Nedarim5: 1
הַשֻּׁתָּפִין שֶׁנָּדְרוּ הֲנָאָה זֶה מִזֶּה — אֲסוּרִין לִכָּנֵס לֶחָצֵר. רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: זֶה נִכְנָס לְתוֹךְ שֶׁלּוֹ, וְזֶה נִכְנָס לְתוֹךְ שֶׁלּוֹ; וּשְׁנֵיהֶם אֲסוּרִים לְהַעֲמִיד שָׁם רֵחַיִם וְתַנּוּר, וּלְגַדֵּל תַּרְנְגוֹלִים.  הָיָה אֶחָד מֵהֶם מֻדָּר הֲנָאָה מֵחֲבֵרוֹ, לֹא יִכָּנֵס לֶחָצֵר. רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: יָכוֹל הוּא לוֹמַר לוֹ: ,,לְתוֹךְ שֶׁלִּי אֲנִי נִכְנָס, וְאֵינִי נִכְנָס לְתוֹךְ שֶׁלָּךְ”. וְכוֹפִין אֶת הַנּוֹדֵר לִמְכּוֹר אֶת חֶלְקוֹ.
Partners who have prohibited with a neder the benefit of each other are forbidden to enter the yard. R' Eliezer ben Yaakov says: This one is entering into his own [property], and this one is entering into his own [property]; but both are forbidden to install a mill or an oven there, or to raise chickens.  [If] one of them was prohibited by a neder from benefiting from the other, he may not enter the yard. R' Eliezer ben Yaakov says: He may say to him: “I am entering my own [property]; I am not entering yours.” We force the one who made the neder to sell his share.
Nedarim5: 2
הָיָה אֶחָד מִן הַשּׁוּק מֻדָּר מֵאֶחָד מֵהֶם הֲנָאָה — לֹא יִכָּנֵס לֶחָצֵר. רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: יָכוֹל הוּא לוֹמַר לוֹ: ,,לְתוֹךְ שֶׁל חֲבֵרְךָ אֲנִי נִכְנָס, וְאֵינִי נִכְנָס לְתוֹךְ שֶׁלָּךְ”.
[If] someone from the street was prohibited by a neder to benefit from one of them, he may not enter the yard. R' Eliezer ben Yaakov says: He may say to him: “I am entering into your partner's property; I am not entering into yours.”
Nedarim5: 3
הַמֻּדָּר הֲנָאָה מֵחֲבֵרוֹ, וְיֶשׁ לוֹ מֶרְחָץ וּבֵית הַבַּד מֻשְׂכָּרִים בָּעִיר, אִם יֶשׁ לוֹ בָהֶן תְּפִיסַת יָד — אָסוּר. אֵין לוֹ בָהֶן תְּפִיסַת יָד — מֻתָּר. הָאוֹמֵר לַחֲבֵרוֹ: ,,קוֹנָם, לְבֵיתְךָ שֶׁאֲנִי נִכְנָס”, וְ,,שָׂדְךָ שֶׁאֲנִי לוֹקֵחַ”, מֵת אוֹ שֶׁמְּכָרוֹ לְאַחֵר — מֻתָּר.  ,,קוֹנָם, לְבַיִת זֶה שֶׁאֲנִי נִכְנָס”, ,,שָׂדֶה זוֹ שֶׁאֲנִי לוֹקֵחַ”, מֵת אוֹ שֶׁמְּכָרוֹ לְאַחֵר — אָסוּר.
Someone prohibited by a neder to benefit from another, who owns a bathhouse or an olive press which are being leased in the city —- if he has an interest in them, it is forbidden; if he does not retain an interest in them, it is permitted.  [If] someone says to another: “Konam, your house, with respect to my entering it,” or “your field, with respect to my buying [it],” [and] he died or sold it to another person, it is permitted.  [If he said:] “Konam, this house, with respect to my entering,” [or] “this field, with respect to my buying [it],” [and] he died or sold it to another, it is forbidden.
Nedarim5: 4
,,הֲרֵינִי עָלֶיךָ חֵרֶם” — הַמֻּדָּר אָסוּר; ,,הֲרֵי אַתְּ עָלַי חֵרֶם” — הַנּוֹדֵר אָסוּר; ,,הֲרֵינִי עָלֶיךָ וְאַתְּ עָלַי” — שְׁנֵיהֶם אֲסוּרִין. וּשְׁנֵיהֶם מֻתָּרִין בְּדָבָר שֶׁל עוֹלֵי בָבֶל, וַאֲסוּרִין בְּדָבָר שֶׁל אוֹתָהּ הָעִיר.
[If one says:] “I am to you cherem,” the person prohibited by the neder is forbidden; “You are to me cherem” —- the person making the neder is forbidden; “I am to you and you are to me” —- both are forbidden. Both are permitted in something of the pilgrims from Babylon, but are forbidden in something of that city.

וְאֵיזֶהוּ ,,דָבָר שֶׁל עוֹלֵי בָבֶל”? כְּגוֹן הַר הַבַּיִת, וְהָעֲזָרוֹת, וְהַבּוֹר שֶׁבְּאֶמְצַע הַדֶּרֶךְ. וְאֵיזֶהוּ ,,דָבָר שֶׁל אוֹתָהּ הָעִיר”? כְּגוֹן הָרְחָבָה, וְהַמֶּרְחָץ, וּבֵית הַכְּנֶסֶת, וְהַתֵּבָה, וְהַסְּפָרִים.  וְהַכּוֹתֵב חֶלְקוֹ לַנָּשִׂיא. רַבִּי יְהוּדָה אוֹמֵר, אֶחָד כּוֹתֵב לַנָּשִׂיא וְאֶחָד כּוֹתֵב לַהֶדְיוֹט. מַה בֵּין כּוֹתֵב לַנָּשִׂיא לְכוֹתֵב לַהֶדְיוֹט? שֶׁהַכּוֹתֵב לַנָּשִׂיא אֵינוֹ צָרִיךְ לְזַכּוֹת. וַחֲכָמִים אוֹמְרִים: אֶחָד זֶה וְאֶחָד זֶה צְרִיכִין לְזַכּוֹת; לֹא דִבְּרוּ בַנָּשִׂיא אֶלָּא בַהֹוֶה. רַבִּי יְהוּדָה אוֹמֵר: אֵין אַנְשֵׁי גָלִיל צְרִיכִין לִכְתּוֹב, שֶׁכְּבָר כָּתְבוּ אֲבוֹתֵיהֶם עַל יְדֵיהֶם.
What is something of the pilgrims from Babylon? [Things] like the Temple Mount, the Temple Court, and the well in the middle of the highway. What is something of that city? [Things] like the public square, the bathhouse, the synagogue, the ark, and the books.  One who assigns his share to the president —- R' Yehudah says: Both one who assigns to the presi-dent, and one who assigns to an ordinary person. What is the difference between one who assigns to the president, and one who assigns to an ordinary person? That one who assigns to the president need not [give it to someone] to take possession on behalf [of the president]. The Sages, however, say: Both this one and that one must [give their share to someone] to take possession on [their behalf]; they spoke of the president only [to reflect] the current [practice]. R' Yehudah says: The people of Galilee need not assign, since their fathers have already assigned for them.
Nedarim5: 6
הַמֻּדָּר הֲנָאָה מֵחֲבֵרוֹ וְאֵין לוֹ מַה יֹּאכַל — נוֹתְנוֹ לְאַחֵר לְשׁוּם מַתָּנָה, וְהַלָּה מֻתָּר בָּהּ. מַעֲשֶׂה בְאֶחָד בְּבֵית חוֹרוֹן שֶׁהָיָה אָבִיו מֻדָּר הֵימֶנּוּ הֲנָאָה, וְהָיָה מַשִּׂיא אֶת בְּנוֹ. וְאָמַר לַחֲבֵרוֹ: ,,חָצֵר וּסְעוּדָה נְתוּנִים לְךָ בְמַתָּנָה, וְאֵינָן לְפָנֶיךָ אֶלָּא כְּדֵי שֶׁיָּבוֹא אַבָּא וְיֹאכַל עִמָּנוּ בַּסְּעוּדָה”. אָמַר לוֹ: ,,אִם שֶׁלִּי הֵם — הֲרֵי הֵם מֻקְדָּשִׁין לַשָּׁמָיִם”! אָמַר לוֹ: לֹא נָתַתִּי [לְךָ] אֶת שֶׁלִּי שֶׁתַּקְדִּישֵׁם לַשָּׁמָיִם”. אָמַר לוֹ: ,,לֹא נָתַתָּ לִּי אֶת שֶׁלְּךָ אֶלָּא שֶׁתְּהֵא אַתָּה וְאָבִיךָ אוֹכְלִים וְשׁוֹתִים וּמִתְרַצִּים זֶה לָזֶה, וִיהֵא עָוֹן תָּלוּי בְּרֹאשׁוֹ”. וּכְשֶׁבָּא דָבָר לִפְנֵי חֲכָמִים, אָמְרוּ: כָּל מַתָּנָה שֶׁאֵינָהּ, שֶׁאִם הִקְדִּישָׁהּ אֵינָהּ מֻקְדֶּשֶׁת — אֵינָהּ מַתָּנָה.
[If] someone is prohibited by a neder to benefit from another, and he has nothing to eat, [the other person] may give it to someone else as a gift, and he is permitted it.  It happened that a person in Beis Choron, whose father was prohibited by a neder to benefit from him, was marrying off his son. He said to another: “[The] courtyard and banquet are given to you as a gift, but are yours only so that Father can come and eat with us at the banquet.” He replied: “If they are mine, then they are dedicated to Heaven.” He said: “I did not give [you] what was mine in order for you to dedicate it to Heaven.” He replied: “You gave me yours only so that you and your father could eat and drink and appease each other, and the sin should be on my head.” When the matter came before the Sages, they said: Any gift which is not [sincere] —- which, if sanctified, is not sacred —- is not a gift.
Nedarim6: 1
הַנּוֹדֵר מִן ,,הַמְבֻשָּׁל” — מֻתָּר בַּצָּלִי וּבַשָּׁלוּק. אָמַר: ,,קוֹנָם תַּבְשִׁיל שֶׁאֵינִי טוֹעֵם” — אָסוּר בְּמַעֲשֵׂה קְדֵרָה רַךְ, וּמֻתָּר בְּעָבֶה. וּמֻתָּר בְּבֵיצַת טְרָמִיטָא וּבִדְלַעַת הָרְמוּצָה.
One who makes a neder prohibiting “what is cooked” is permitted what is roasted and what is overcooked. [If] he said: “Konam, cooked food, with respect to my tasting [it],” he is forbidden [to taste] soft food made in a pot, but is permitted [to taste] solids. He is permitted [to taste] soft-boiled eggs and a gourd baked in hot ashes.
Nedarim6: 2
הַנּוֹדֵר מִ,,מַּעֲשֵׂה קְדֵרָה” — אֵינוֹ אָסוּר אֶלָּא מִמַּעֲשֵׂה רְתַחְתָּה. אָמַר: ,,קוֹנָם הַיּוֹרֵד לַקְּדֵרָה שֶׁאֵינִי טוֹעֵם” — אָסוּר בְּכָל הַמִּתְבַּשְּׁלִין בַּקְּדֵרָה.
One who makes a neder prohibiting “something prepared in a pot” is forbidden only a boiled food. [If] he said: “Konam, what goes into a pot, with respect to my tasting it,” he is forbidden whatever is cooked in a pot.
Nedarim6: 3
מִן ,,הַכָּבוּשׁ” — אֵינוֹ אָסוּר אֶלָּא מִן הַכָּבוּשׁ שֶׁל יָרָק; ,,כָּבוּשׁ שֶׁאֵינִי טוֹעֵם” — אָסוּר בְּכָל הַכְּבוּשִׁים. מִן ,,הַשָּׁלוּק” אֵינוֹ אָסוּר אֶלָּא מִן הַשָּׁלוּק שֶׁל בָּשָׂר; ”שָׁלוּק שֶׁאֵינִי טוֹעֵם” — אָסוּר בְּכָל הַשְּׁלָקִים. מִן ,,הַצָּלִי” — אֵינוֹ אָסוּר אֶלָּא מִן הַצָּלִי שֶׁל בָּשָׂר; דִּבְרֵי רַבִּי יְהוּדָה; ,,צָלִי שֶׁאֵינִי טוֹעֵם” — אָסוּר בְּכָל הַצְּלוּיִים. מִן ,,הַמָּלִיחַ” — אֵינוֹ אָסוּר אֶלָּא מִן הַמָּלִיחַ שֶׁל דָּג; ,,מָלִיחַ שֶׁאֵינִי טוֹעֵם” — אָסוּר בְּכָל הַמְלוּחִים.
[If he prohibited] “the preserved food,” he is forbidden only preserved vegetables; “preserved food, with respect to my tasting” —- he is forbidden all preserved foods. “The seethed food” —- he is forbidden only seethed meat; “seethed food, with respect to my tasting” —- he is forbidden all seethed foods. “The roast” —- he is forbidden only roasted meat; [these are] the words of R' Yehudah; “roast, with respect to my tasting” —- he is forbidden all roasted foods. “The salted food” —- he is forbidden only salted fish; “salted food with respect to my tasting” —- he is forbidden all salted foods.
Nedarim6: 4
,,דָּג, דָּגִים שֶׁאֵינִי טוֹעֵם” — אָסוּר בָּהֶן, בֵּין גְּדוֹלִים בֵּין קְטַנִּים, בֵּין מְלוּחִין בֵּין טְפֵלִין, בֵּין חַיִּין בֵּין מְבֻשָּׁלִין; וּמֻתָּר בְּטָרִית טְרוּפָה וּבַצִּיר. הַנּוֹדֵר מִן ,,הַצַּחֲנָה” — אָסוּר בְּטָרִית טְרוּפָה, וּמֻתָּר בַּצִּיר וּבַמֻּרְיָס. הַנּוֹדֵר מִטָּרִית טְרוּפָה — אָסוּר בַּצִּיר וּבַמֻּרְיָס.
[If one said: “Konam] fish, fishes, with respect to my tasting,” he is forbidden them whether large or small, whether salted or unsalted, whether raw or cooked; but he is permitted hashed taris and brine. One who makes a neder prohibiting “assorted hashed fish” is forbidden hashed taris, but permitted brine and fish juice. One who makes a neder prohibiting “hashed taris” is forbidden brine and fish juice.
Nedarim6: 5
הַנּוֹדֵר מִן ,,הֶחָלָב” — מֻתָּר בַּקּוּם; וְרַבִּי יוֹסֵי אוֹסֵר. מִן ,,הַקּוּם” — מֻתָּר בֶּחָלָב. אַבָּא שָׁאוּל אוֹמֵר: הַנּוֹדֵר מִן ,,הַגְּבִינָה” — אָסוּר בָּהּ, בֵּין מְלוּחָה בֵּין טְפֵלָה.
One who makes a neder prohibiting “the milk” is permitted whey; R' Yose, however, forbids it. “The whey” —- he is permitted milk. Abba Shaul says: One who makes a neder prohibiting “the cheese” is forbidden it, whether it is salted or unsalted.
Nedarim6: 6
הַנּוֹדֵר מִן ,,הַבָּשָׂר” — מֻתָּר בָּרֹטֶב וּבַקִּיפָה; וְרַבִּי יְהוּדָה אוֹסֵר. אָמַר רַבִּי יְהוּדָה: מַעֲשֶׂה וְאָסַר עָלַי רַבִּי טַרְפוֹן בֵּיצִים שֶׁנִּתְבַּשְּׁלוּ עִמּוֹ. אָמְרוּ לוֹ: וְכֵן הַדָּבָר! אֵימָתַי? בִּזְמַן שֶׁיֹּאמַר: ,,בָּשָׂר זֶה עָלַי”, שֶׁהַנּוֹדֵר מִן הַדָּבָר וְנִתְעָרֵב בְּאַחֵר, אִם יֶשׁ בּוֹ בְּנוֹתֵן טַעַם — אָסוּר.
One who makes a neder prohibiting “meat” is permitted meat juice and jelled meat juice; R' Yehudah, however, forbids [them]. Said R' Yehudah: It happened that R' Tarfon forbade me the eggs which were cooked with it. They said to him: It is true! When? At a time that he says: “This meat to me,” because one who prohibits a thing with a neder and it mixes with another thing —- if there is enough to give a flavor, it is forbidden.
Nedarim6: 7
הַנּוֹדֵר מִן ,,הַיַּיִן” — מֻתָּר בְּתַבְשִׁיל שֶׁיֶּשׁ בּוֹ טַעַם יָיִן. אָמַר: ,,קוֹנָם יַיִן זֶה שֶׁאֵינִי טוֹעֵם”, וְנָפַל לַתַּבְשִׁיל — אִם יֶשׁ בּוֹ בְּנוֹתֵן טַעַם הֲרֵי זֶה אָסוּר. הַנּוֹדֵר מִן ,,הָעֲנָבִים” — מֻתָּר בַּיַּיִן; מִן ,,הַזֵּיתִים” — מֻתָּר בַּשָּׁמֶן. אָמַר: ,,קוֹנָם זֵיתִים וַעֲנָבִים אֵלּוּ שֶׁאֵינִי טוֹעֵם” — אָסוּר בָּהֶן וּבַיּוֹצֵא מֵהֶן.
One who makes a neder prohibiting “wine” is permitted a cooked dish which has a taste of wine in it. [If] he said: “Konam, this wine with respect to my tasting [it],” and it fell into a cooked dish —- if it is enough to give flavor, it is forbidden. One who makes a neder prohibiting “grapes” is permitted wine; [if he makes a neder prohibiting] “olives,” he is permitted oil. [If] he said: “Konam, these olives and grapes with respect to my tasting [them],” he is forbidden them and what comes from them.
Nedarim6: 8
הַנּוֹדֵר מִן ,,הַתְּמָרִים” — מֻתָּר בִּדְבַשׁ תְּמָרִים. מִ,,סִּתְוָנִיּוֹת” — מֻתָּר בְּחֹמֶץ סִתְוָנִיּוֹת. רַבִּי יְהוּדָה בֶּן בְּתֵירָא אוֹמֵר: כֹּל שֶׁשֵּׁם תּוֹלַדְתּוֹ קְרוּיָה עָלָיו, וְנוֹדֵר הֵימֶנּוּ — אָסוּר אַף בַּיּוֹצֵא הֵימֶנּוּ. וַחֲכָמִים מַתִּירִין.
One who makes a neder prohibiting “dates” is permitted date honey. [If he makes a neder prohibiting] “winter grapes,” he is permitted vinegar of winter grapes. R' Yehudah ben Beseira says: Whenever the derivative carries the name of its source, and he makes a neder prohibiting the source, he is forbidden the derivative as well. The Sages, however, permit it.

הַנּוֹדֵר מִן ,,הַיַּיִן” — מֻתָּר בְּיֵין תַּפּוּחִים; מִן ,,הַשֶּׁמֶן” — מֻתָּר בְּשֶׁמֶן שֻׁמְשְׁמִין; מִן ,,הַדְּבַשׁ” — מֻתָּר בִּדְבַשׁ תְּמָרִים; מִן ,,הַחֹמֶץ” — מֻתָּר בְּחֹמֶץ סִתְוָנִיּוֹת; מִן ,,הַכְּרֵשִׁין” — מֻתָּר בַּקַּפְלוֹטוֹת; מִן ,,הַיָּרָק” — מֻתָּר בְּיַרְקוֹת הַשָּׂדֶה, מִפְּנֵי שֶׁהוּא שֵׁם לְוַי.
One who makes a neder prohibiting “wine” is permitted apple wine; [if he prohibited] “oil,” he is permitted sesame oil; [if] “honey,” he is permitted date honey; [if] “vinegar,” he is permitted vinegar of winter grapes; [if] “leek,” he is permitted leeks with a head; [if] “vegetables,” he is permitted wild vegetables because it is an appellative.

מִן ,,הַכְּרוּב” — אָסוּר בָּאִסְפַּרְגּוֹס; מִן ,,הָאִסְפַּרְגּוֹס” — מֻתָּר בַּכְּרוּב. מִן ,,הַגְּרִיסִין” — אָסוּר (מִן הַ) [בַּ]מִּקְפָּה, וְרַבִּי יוֹסֵי מַתִּיר; מִן ,,הַמִּקְפָּה” — מֻתָּר בַּגְּרִיסִין. מִן ,,הַמִּקְפָּה” — אָסוּר בַּשּׁוּם, וְרַבִּי יוֹסֵי מַתִּיר; מִן ,,הַשּׁוּם” — מֻתָּר בַּמִּקְפָּה. מִן ,,הָעֲדָשִׁים” — אָסוּר בָּאֲשִׁישִׁין, [וְרַבִּי יוֹסֵי מַתִּיר]; מִן ,,הָאֲשִׁישִׁים” — מֻתָּר בָּעֲדָשִׁים. ,,חִטָּה, חִטִּים שֶׁאֵינִי טוֹעֵם” — אָסוּר בָּהֶן בֵּין קֶמַח בֵּין פַּת. ,,גְּרִיס, גְּרִיסִין שֶׁאֵינִי טוֹעֵם” — אָסוּר בָּהֶן בֵּין חַיִּין בֵּין מְבֻשָּׁלִים. רַבִּי יְהוּדָה אוֹמֵר: ,,קוֹנָם גְּרִיס אוֹ חִטָּה שֶׁאֵינִי טוֹעֵם” — מֻתָּר לָכוֹס חַיִּים.
[If one made a neder prohibiting] “cabbage,” he is forbidden ispargos; [if] “ispargos,” he is permitted cabbage. [If] “grits,” he is forbidden grits pottage; R' Yose, how- ever, permits it. [If] “grits pottage,” he is permitted grits. [If] “grits pottage,” he is [also] forbidden garlic; R' Yose, however, permits it; [if] “garlic,” he is permitted grits pottage. [If] “lentils,” he is for- bidden waste of lentils; R' Yose, however, permits it; [if] “waste of lentils,” he is permitted lentils. [If one says:] “Wheat grain, wheat grains, with respect to my tasting [them],” he is forbidden them whether [in the form of] flour or bread; “Grits, grits with respect to my tasting [them],” he is forbidden them whether raw or cooked. R' Yehudah says: [If he says:] “Konam, grits or wheat grain with respect to my tasting,” he is permitted to chew them raw.
