַדַּן הַשִּׁקְמָה, וְלֹא אֶת הַבּוֹר, וְלֹא אֶת הַגַּת, וְלֹא אֶת הַשּׁוֹבָךְ — בֵּין חֲרֵבִין בֵּין יְשׁוּבִין. וְצָרִיךְ לִקַּח לוֹ דֶרֶךְ; דִּבְרֵי רַבִּי עֲקִיבָא. וַחֲכָמִים אוֹמְרִים: אֵינוֹ צָרִיךְ. וּמוֹדֶה רַבִּי עֲקִיבָא בִּזְמַן שֶׁאָמַר לוֹ: ,,חוּץ מֵאֵלּוּ”, שֶׁאֵינוֹ צָרִיךְ לִקַּח לוֹ דֶרֶךְ. מְכָרָן לְאַחֵר — רַבִּי עֲקִיבָא אוֹמֵר: אֵינוֹ צָרִיךְ לִקַּח לוֹ דֶרֶךְ. וַחֲכָמִים אוֹמְרִים: צָרִיךְ לִקַּח לוֹ דֶרֶךְ. בַּמֶּה דְבָרִים אֲמוּרִים? בְּמוֹכֵר, אֲבָל בְּנוֹתֵן מַתָּנָה — נוֹתֵן אֶת כֻּלָּם. הָאַחִין שֶׁחָלְקוּ, זָכוּ בַשָּׂדֶה — זָכוּ בְכֻלָּם. הַמַּחֲזִיק בְּנִכְסֵי הַגֵּר, הֶחֱזִיק בַּשָּׂדֶה — הֶחֱזִיק בְּכֻלָּם. הַמַּקְדִּישׁ אֶת הַשָּׂדֶה — הִקְדִּישׁ אֶת כֻּלָּם. רַבִּי שִׁמְעוֹן אוֹמֵר: הַמַּקְדִּישׁ הַשָּׂדֶה — לֹא הִקְדִּישׁ אֶלָּא אֶת הֶחָרוּב הַמֻּרְכָּב וְאֶת סַדַּן הַשִּׁקְמָה.
However, he has not sold the stones which are not needed for it, nor the reeds in the vineyard that are not needed for it, nor the produce which is detached from the ground. When he said to him, “It, and all that is in it,” they are all sold. In any case, he has not sold a clump of reeds which covers the area of a quarter-kav, nor the watchman's hut which is plastered, nor the grafted carob tree, nor the cropped sycamore, nor the pit, nor the wine press, nor the dovecote —- whether they are in disuse or in use. He must buy [back] a [right-of-]way; [these are] the words of R' Akiva. The Sages, however, say: He need not. R' Akiva admits [that] when he said to him, “Except for these,” he need not buy [back] a [right-of-]way. The Sages, however, say: He must buy a [right-of-]way. In regard to what is this stated? In regard to a sale, but one who gives a gift gives all of them. [When] brothers divide [an inheritance], those who acquire a field acquire all of them. One who takes possession of the estate of a convert, [if] he takes possession of a field, he takes possession of all of them. One who consecrates a field consecrates all of them. R' Shimon says: One who consecrates a field has consecrated only the grafted carob tree and the cropped sycamore.
Bava Basra5: 1
הַמּוֹכֵר אֶת הַסְּפִינָה — מָכַר אֶת הַתֹּרֶן, וְאֶת הַנֵּס, וְאֶת הָעוֹגִין, וְאֶת כָּל הַמַּנְהִיגִין אוֹתָהּ; אֲבָל לֹא מָכַר לֹא אֶת הָעֲבָדִים, וְלֹא אֶת הַמַּרְצוּפִין, וְלֹא אֶת הָאַנְתִּיקִי. וּבִזְמַן שֶׁאָמַר לוֹ: ,,הִיא וְכָל מַה שֶּׁבְּתוֹכָהּ” — הֲרֵי כֻלָּן מְכוּרִין. מָכַר אֶת הַקָּרוֹן — לֹא מָכַר אֶת הַפְּרָדוֹת; מָכַר אֶת הַפְּרָדוֹת — לֹא מָכַר אֶת הַקָּרוֹן. מָכַר אֶת הַצֶּמֶד — לֹא מָכַר אֶת הַבָּקָר; מָכַר אֶת הַבָּקָר — לֹא מָכַר אֶת הַצֶּמֶד. רַבִּי יְהוּדָה אוֹמֵר: הַדָּמִים מוֹדִיעִין. כֵּיצַד? אָמַר לוֹ ,,מְכוֹר לִי צִמְדְּךָ בְּמָאתַיִם זוּז” — הַדָּבָר יָדוּעַ שֶׁאֵין הַצֶּמֶד בְּמָאתַיִם זוּז. וַחֲכָמִים אוֹמְרִים: אֵין הַדָּמִים רְאָיָה.
One who sells a ship has sold the mast, the sail, the anchor, and all the oars; but he has not sold the slaves, the cargo sacks, or the cargo. [When] he said to him, “It, and all that is in it,” they are all sold. [If] he sold a wagon, he did not sell the mules; [if] he sold the mules, he did not sell the wagon. [If] he sold a yoke, he did not sell the oxen; [if] he sold the oxen, he did not sell the yoke. R' Yehudah says: The price informs [us]. How so? [If] he said to him, “Sell me your yoke for two hundred zuz,” it is well known that a yoke does not cost two hundred zuz. The Sages, however, say: The price is not proof.
Bava Basra5: 2
הַמּוֹכֵר אֶת הַחֲמוֹר — לֹא מָכַר אֶת כֵּלָיו. נַחוּם הַמָּדִי אוֹמֵר: מָכַר כֵּלָיו. רַבִּי יְהוּדָה אוֹמֵר: פְּעָמִים מְכוּרִין וּפְעָמִים אֵינָן מְכוּרִין. כֵּיצַד? הָיָה חֲמוֹר לְפָנָיו וְכֵלָיו עָלָיו, וְאָמַר לוֹ: ,,מְכוֹר לִי חֲמוֹרְךָ זֶה” — הֲרֵי כֵלָיו מְכוּרִין. ,,חֲמוֹרְךָ הוּא” — אֵין כֵּלָיו מְכוּרִין.
2. One who sells a donkey has not sold its equipment. Nachum the Mede says: He has sold its equipment. R' Yehudah says: Sometimes they are sold and sometimes they are not sold. How so? [If] the donkey was in front of him and its equipment was on it, and he said to him, “Sell me this donkey of yours,” its equipment is sold. [But if he said,] “This is your donkey,” its equipment is not sold.
Bava Basra5: 3
הַמּוֹכֵראֶת הַחֲמוֹר — מָכַר אֶת הַסְּיָח. מָכַר אֶת הַפָּרָה — לֹא מָכַר אֶת בְּנָהּ. מָכַר אַשְׁפָּה — מָכַר זִבְלָהּ. מָכַר בּוֹר — מָכַר מֵימָיו. מָכַר כַּוֶּרֶת — מָכַר דְּבוֹרִים. מָכַר שׁוֹבָךְ — מָכַר יוֹנִים. הַלּוֹקֵחַ פֵּרוֹת שׁוֹבָךְ מֵחֲבֵרוֹ — מַפְרִיחַ בְּרֵכָה רִאשׁוֹנָה. פֵּרוֹת כַּוֶּרֶת — נוֹטֵל שְׁלֹשָׁה נְחִילִין וּמְסָרֵס. חַלּוֹת דְּבַשׁ — מַנִּיחַ שְׁתֵּי חַלּוֹת. זֵיתִים לָקֹץ — מַנִּיחַ שְׁתֵּי גְרוֹפִיּוֹת.
One who sells a donkey has sold the foal. [If] he sold a cow, he has not sold its calf. [If] he sold a dungheap, he has sold its manure. [If] he sold a pit, he has sold its water. [If] he sold a beehive, he has sold the bees. [If] he sold a dovecote, he has sold the doves.
One who buys the production of a dovecote from another must allow the first brace to fly. [If he bought] the production of a beehive, he takes three swarms and [then] alternates. [If he bought] honeycombs, he must leave two combs. [If he bought] olive trees to cut, he must leave two branches.
Bava Basra5: 4
הַקּוֹנֶה שְׁנֵי אִילָנוֹת בְּתוֹךְ שְׂדֵה חֲבֵרוֹ הֲרֵי זֶה לֹא קָנָה קַרְקַע. רַבִּי מֵאִיר אוֹמֵר: קָנָה קַרְקַע. הִגְדִּילוּ — לֹא יְשַׁפֶּה. וְהָעוֹלֶה מִן הַגֶּזַע — שֶׁלּוֹ; וּמִן הַשָּׁרָשִׁים — שֶׁל בַּעַל הַקַּרְקַע; וְאִם מֵתוּ — אֵין לוֹ קַרְקַע.
קָנָה שְׁלֹשָׁה — קָנָה קַרְקַע. הִגְדִּילוּ — יְשַׁפֶּה; וְהָעוֹלֶה מִן הַגֶּזַע וּמִן הַשָּׁרָשִׁין — שֶׁלּוֹ, וְאִם מֵתוּ — יֶשׁ לוֹ קַרְקַע.
One who buys two trees in the field of another has not acquired any land. R' Meir says: He has acquired land. [If] they grew, he may not trim [them]. Whatever grows from the trunk belongs to him; from the roots, to the owner of the land; and if they died the land is not his. [If] he bought three, he has acquired land. [If] they grew, he may trim [them]; whatever grows from the trunk and the roots belongs to him, and if they died the land is his.
Bava Basra5: 5
הַמּוֹכֵר רֹאשׁ בְּהֵמָה גַסָּה — לֹא מָכַר אֶת הָרַגְלַיִם; מָכַר אֶת הָרַגְלַיִם — לֹא מָכַר אֶת הָרֹאשׁ. מָכַר אֶת הַקָּנֶה — לֹא מָכַר אֶת הַכָּבֵד; מָכַר אֶת הַכָּבֵד — לֹא מָכַר אֶת הַקָּנֶה. אֲבָל בַּדַּקָּה, מָכַר אֶת הָרֹאשׁ — מָכַר אֶת הָרַגְלַיִם; מָכַר אֶת הָרַגְלַיִם — לֹא מָכַר אֶת הָרֹאשׁ. מָכַר אֶת הַקָּנֶה — מָכַר אֶת הַכָּבֵד; מָכַר אֶת הַכָּבֵד — לֹא מָכַר אֶת הַקָּנֶה.
One who sells the head of a large animal has not sold the legs; [if] he sold the legs, he has not sold the head. [If] he sold the trachea, he has not sold the liver; [if] he sold the liver, he has not sold the trachea. However, in [the case of] a small animal, [if] he sold the head, he has sold the legs; [if] he sold the legs, he has not sold the head. [If] he sold the trachea, he has sold the liver; [if] he sold the liver, he has not sold the trachea.
Bava Basra5: 6
אַרְבַּע מִדּוֹת בַּמּוֹכְרִין: מָכַר לוֹ חִטִּים יָפוֹת וְנִמְצְאוּ רָעוֹת — הַלּוֹקֵחַ יָכוֹל לַחֲזוֹר בּוֹ. רָעוֹת וְנִמְצְאוּ יָפוֹת — מוֹכֵר יָכוֹל לַחֲזוֹר בּוֹ. רָעוֹת וְנִמְצְאוּ רָעוֹת, יָפוֹת וְנִמְצְאוּ יָפוֹת — אֵין אֶחָד מֵהֶם יָכוֹל לַחֲזוֹר בּוֹ. שְׁחַמְתִּית וְנִמְצֵאת לְבָנָה, לְבָנָה וְנִמְצֵאת שְׁחַמְתִּית; עֵצִים שֶׁל זַיִת וְנִמְצְאוּ שֶׁל שִׁקְמָה, שֶׁל שִׁקְמָה וְנִמְצְאוּ שֶׁל זַיִת; יַיִן וְנִמְצָא חֹמֶץ, חֹמֶץ וְנִמְצָא יַיִן — שְׁנֵיהֶם יְכוֹלִין לַחֲזוֹר בָּהֶן.
There are four rules for dealing with sales: [If] he sold him superior wheat and it was found to be inferior, the buyer can retract. [If he sold him] inferior [wheat] and it was found to be superior, the seller can retract. [If he sold him] inferior [wheat] and it was found to be inferior, [or] superior [wheat] and it was found to be superior, neither can retract. [If he sold him] red [wheat] and it was found to be white, [or] white [wheat] and it was found to be red; [or he sold him] olive wood and it was found to be sycamore, [or] sycamore and it was found to be olive; [or he sold him] wine and it was found to be vinegar, [or] vinegar and it was found to be wine —- both of them can retract.
Bava Basra5: 7
הַמּוֹכֵר פֵּרוֹת לַחֲבֵרוֹ, מָשַׁךְ וְלֹא מָדַד — קָנָה; מָדַד וְלֹא מָשַׁךְ — לֹא קָנָה. אִם הָיָה פִקֵּחַ — שׂוֹכֵר אֶת מְקוֹמָן. הַלּוֹקֵחַ פִּשְׁתָּן מֵחֲבֵרוֹ — הֲרֵי זֶה לֹא קָנָה עַד שֶׁיְּטַלְטְלֶנּוּ מִמָּקוֹם לְמָקוֹם. וְאִם הָיָה בִמְחֻבָּר לַקַּרְקַע וְתָלַשׁ כָּל שֶׁהוּא — קָנָה.
[If] one sold produce to another, [if] he drew [it] but did not measure [it], he has acquired [it]; [if] he measured but did not draw [it], he has not acquired [it]. If he is prudent, he rents its space. One who buys flax from another does not ac-quire [it] until he moves it from place to place. If it was attached to the ground and he detached any amount, he has acquired [it].
Bava Basra5: 8
הַמּוֹכֵר יַיִן וָשֶׁמֶן לַחֲבֵרוֹ, וְהוּקְרוּ אוֹ שֶׁהוּזְלוּ, אִם עַד שֶׁלֹּא נִתְמַלְּאָה הַמִּדָּה — לַמּוֹכֵר; מִשֶּׁנִּתְמַלְּאָה הַמִּדָּה — לַלּוֹקֵחַ. וְאִם הָיָה סַרְסוּר בֵּינֵיהֶן, נִשְׁבְּרָה הֶחָבִית — נִשְׁבְּרָה לַסַּרְסוּר. וְחַיָּב לְהַטִּיף לוֹ שָׁלֹשׁ טִפִּין. הִרְכִּינָהּ וּמִצָּה — הֲרֵי הוּא שֶׁל מוֹכֵר. וְהַחֶנְוָנִי אֵינוֹ חַיָּב לְהַטִּיף שָׁלֹשׁ טִפִּין. רַבִּי יְהוּדָה אוֹמֵר: עֶרֶב שַׁבָּת עִם חֲשֵׁכָה — פָּטוּר.
[If] one sold wine or oil to another, and it appreciated or depreciated, if [it happened] before the measure was filled, [it belongs] to the seller; once the measure was filled, [it belongs] to the seller; once the measure was filled, [it belongs] to the buyer. If there was a middleman between them, [and] the barrel broke, it broke for the middleman. He is obligated to let three drops drip out for him. [If] he turned it over and drained [it], it belongs to the seller. A storekeeper, however, is not obligated to let three drops drip out. R' Yehudah says: Only on the eve of the Sabbath, at dusk, is he exempt.
