בֵּית שַׁמַּאי אוֹמְרִים: אֵין מְמָאֲנִין אֶלָּא אֲרוּסוֹת; וּבֵית הִלֵּל אוֹמְרִים: אֲרוּסוֹת וּנְשׂוּאוֹת. בֵּית שַׁמַּאי אוֹמְרִים: בַּבַּעַל וְלֹא בַיָּבָם; וּבֵית הִלֵּל אוֹמְרִים: בַּבַּעַל וּבַיָּבָם. בֵּית שַׁמַּאי אוֹמְרִים: בְּפָנָיו; וּבֵית הִלֵּל אוֹמְרִים: בְּפָנָיו וְשֶׁלֹּא בְפָנָיו. בֵּית שַׁמַּאי אוֹמְרִים: בְּבֵית דִּין; וּבֵית הִלֵּל אוֹמְרִים: בְּבֵית דִּין וְשֶׁלֹּא בְבֵית דִּין. אָמְרוּ לָהֶן בֵּית הִלֵּל לְבֵית שַׁמַּאי: מְמָאֶנֶת וְהִיא קְטַנָּה, אֲפִלּוּ אַרְבָּעָה וַחֲמִשָּׁה פְעָמִים. אָמְרוּ לָהֶן בֵּית שַׁמַּאי: אֵין בְּנוֹת יִשְׂרָאֵל הֶפְקֵר! אֶלָּא מְמָאֶנֶת וּמַמְתֶּנֶת עַד שֶׁתַּגְדִּיל, וּתְמָאֵן וְתִנָּשֵׂא.
Beis Shammai say: Only those [who are] betrothed may refuse; but Beis Hillel say: Both those [who are] betrothed and those [who are] married [may refuse]. Beis Shammai say: [Only] the husband [may be refused], but not the yavam; while Beis Hillel say: [Both] the husband and the yavam [may be refused]. Beis Shammai say: [Refusal may only be made] in his presence; but Beis Hillel say: [It may be made] whether in his presence or not. Beis Shammai say: [Only] in court; but Beis Hillel say: Whether in court or out of court. Beis Hillel said to Beis Shammai: She may refuse while a minor, even four and five times. Beis Shammai replied: The daughters of Israel are not to be [treated as] promiscuous. Rather, she may refuse and wait until adulthood, or refuse and marry.
Yevamos13: 2
אֵיזוֹ הִיא קְטַנָּה שֶׁצְּרִיכָה לְמָאֵן? כֹּל שֶׁהִשִּׂיאוּהָ אִמָּהּ וְאַחֶיהָ לְדַעְתָּהּ. הִשִּׂיאוּהָ שֶׁלֹּא לְדַעְתָּהּ — אֵינָהּ צְרִיכָה לְמָאֵן. רַבִּי חֲנִינָא בֶּן אַנְטִיגְנוֹס אוֹמֵר: כָּל תִּינוֹקֶת שֶׁאֵינָהּ יְכוֹלָה לִשְׁמוֹר קִדּוּשֶׁיהָ אֵינָהּ צְרִיכָה לְמָאֵן. רַבִּי אֱלִיעֶזֶר אוֹמֵר: אֵין מַעֲשֵׂה קְטַנָּה כְּלוּם, אֶלָּא כִמְפֻתָּה. בַּת יִשְׂרָאֵל לְכֹהֵן, לֹא תֹאכַל בִּתְרוּמָה. בַּת כֹּהֵן לְיִשְׂרָאֵל — תֹּאכַל בִּתְרוּמָה.
Who is the minor [wife] who must refuse? Anyone whose mother or brothers gave her in marriage with her consent. [If] they gave her in marriage without her consent, she does not need to refuse. R' Chanina ben Antignos says: Any child who is unable to guard her betrothal [object] need not refuse. R' Eliezer says: A minor's act is void —- it is as if she had been seduced; a Yisrael's daughter [married] to a Kohen may not eat terumah, [and] a Kohen's daughter [married] to a Yisrael may eat terumah.
Yevamos13: 3
רַבִּי אֱלִיעֶזֶר בֶּן יַעֲקֹב אוֹמֵר: כָּל עַכָּבָה שֶׁהִיא מִן הָאִישׁ — כְּאִלּוּ הִיא אִשְׁתּוֹ; וְכָל עַכָּבָה שֶׁאֵינָהּ מִן הָאִישׁ — כְּאִלּוּ אֵינָהּ אִשְׁתּוֹ.
R' Eliezer ben Yaakov says: Whenever she stayed for the husband, she is [considered] like his wife; but whenever she did not stay for the husband, she is not [considered] like his wife.
Yevamos13: 4
הַמְמָאֶנֶת בָּאִישׁ — הוּא מֻתָּר בִּקְרוֹבוֹתֶיהָ, וְהִיא מֻתֶּרֶת בִּקְרוֹבָיו, וְלֹא פְסָלָהּ מִן הַכְּהֻנָּה. נָתַן לָהּ גֵּט — הוּא אָסוּר בִּקְרוֹבוֹתֶיהָ, וְהִיא אֲסוּרָה בִקְרוֹבָיו, וּפְסָלָהּ מִן הַכְּהֻנָּה. נָתַן לָהּ גֵּט וְהֶחֱזִירָהּ, מֵאֲנָה בוֹ וְנִשֵּׂאת לְאַחֵר וְנִתְאַרְמְלָה אוֹ נִתְגָּרְשָׁה — מֻתֶּרֶת לַחֲזוֹר לוֹ. מֵאֲנָה בוֹ וְהֶחֱזִירָהּ, נָתַן לָהּ גֵּט וְנִשֵּׂאת לְאַחֵר וְנִתְאַרְמְלָה אוֹ נִתְגָּרְשָׁה — אֲסוּרָה לַחֲזוֹר לוֹ. זֶה הַכְּלָל: גֵּט אַחַר מֵאוּן — אֲסוּרָה לַחֲזוֹר לוֹ. מֵאוּן אַחַר גֵּט — מֻתֶּרֶת לַחֲזוֹר לוֹ.
[If] a girl refuses her husband —- he is permitted to [marry] her relatives, she is permitted to [marry] his relatives, and she is not disqualified from the priesthood. [If] he gave her a bill of divorce —- he is prohibited from [marrying] her relatives, she is prohibited from [marrying] his relatives, and she is disqualified from the priesthood. [If] he divorced her and remarried her, and [then] she refused him and married another, and was widowed or divorced —- she may remarry him. [If] she refused him and he remarried her, [and then he] divorced her and she married another, and was widowed or divorced —- she may not remarry him. This is the rule: [In a case of] divorce after refusal, she is forbidden to remarry him; [in a case of] refusal after divorce, she is permitted to remarry him.
Yevamos13: 5
הַמְמָאֶנֶת בָּאִישׁ וְנִשֵּׂאת לְאַחֵר וְגֵרְשָׁהּ, לְאַחֵר וּמֵאֲנָה בוֹ, לְאַחֵר וְגֵרְשָׁהּ [לְאַחֵר וּמֵאֲנָה בוֹ], כֹּל שֶׁיָּצָאת הֵימֶנּוּ בְגֵט — אֲסוּרָה לַחֲזוֹר לוֹ. בְּמֵאוּן — מֻתֶּרֶת לַחֲזוֹר לוֹ.
[If] a girl refuses a husband and is [then] married to another who divorces her; [then] to another whom she refuses; [then] to another who divorces her; [then] to another whom she refuses —- she is forbidden to return to anyone from whom she was divorced, but is permitted to return to anyone [whom she] refused.

הַמְגָרֵשׁ אֶת הָאִשָּׁה וְהֶחֱזִירָהּ — מֻתֶּרֶת לַיָּבָם; וְרַבִּי אֱלִיעֶזֶר אוֹסֵר. וְכֵן הַמְגָרֵשׁ אֶת הַיְתוֹמָה וְהֶחֱזִירָהּ מֻתֶּרֶת לַיָּבָם; וְרַבִּי אֱלִיעֶזֶר אוֹסֵר. קְטַנָּה שֶׁהִשִּׂיאָהּ אָבִיהָ וְנִתְגָּרְשָׁה — כִּיתוֹמָה בְּחַיֵּי הָאָב. הֶחֱזִירָהּ — דִּבְרֵי הַכֹּל אֲסוּרָה לַיָּבָם.
[If] a man divorces his wife and then remarries her, she is permitted to the yavam; but R' Eliezer forbids [her]. So too, [if] someone divorces an orphan and then re- marries her, she is permitted to the yavam; but R' Eliezer forbids [her]. [If] a child was given in marriage by her father and was then divorced, she is like an orphan during her father's lifetime. [If] he remarries her, all agree that she is forbidden to the yavam.
Yevamos13: 7
שְׁנֵי אַחִין נְשׂוּאִין לִשְׁתֵּי אֲחָיוֹת יְתוֹמוֹת קְטַנּוֹת, וּמֵת בַּעְלָהּ שֶׁל אַחַת מֵהֶן — תֵּצֵא מִשּׁוּם אֲחוֹת אִשָּׁה. וְכֵן שְׁתֵּי חֵרְשׁוֹת. גְדוֹלָה וּקְטַנָּה, מֵת בַּעְלָהּ שֶׁל קְטַנָּה — תֵּצֵא הַקְּטַנָּה מִשּׁוּם אֲחוֹת אִשָּׁה. מֵת בַּעְלָהּ שֶׁל גְּדוֹלָה — רַבִּי אֱלִיעֶזֶר אוֹמֵר: מְלַמְּדִין אֶת הַקְּטַנָּה שֶׁתְּמָאֵן בּוֹ. רַבָּן גַּמְלִיאֵל אוֹמֵר: אִם מֵאֲנָה — מֵאֵנָה. וְאִם לָאו — תַּמְתִּין עַד שֶׁתַּגְדִּיל, וְתֵצֵא הַלֵּזוּ מִשּׁוּם אֲחוֹת אִשָּׁה. רַבִּי יְהוֹשֻׁעַ אוֹמֵר: אִי לוֹ עַל אִשְׁתּוֹ, וְאִי לוֹ עַל אֵשֶׁת אָחִיו — מוֹצִיא אֶת אִשְׁתּוֹ בְגֵט, וְאֵשֶׁת אָחִיו בַּחֲלִיצָה.
[If] two brothers were married to two minor orphaned sisters, and the husband of one died, she is discharged as his wife's sister. So too, [in the case of] two deaf-mutes. [If one was] an adult and [one was] a minor —- [if] the minor's husband died, the minor is discharged as his wife's sister; [if] the adult's husband died, R' Eliezer says: We teach the minor to refuse him. Rabban Gamliel says: If she refused, then she did so; but if not, let her wait until she reaches adulthood, and the other will [then] be discharged as his wife's sister. R' Yehoshua says: Woe unto him because of his wife, and woe unto him because of his brother's wife —- he must divorce his wife, and perform chalitzah with his brother's wife.
Yevamos13: 8
מִי שֶׁהָיָה נָשׂוּי לִשְׁתֵּי יְתוֹמוֹת קְטַנּוֹת, וָמֵת — בִּיאָתָהּ אוֹ חֲלִיצָתָהּ שֶׁל אַחַת מֵהֶן פּוֹטֶרֶת צָרָתָהּ. וְכֵן שְׁתֵּי חֵרְשׁוֹת. קְטַנָּה וְחֵרֶשֶׁת — אֵין בִּיאַת אַחַת מֵהֶן פּוֹטֶרֶת צָרָתָהּ. פִּקַּחַת וְחֵרֶשֶׁת — בִּיאַת הַפִּקַּחַת פּוֹטֶרֶת אֶת הַחֵרֶשֶׁת, וְאֵין בִּיאַת הַחֵרֶשֶׁת פּוֹטֶרֶת אֶת הַפִּקַּחַת. גְּדוֹלָה וּקְטַנָּה — בִּיאַת הַגְּדוֹלָה פּוֹטֶרֶת אֶת הַקְּטַנָּה, וְאֵין בִּיאַת הַקְּטַנָּה פּוֹטֶרֶת אֶת הַגְּדוֹלָה.
[If] someone was married to two minor orphans and died, cohabitation or chalitzah with one of them releases her co-wife. So too, [in the case of] two deaf-mutes. [If one was] a minor and [one was] a deaf-mute, cohabitation with one does not release her co-wife. [If one was] competent and [one was] a deaf-mute, cohabitation with the competent one releases the deaf-mute, but cohabitation with the deaf-mute does not release the competent one. [If one was] an adult and [one was] a minor, cohabitation with the adult releases the minor, but cohabitation with the minor does not release the adult.

מִי שֶׁהָיָה נָשׂוּי לִשְׁתֵּי יְתוֹמוֹת קְטַנּוֹת, וָמֵת, בָּא יָבָם עַל הָרִאשׁוֹנָה וְחָזַר וּבָא עַל הַשְּׁנִיָּה, אוֹ שֶׁבָּא אָחִיו עַל הַשְּׁנִיָּה לֹא פָסַל אֶת הָרִאשׁוֹנָה. וְכֵן שְׁתֵּי חֵרְשׁוֹת. קְטַנָּה וְחֵרֶשֶׁת, בָּא יָבָם עַל הַקְּטַנָּה וְחָזַר וּבָא עַל הַחֵרֶשֶׁת, אוֹ שֶׁבָּא אָחִיו עַל הַחֵרֶשֶׁת — לֹא פָסַל אֶת הַקְּטַנָּה. בָּא יָבָם עַל הַחֵרֶשֶׁת וְחָזַר וּבָא עַל הַקְּטַנָּה, אוֹ שֶׁבָּא אָחִיו עַל הַקְּטַנָּה — פָּסַל אֶת הַחֵרֶשֶׁת.
[If] someone was married to two minor orphans and died, [if] the yavam cohabited with the first one and then with the second one, or his brother cohabited with the second one, he did not disqualify the first one. So too, [in the case of] two deaf-mutes. [If one was] a minor and [one was] a deaf-mute, [if] the yavam cohabited with the minor and then with the deaf-mute, or [if] his brother [then] cohabited with the deaf-mute, he did not disqualify the minor. [If] the yavam cohabited with the deaf-mute and then with the minor, or his brother [then] cohabited with the minor, he disqualified the deaf-mute.
Yevamos13: 10
פִּקַּחַת וְחֵרֶשֶׁת, בָּא יָבָם עַל הַפִּקַּחַת וְחָזַר וּבָא עַל הַחֵרֶשֶׁת, אוֹ שֶׁבָּא אָחִיו עַל הַחֵרֶשֶׁת — לֹא פָסַל אֶת הַפִּקַּחַת. בָּא יָבָם עַל הַחֵרֶשֶׁת וְחָזַר וּבָא עַל הַפִּקַּחַת, אוֹ שֶׁבָּא אָחִיו עַל הַפִּקַּחַת — פָּסַל אֶת הַחֵרֶשֶׁת.
[If one was] competent and [one was] a deaf-mute, [if] the yavam cohabited with the competent one and then with the deaf-mute, or his brother cohabited with the deaf-mute, he did not disqualify the competent one. [If] the yavam cohabited with the deaf-mute and then with the competent one, or if his brother [then] cohabited with the competent one, he disqualified the deaf-mute.
Yevamos13: 11
גְּדוֹלָה וּקְטַנָּה, בָּא יָבָם עַל הַגְּדוֹלָה וְחָזַר וּבָא עַל הַקְּטַנָּה, אוֹ שֶׁבָּא אָחִיו עַל הַקְּטַנָּה — לֹא פָסַל אֶת הַגְּדוֹלָה. בָּא יָבָם עַל הַקְּטַנָּה וְחָזַר וּבָא עַל הַגְּדוֹלָה, אוֹ שֶׁבָּא אָחִיו עַל הַגְּדוֹלָה — פָּסַל אֶת הַקְּטַנָּה. רַבִּי אֶלְעָזָר אוֹמֵר: מְלַמְּדִין הַקְּטַנָּה שֶׁתְּמָאֵן בּוֹ.
[If one was] an adult and [one was] a minor, [if] the yavam cohabited with the adult and then with the minor, or [if] his brother [then] cohabited with the minor, he did not disqualify the adult. [If] the yavam cohabited with the minor and then with the adult, or [if] his brother [then] cohabited with the adult, he disqualified the minor. R' Elazar says: We teach the minor to refuse him.
Yevamos13: 12
יָבָם קָטָן שֶׁבָּא עַל יְבָמָה קְטַנָּה — יִגְדְּלוּ זֶה עִם זֶה. בָּא עַל יְבָמָה גְדוֹלָה — תְּגַדְּלֶנּוּ. הַיְבָמָה שֶׁאָמְרָה בְּתוֹךְ שְׁלֹשִׁים יוֹם ,,לֹא נִבְעַלְתִּי” — כּוֹפִין אוֹתוֹ שֶׁיַּחֲלוֹץ לָהּ. לְאַחַר שְׁלֹשִׁים יוֹם — מְבַקְשִׁים הֵימֶנּוּ שְׁיַּחֲלוֹץ לָהּ. וּבִזְמַן שֶׁהוּא מוֹדֶה — אֲפִלּוּ לְאַחַר שְׁנֵים עָשָׂר חֹדֶשׁ כּוֹפִין אוֹתוֹ שֶׁיַּחֲלוֹץ לָהּ.
[If] a minor yavam cohabited with a minor yevamah, they must wait for each other to grow up. [If] he cohabited with an adult yevamah, she must wait for him to grow up. [If] a yevamah stated within thirty days, “He did not cohabit with me,” we coerce him to perform chalitzah with her; [if she stated this] after thirty days, we request of him that he perform chalitzah with her. However, if he admits [to it], then even after twelve months we coerce him to perform chalitzah with her.
Yevamos13: 13
הַנּוֹדֶרֶת הֲנָאָה מִיבָמָהּ בְּחַיֵּי בַעְלָהּ — כּוֹפִין אוֹתוֹ שֶׁיַּחֲלוֹץ לָהּ. לְאַחַר מִיתַת בַּעְלָהּ — מְבַקְשִׁין הֵימֶנּוּ שֶׁיַּחֲלוֹץ לָהּ. וְאִם נִתְכַּוְּנָה לְכָךְ, אֲפִלּוּ בְּחַיֵּי בַעְלָהּ מְבַקְשִׁין הֵימֶנּוּ שֶׁיַּחֲלוֹץ לָּהּ.
[If] a woman vowed not to derive benefit from her yavam —- [if she vowed so] during her husband's lifetime, we coerce him to perform chalitzah with her; [if she vowed so] after her husband's death, we request of him that he perform chalitzah with her. However, if she intended this, then even [if she vowed] during her husband's lifetime, we [only] request of him that he perform chalitzah with her.
Suggestions
