הַמֵּנִיחַ אִיסָר וְאָכַל עָלָיו חֲצִי, וְהָלַךְ לְמָקוֹם אַחֵר וַהֲרֵי הוּא יוֹצֵא בְּפֻנְדְּיוֹן, אוֹכֵל עָלָיו עוֹד אִיסָר.
הַמֵּנִיחַ פֻּנְדְּיוֹן וְאָכַל עָלָיו חֶצְיוֹ, וְהָלַךְ לְמָקוֹם אַחֵר וַהֲרֵי הוּא יוֹצֵא בְאִיסָר, אוֹכֵל עָלָיו עוֹד פְּלָג.
הַמֵּנִיחַ אִיסָר שֶׁל מַעֲשֵׂר שֵׁנִי, אוֹכֵל עָלָיו אַחַד עָשָׂר בְּאִיסָר, וְאֶחָד מִמֵּאָה בְּאִיסָר. בֵּית שַׁמַּאי אוֹמְרִים: הַכֹּל עֲשָׂרָה. וּבֵית הִלֵּל אוֹמְרִים: בְּוַדַּאי, אַחַד עָשָׂר; וּבִדְמַאי, עֲשָׂרָה.
One who set down an issar and ate against half [of it], then went to another place where it can be spent as a pundeyon, may eat another issar against it.
One who set down a pundeyon and ate against half of it, then went to another place where it can [only] be spent as an issar, may eat another half against it. One who set down an issar of maaser sheni may eat eleven per issar against it, and one from a hundred per issar. Beis Shammai say: It all is ten. But Beis Hillel say: In definite [maaser sheni], eleven; but in demai, ten.
Ma'aser Sheini4: 9
כָּל הַמָּעוֹת הַנִּמְצָאִים, הֲרֵי אֵלּוּ חֻלִּין, אֲפִלּוּ דִינַר זָהָב עִם הַכֶּסֶף וְעִם הַמָּעוֹת. מָצָא בְתוֹכָן חֶרֶשׂ וְכָתוּב עָלָיו: ,,מַעֲשֵׂר”, הֲרֵי זֶה מַעֲשֵׂר.
All coins that are found, these are chullin, even a gold dinar with a silver [one] and with [copper] coins. [If] he found among them a potsherd upon which it was written “maaser,” then it is maaser [sheni].
Ma'aser Sheini4: 10
הַמּוֹצֵא כְלִי וְכָתוּב עָלָיו: ,,קָרְבָּן”, רַבִּי יְהוּדָה אוֹמֵר: אִם הָיָה שֶׁל חֶרֶס, הוּא חֻלִּין, וּמַה שֶּׁבְּתוֹכוֹ קָרְבָּן. וְאִם הָיָה שֶׁל מַתֶּכֶת, הוּא קָרְבָּן, וּמַה שֶּׁבְּתוֹכוֹ חֻלִּין. אָמְרוּ לוֹ: אֵין דֶּרֶךְ בְּנֵי אָדָם לִהְיוֹת כּוֹנְסִין חֻלִּין לְקָרְבָּן.
One who finds a vessel, and upon it is written “korban,” R' Yehudah says: If it was pottery, it is chullin, but that which is in it is consecrated. But if it was metal, it is consecrated, and what is in it is chullin. They said to him: It is not the way of people to put chullin into [a thing that is] consecrated.
Ma'aser Sheini4: 11
הַמּוֹצֵא כְלִי וְכָתוּב עָלָיו: ,,קוף”, קָרְבָּן; ,,מ' ”, מַעֲשֵׂר; ,,ד' ”, דְּמַאי; ,,ט' ”, טֶבֶל; ,,ת' ”, תְּרוּמָה, שֶׁבִּשְׁעַת סַכָּנָה הָיוּ כוֹתְבִין ,,ת' ” תַּחַת תְּרוּמָה. רַבִּי יוֹסֵי אוֹמֵר: כֻּלָּם שְׁמוֹת בְּנֵי אָדָם הֵם. אָמַר רַבִּי יוֹסֵי: אֲפִלּוּ מָצָא חָבִית וְהִיא מְלֵאָה פֵרוֹת וְכָתוּב עָלֶיהָ: ,,תְּרוּמָה”, הֲרֵי אֵלּוּ חֻלִּין, שֶׁאֲנִי אוֹמֵר: אֶשְׁתָּקַד הָיְתָה מְלֵאָה פֵרוֹת תְּרוּמָה, וּפִנָּהּ.
One who finds a container, and upon it is written [the letter] “kuf,” [it is] consecrated; “mem,” [it is] maaser [sheni]; “dalet,” [it is] demai; “tes,” [it is] tevel; “tav,” [it is] terumah, for in a time of danger they would write “tav” instead of terumah. R' Yose says: They are all names of people. Said R' Yose: Even if he found a barrel and it was full of fruits, and upon it is written “terumah,” they are chullin, for I say: Last year it was full of produce of terumah and he emptied it.
Ma'aser Sheini4: 12
הָאוֹמֵר לִבְנוֹ: ,,מַעֲשֵׂר שֵׁנִי בְזָוִית זוֹ”, וּמָצָא בְזָוִית אַחֶרֶת, הֲרֵי אֵלּוּ חֻלִּין. הָיָה שָׁם מָנֶה וּמָצָא מָאתַיִם, הַשְּׁאָר חֻלִּין; מָאתַיִם וּמָצָא מָנֶה, הַכֹּל מַעֲשֵׂר.
One who says to his son: “Maaser sheni is in this corner,” and he finds [money] in another corner, it is chullin. [If] one hundred had been there and he found two hundred, the rest is chullin; two hundred and he found one hundred, it is all maaser [sheni].

כֶּרֶם רְבָעִי מְצַיְּנִין אוֹתוֹ בְקוֹזְזוֹת אֲדָמָה; וְשֶׁל עָרְלָה בְחַרְסִית; וְשֶׁל קְבָרוֹת בְּסִיד וּמַמְחֶה וְשׁוֹפֵךְ. אָמַר רַבָּן שִׁמְעוֹן בֶּן גַּמְלִיאֵל: בַּמֶּה דְבָרִים אֲמוּרִים? בִּשְׁבִיעִית. וְהַצְּנוּעִים מְנִיחִין אֶת הַמָּעוֹת וְאוֹמְרִים: ,,כָּל הַנִּלְקַט מִזֶּה יְהֵא מְחֻלָּל עַל הַמָּעוֹת הָאֵלּוּ”.
A fourth-year vineyard is marked with clumps of earth; and orlah with clay; and graves with lime [that] he mixes [with water] and pours. Rabban Shimon ben Gamliel said: When are these things said? During the Shemittah [lit., seventh] year. However the discreet ones place down the coins and say: “Whatever will have been picked from this [vineyard] shall be deconsecrated on these coins.”

כֶּרֶם רְבָעִי הָיָה עוֹלֶה לִירוּשָׁלַיִם מַהֲלַךְ יוֹם אֶחָד לְכָל צַד. וְאֵי זוֹ הִיא תְחוּמָהּ? אֵילַת מִן הַדָּרוֹם וְעַקְרַבַּת מִן הַצָּפוֹן; לֹד מִן הַמַּעֲרָב וְהַיַּרְדֵּן מִן הַמִּזְרָח. וּמִשֶּׁרַבּוּ הַפֵּרוֹת, הִתְקִינוּ שֶׁיְּהֵא נִפְדֶּה סָמוּךְ לַחוֹמָה. וּתְנַאי הָיָה הַדָּבָר, שֶׁאֵימָתַי שֶׁיִּרְצוּ, יַחֲזֹר הַדָּבָר לִכְמוֹת שֶׁהָיָה. רַבִּי יוֹסֵי אוֹמֵר: מִשֶּׁחָרַב בֵּית הַמִּקְדָּשׁ הָיָה הַתְּנַאי הַזֶּה. וּתְנַאי הָיָה אֵימָתַי שֶׁיִּבָּנֶה בֵּית הַמִּקְדָּשׁ, יַחֲזֹר הַדָּבָר לִכְמוֹת שֶׁהָיָה.
[Grapes of] a fourth year vineyard were brought up to Jerusalem [from any place within] a day's travel in every direction. And what were its boundaries? Eilas from the south and Akrabas from the north; Lod from the west and the Jordan River from the east. But when the [supply of] produce became abundant, they enacted that it be redeemed near to the wall. However there was a stipulation [to] the matter, that whenever they wanted, the matter would revert to the way it was before. R' Yose says: [It was] when the Temple was destroyed that this stipulation was [made]; and [the] stipulation was [that] when the Temple will be rebuilt, the matter would revert to the way it was before.
Ma'aser Sheini5: 3
כֶּרֶם רְבָעִי, בֵּית שַׁמַּאי אוֹמְרִים: אֵין לוֹ חֹמֶשׁ וְאֵין לוֹ בִעוּר. וּבֵית הִלֵּל אוֹמְרִים: יֵשׁ לוֹ.
בֵּית שַׁמַּאי אוֹמְרִים: יֵשׁ לוֹ פֶרֶט וְיֵשׁ לוֹ עוֹלֵלוֹת, וְהָעֲנִיִּים פּוֹדִין לְעַצְמָן. וּבֵית הִלֵּל אוֹמְרִים: כֻּלוֹ לַגַּת.
A fourth-year vineyard, Beis Shammai say: It is not subject to [the law of] a fifth, nor is it subject to [the law of] disposal. But Beis Hillel say: It is subject [to these laws]. Beis Shammai say: It is subject to the law of peret and the law of oleilos, and the poor people redeem for themselves. But Beis Hillel say: All of it [goes] to the wine press.
Ma'aser Sheini5: 4
כֵּיצַד פּוֹדִין נֶטַע רְבָעִי? מֵנִיחַ אֶת הַסַּל עַל פִּי שְׁלֹשָׁה, וְאוֹמֵר: ,,כַּמָּה אָדָם רוֹצֶה לִפְדּוֹת לוֹ בְסֶלַע, עַל מְנָת לְהוֹצִיא יְצִיאוֹת מִבֵּיתוֹ?” וּמֵנִיחַ אֶת הַמָּעוֹת וְאוֹמֵר: ,,כָּל הַנִּלְקַט מִזֶּה מְחֻלָּל עַל הַמָּעוֹת הָאֵלּוּ, בְּכָךְ וְכָךְ סַלִּים בְּסֶלַע”.
How does one redeem reva'i produce? He places the basket before three people, and says: “How much [of this produce] will a person want to buy for himself for a sela, it being under-stood that the expenses come from his pocket?” And he puts down the coins and says: “Whatever was picked from this [crop] is redeemed on these coins, based on the rate of so many baskets per sela.”
Ma'aser Sheini5: 5
וּבִשְׁבִיעִית, פּוֹדֵהוּ בְשָׁוְיוֹ. וְאִם הָיָה הַכֹּל מֻפְקָר, אֵין לוֹ אֶלָּא שְׂכַר לְקִיטָה.
הַפּוֹדֶה נֶטַע רְבָעִי שֶׁלּוֹ, מוֹסִיף עָלָיו חֲמִישִׁיתוֹ, בֵּין שֶׁהוּא שֶׁלּוֹ וּבֵין שֶׁנִּתַּן לוֹ בְמַתָּנָה.
However, in the Shemittah [lit., seventh] year, one redeems it for its worth. And if all of it was ownerless, he is only entitled to the cost of picking. [If] someone redeems his own fourth-year plantation, he adds to it its fifth, whether it is his [own] or whether it was given to him as a gift.
Ma'aser Sheini5: 6
עֶרֶב יוֹם טוֹב הָרִאשׁוֹן שֶׁל פֶּסַח שֶׁל רְבִיעִית וְשֶׁל שְׁבִיעִית, הָיָה בִעוּר. כֵּיצַד הָיָה בִעוּר? נוֹתְנִין תְּרוּמָה וּתְרוּמַת מַעֲשֵׂר לַבְּעָלִים, וּמַעֲשֵׂר רִאשׁוֹן לִבְעָלָיו, וּמַעְשַׂר עָנִי לִבְעָלָיו. וּמַעֲשֵׂר שֵׁנִי וְהַבִּכּוּרִים מִתְבָּעֲרִים בְּכָל מָקוֹם. רַבִּי שִׁמְעוֹן אוֹמֵר: הַבִּכּוּרִים נִתָּנִין לַכֹּהֲנִים כִּתְרוּמָה.
הַתַּבְשִׁיל, בֵּית שַׁמַּאי אוֹמְרִים: צָרִיךְ לְבַעֵר. וּבֵית הִלֵּל אוֹמְרִים: הֲרֵי הוּא כִמְבֹעָר.
[On] the day before the first day of Pesach of the fourth and the seventh [years], the disposal took place. How was the removal [performed]? Terumah and terumas maaser are given to its owners, and maaser rishon to its owner, and maaser ani to its owner. But maaser sheni and bikkurim must be removed [from] every place. R' Shimon says: The bikkurim are given to the Ko-hanim just like terumah.
[Regarding] a cooked dish, Beis Shammai say: It must be removed. But Beis Hillel say: It is regarded as if it were re-moved.
Ma'aser Sheini5: 7
מִי שֶׁהָיוּ לוֹ פֵרוֹת בַּזְּמַן הַזֶּה וְהִגִּיעָה שְׁעַת הַבִּעוּר, בֵּית שַׁמַּאי אוֹמְרִים: צָרִיךְ לְחַלְּלָן עַל הַכֶּסֶף. וּבֵית הִלֵּל אוֹמְרִים: אֶחָד שֶׁהֵן כֶּסֶף וְאֶחָד שֶׁהֵן פֵּרוֹת.
[If] someone had produce nowadays and the deadline for biur arrived, Beis Shammai say: One must redeem them on money. But Beis Hillel say: Whether they are money and whether they are produce.
Ma'aser Sheini5: 8
אָמַר רַבִּי יְהוּדָה: בָּרִאשׁוֹנָה הָיוּ שׁוֹלְחִין אֵצֶל בַּעֲלֵי בָתִּים שֶׁבַּמְּדִּינוֹת: ,,מַהֲרוּ וְהַתְקִינוּ אֶת פֵּרוֹתֵיכֶם עַד שֶׁלֹּא תַגִּיעַ שְׁעַת הַבִּעוּר”. עַד שֶׁבָּא רַבִּי עֲקִיבָא וְלִמֵּד שֶׁכָּל הַפֵּרוֹת שֶׁלֹּא בָאוּ לְעוֹנַת הַמַּעַשְׂרוֹת פְּטוּרִים מִן הַבִּעוּר.
R' Yehudah said: At first they would send to the owners in the provinces, “Hurry and prepare your produce before the time for biur arrives.” Until R' Akiva came and taught that all produce that did not reach the tithing stage is exempt from the removal.
Ma'aser Sheini5: 9
מִי שֶׁהָיוּ פֵרוֹתָיו רְחוֹקִים מִמֶּנּוּ צָרִיךְ לִקְרוֹא לָהֶם שֵׁם. מַעֲשֶׂה בְרַבָּן גַּמְלִיאֵל וְהַזְּקֵנִים, שֶׁהָיוּ בָאִין בִּסְפִינָה; אָמַר רַבָּן גַּמְלִיאֵל: ,,עִשּׂוּר שֶׁאֲנִי עָתִיד לָמֹד נָתוּן לִיהוֹשֻׁעַ, וּמְקוֹמוֹ מֻשְׂכָּר לוֹ; עִשּׂוּר אַחֵר שֶׁאֲנִי עָתִיד לָמֹד נָתוּן לַעֲקִיבָא בֶן יוֹסֵף שֶׁיִּזְכֶּה בוֹ לָעֲנִיִּים, וּמְקוֹמוֹ מֻשְׂכָּר לוֹ”. אָמַר רַבִּי יְהוֹשֻׁעַ: ,,עִשּׂוּר שֶׁאֲנִי עָתִיד לָמֹד נָתוּן לְאֶלְעָזָר בֶּן עֲזַרְיָה, וּמְקוֹמוֹ מֻשְׂכָּר לוֹ”. וְנִתְקַבְּלוּ זֶה מִזֶּה שָׂכָר.
Someone whose produce is far away from him must assign them a name. There was an incident involving Rabban Gamliel and the Elders, who were traveling on a ship; Rabban Gamliel declared: “The tenth that I will, in the future, measure out is [hereby] given to Yehoshua, and its place is leased to him; another tenth that I will, in the future, measure out is [hereby] given to Akiva ben Yosef so that he will acquire it on be-half of the poor, and its place is leased to him.” R' Yehoshua said: “The tenth that I intend to measure out is given to Elazar ben Azaryah, and its location is rented to him.” And they received rent from one an-other.
