Shevi'is 10:7 - Terumos 2:2

חֲמִשָּׁה לֹא יִתְרוֹמוּ; וְאִם תָּרְמוּ, אֵין תְּרוּמָתָן תְּרוּמָה: הַחֵרֵשׁ, וְהַשּׁוֹטֶה, וְהַקָּטָן, וְהַתּוֹרֵם אֶת שֶׁאֵינוֹ שֶׁלּוֹ. עוֹבֵד כּוֹכָבִים שֶׁתָּרַם אֶת שֶׁל יִשְׂרָאֵל, אֲפִלּוּ בִרְשׁוּת, אֵין תְּרוּמָתוֹ תְּרוּמָה.
[The following] five [individuals] should not separate terumah; if they did separate te-rumah, their terumah is not terumah: a deaf person, a deranged person, a minor, and one who separates terumah from that which is not his. [If] a non-Jew separates terumah from [the produce] of a Jew, even with [the Jew's] consent, his terumah is not terumah.

חֵרֵשׁ הַמְדַבֵּר וְאֵינוֹ שׁוֹמֵעַ לֹא יִתְרוֹם; וְאִם תָּרַם, תְּרוּמָתוֹ תְּרוּמָה. חֵרֵשׁ שֶׁדִּבְּרוּ בוֹ חֲכָמִים בְּכָל מָקוֹם, שֶׁאֵינוֹ לֹא שׁוֹמֵעַ וְלֹא מְדַבֵּר.
A deaf person who can speak but cannot hear may not separate terumah; but if he did separate terumah, his terumah is te-rumah. The deaf person of whom the Sages spoke in all places [is one] who can neither hear nor speak.
Terumos1: 3
קָטָן שֶׁלֹּא הֵבִיא שְׁתֵּי שְׂעָרוֹת, רַבִּי יְהוּדָה אוֹמֵר: תְּרוּמָתוֹ תְּרוּמָה. רַבִּי יוֹסֵי אוֹמֵר: אִם עַד שֶׁלֹּא בָא לְעוֹנַת נְדָרִים, אֵין תְּרוּמָתוֹ תְּרוּמָה; וּמִשֶּׁבָּא לְעוֹנַת נְדָרִים, תְּרוּמָתוֹ תְּרוּמָה.
[Regarding] a minor who has not grown two hairs, R' Yehudah says: His terumah is terumah. R' Yose says: If he has not yet reached the age of vows, his terumah is not terumah; but when he has reached the age of vows, his terumah is terumah.

אֵין תּוֹרְמִין זֵיתִים עַל הַשֶּׁמֶן, וְלֹא עֲנָבִים עַל הַיַּיִן. וְאִם תָּרְמוּ, בֵּית שַׁמַּאי אוֹמְרִים: תְּרוּמַת עַצְמָן בָּהֶם. וּבֵית הִלֵּל אוֹמְרִים: אֵין תְּרוּמָתָן תְּרוּמָה.
We may not designate olives as terumah on behalf of oil, nor grapes [as terumah] on behalf of wine. If one did designate te-rumah [thus], Beis Shammai say: Their own terumah is [contained] within them. But Beis Hillel say: The terumah is not te-rumah [at all].

אֵין תּוֹרְמִין מִן הַלֶּקֶט, וּמִן הַשִּׁכְחָה, וּמִן הַפֵּאָה, וּמִן הַהֶפְקֵר; וְלֹא מִמַּעֲשֵׂר רִאשׁוֹן שֶׁנִּטְּלָה תְרוּמָתוֹ; וְלֹא מִמַּעֲשֵׂר שֵׁנִי וְהֶקְדֵּשׁ שֶׁנִּפְדּוּ; וְלֹא מִן הַחִַיָּיב עַל הַפָּטוּר, וְלֹא מִן הַפָּטוּר עַל הַחִַיָּיב; וְלֹא מִן הַתָּלוּשׁ עַל הַמְחֻבָּר, וְלֹא מִן הַמְחֻבָּר עַל הַתָּלוּשׁ; וְלֹא מִן הֶחָדָשׁ עַל הַיָּשָׁן, וְלֹא מִן הַיָּשָׁן עַל הֶחָדָשׁ; וְלֹא מִפֵּרוֹת הָאָרֶץ עַל פֵּרוֹת חוּצָה לָאָרֶץ, וְלֹא מִפֵּרוֹת חוּצָה לָאָרֶץ עַל פֵּרוֹת הָאָרֶץ. וְאִם תָּרְמוּ, אֵין תְּרוּמָתָן תְּרוּמָה.
We may not designate terumah from leket, from shich'chah, from pe'ah, or from ownerless [produce]; nor from maaser rishon whose terumah was [already] taken; nor from maaser sheni and consecrated produce that were re-deemed; nor from that which is obligated [in tithing] on behalf of that which is exempt [from tithing], or from that which is exempt on behalf of that which is obligated; nor from that which is detached [from the ground] on behalf of that which is attached, or from that which is attached on behalf of that which is detached; nor from the new [crop] on behalf of the old [crop], or from the old [crop] on behalf of the new [crop]; nor from produce of the Land [of Israel] on behalf of produce from outside the Land, or from pro-duce from outside the Land on behalf of produce of the Land. If they designated terumah [thus], their terumah is not terumah.
Terumos1: 6
חֲמִשָּׁה לֹא יִתְרוֹמוּ, וְאִם תָּרְמוּ, תְּרוּמָתָן תְּרוּמָה . הָאִלֵּם, וְהַשִּׁכּוֹר, וְהֶעָרֹם, וְהַסּוּמָא, וּבַעַל קֶרִי לֹא יִתְרוֹמוּ, וְאִם תָּרְמוּ, תְּרוּמָתָן תְּרוּמָה.
[The following] five [individuals] should not separate terumah, but if they did separate terumah, their terumah is terumah: One who is mute, a drunk person, one who is unclothed, a blind person, and one who experienced a seminal emission should not separate terumah, but if they did separate terumah, their terumah is terumah.

אֵין תּוֹרְמִין לֹא בְמִדָּה, וְלֹא בְמִשְׁקָל, וְלֹא בְמִנְיָן; אֲבָל תּוֹרֵם הוּא אֶת הַמָּדוּד וְאֶת הַשָּׁקוּל וְאֶת הַמָּנוּי. אֵין תּוֹרְמִין בְּסַל וּבְקֻפָּה שֶׁהֵם שֶׁל מִדָּה; אֲבָל תּוֹרֵם הוּא בָהֶן חֶצְיָן וּשְׁלִישָׁן. לֹא יִתְרוֹם בִּסְאָה חֶצְיָהּ, שֶׁחֶצְיָהּ מִדָּה.
We may not separate terumah by measure, nor by weight nor by count; but one may separate terumah from that which is measured, from that which is weighed and from that which is counted.  We may not separate terumah with a basket or a container of [known] measure; but one may use them to separate terumah using half [their volume] or a third [of their vol-ume]. One may not separate terumah using half [the volume of] a se'ah container, for half [a se'ah container] is a [precise] measure.

אֵין תּוֹרְמִין שֶׁמֶן עַל זֵיתִים הַנִּכְתָּשִׁין, וְלֹא יַיִן עַל עֲנָבִים הַנִּדְרָכִים. וְאִם תָּרַם, תְּרוּמָתוֹ תְּרוּמָה, וְיַחֲזוֹר וְיִתְרוֹם. הָרִאשׁוֹנָה מְדַמַּעַת בִּפְנֵי עַצְמָהּ, וְחַיָּבִין עָלֶיהָ חֹמֶשׁ, אֲבָל לֹא שְׁנִיָּה.
We may not separate oil as terumah on behalf of crushed olives, nor wine on behalf of pressed grapes. If one separated te-rumah [thus], his terumah is terumah, but he must separate terumah again. The first [terumah] renders a mixture forbidden by itself, and we are liable to [a surcharge of] a fifth for it, but not the second [terumah].

וְתוֹרְמִין שֶׁמֶן עַל זֵיתִים הַנִּכְבָּשִׁים, וְיַיִן עַל עֲנָבִים לַעֲשׂוֹתָם צִמּוּקִים. הֲרֵי שֶׁתָּרַם שֶׁמֶן עַל זֵיתִים לַאֲכִילָה וְזֵיתִים עַל זֵיתִים לַאֲכִילָה, וְיַיִן עַל עֲנָבִים לַאֲכִילָה וַעֲנָבִים עַל עֲנָבִים לַאֲכִילָה, וְנִמְלַךְ לְדָרְכָן, אֵינוֹ צָרִיךְ לִתְרוֹם.
But we may separate oil as terumah on behalf of preserved olives, and wine on behalf of grapes that will be made into raisins. If one separated oil as terumah on behalf of olives [used] for eating or olives on behalf of olives [used] for eating, or wine on behalf of grapes [used] for eating or grapes on behalf of grapes [used] for eating, and he reconsiders [and decides] to press them, he need not separate terumah [again].

אֵין תּוֹרְמִין מִדָּבָר שֶׁנִּגְמְרָה מְלַאכְתּוֹ עַל דָּבָר שֶׁלֹּא נִגְמְרָה מְלַאכְתּוֹ, וְלֹא מִדָּבָר שֶׁלֹּא נִגְמְרָה מְלַאכְתּוֹ עַל דָּבָר שֶׁנִּגְמְרָה מְלַאכְתּוֹ, וְלֹא מִדָּבָר שֶׁלֹּא נִגְמְרָה מְלַאכְתּוֹ עַל דָּבָר שֶׁלֹּא נִגְמְרָה מְלַאכְתּוֹ. וְאִם תָּרְמוּ, תְּרוּמָתָן תְּרוּמָה.
We may not separate terumah from an item whose processing is completed on behalf of an item whose processing is not com-pleted, nor from an item whose processing is not completed on behalf of an item whose processing is completed, nor from an item whose processing is not completed on behalf of an item whose processing is not completed. But if they separated te-rumah [thus], their terumah is terumah.
Terumos2: 1
אֵין תּוֹרְמִין מִטָּהוֹר עַל הַטָּמֵא. וְאִם תָּרְמוּ, תְּרוּמָתָן תְּרוּמָה.  בֶּאֱמֶת אָמְרוּ: הָעִגּוּל שֶׁל דְּבֵלָה שֶׁנִּטְמָא מִקְצָתוֹ, תּוֹרֵם מִן הַטָּהוֹר שֶׁיֵּשׁ בּוֹ עַל הַטָּמֵא שֶׁיֵּשׁ בּוֹ, וְכֵן אֲגֻדָּה שֶׁל יָרָק, וְכֵן עֲרֵמָה. הָיוּ שְׁנֵי עִגּוּלִים, שְׁתֵּי אֲגֻדּוֹת, שְׁתֵּי עֲרֵמוֹת, אַחַת טְמֵאָה וְאַחַת טְהוֹרָה, לֹא יִתְרוֹם מִזֶּה עַל זֶה. רַבִּי אֱלִיעֶזֶר אוֹמֵר: תּוֹרְמִין מִן הַטָּהוֹר עַל הַטָּמֵא.
We may not separate terumah from tahor [produce] on behalf of tamei [produce]. But if they separated terumah [thus], their terumah is terumah. In truth, they said: [Regarding] a round cake of pressed figs part of which became tamei, one may separate terumah from the tahor [figs] it contains on behalf of the tamei [figs] it contains, and likewise for a bundle of vegetables, and likewise for a pile [of produce]. If there were two round cakes [of figs], two bundles [of vegetables], or two piles [of produce], one [of which is] tamei and one [of which is] tahor, one may not separate terumah from this [one] on behalf of that [one].  Rab-bi Eliezer says: We may separate terumah from tahor [produce] on behalf of tamei [produce].
Terumos2: 2
אֵין תּוֹרְמִין מִן הַטָּמֵא עַל הַטָּהוֹר. וְאִם תָּרַם, שׁוֹגֵג, תְּרוּמָתוֹ תְּרוּמָה. וּמֵזִיד, לֹא עָשָׂה כְלוּם. וְכֵן בֶּן לֵוִי שֶׁהָיָה לוֹ מַעֲשֵׂר טֶבֶל, הָיָה מַפְרִישׁ עָלָיו וְהוֹלֵךְ, שׁוֹגֵג, מַה שֶּׁעָשָׂה עָשׂוּי; מֵזִיד, לֹא עָשָׂה כְלוּם. רַבִּי יְהוּדָה אוֹמֵר: אִם הָיָה יוֹדֵעַ בּוֹ בַּתְּחִלָּה, אַף עַל פִּי שֶׁהוּא שׁוֹגֵג, לֹא עָשָׂה כְלוּם.
We may not separate terumah from tamei [produce] on behalf of tahor [produce]. If one separated terumah [thus], [if he did so] inadvertently, his terumah is terumah; but [if he did so] intentionally, he has done nothing. Similarly, a Levi who had maaser [rishon which is] tevel, [and] he was continuously separating from it [tithes for other produce], [if he does so] inadvertently, what he did is done; [but if he does so] intentionally, he has done nothing. Rabbi Yehudah says: If he knew of it initially, even though his [designation] was inadvertent, he has done nothing.
Shevi'is10: 7
כַּוֶּורֶת דְּבוֹרִים — רַבִּי אֱלִיעֶזֶר אוֹמֵר: הֲרֵי הִיא כַקַּרְקַע, וְכוֹתְבִין עָלֶיהָ פְּרוֹזְבּוּל, וְאֵינָהּ מְקַבֶּלֶת טוּמְאָה בִּמְקוֹמָהּ, וְהָרוֹדֶה מִמֶּנָּה בַּשַּׁבָּת חַיָּיב. וַחֲכָמִים אוֹמְרִים: אֵינָהּ כַּקַּרְקַע, וְאֵין כּוֹתְבִין עָלֶיהָ פְּרוֹזְבּוּל, וּמְקַבֶּלֶת טוּמְאָה בִּמְקוֹמָהּ, וְהָרוֹדֶה מִמֶּנָּה בַּשַּׁבָּת פָּטוּר.
A beehive — R’ Eliezer says: It is [considered] like land, a prozbul may be written based on it, it is not susceptible to tumah in its place, and one who detaches [honey] from it on the Sabbath is liable. But the Sages say: It is not [considered] like land, nor may a prozbul be written based on it, and it is susceptible to tumah in its place, and one who detaches [honey] from it on the Sabbath is not liable.
Shevi'is10: 8
הַמַּחֲזִיר חוֹב בַּשְּׁבִיעִית יֹאמַר לוֹ: ,,מְשַׁמֵּט אֲנִי.“ אָמַר לוֹ: ,,אַף עַל פִּי כֵן,“ יְקַבֵּל מִמֶּנּוּ — שֶׁנֶּאֱמַר: “וְזֶה דְּבַר הַשְּׁמִטָּה“. כַּיּוֹצֵא בוֹ, רוֹצֵחַ שֶׁגָּלָה לְעִיר מִקְלָט, וְרָצוּ אַנְשֵׁי הָעִיר לְכַבְּדוֹ, יֹאמַר לָהֶם: “רוֹצֵחַ אָנִי“! אָמְרוּ לוֹ ,,אַף עַל פִּי כֵן,“ יְקַבֵּל מֵהֶם — שֶׁנֶּאֱמַר: “וְזֶה דְּבַר הָרוֹצֵחַ.“
[If] one repays a debt on [the occasion of] the seventh [year], he should say to him, ‘‘I relinquish [the debt].’’ [If] he said to him, ‘‘Even so,’’ he may accept [the money] from him — as it states (Deut. 15:2): And this is the matter of the relinquishment. Similarly, a murderer who went into exile in a city of refuge, and the people of the city wanted to honor him, he should say to them: ‘‘I am a murderer!’’ [If] they said, ‘‘Even so,’’ he may accept [the honor] from them — as it states (Deut. 19:4): And this is the matter of the murderer.
Shevi'is10: 9
הַמַּחֲזִיר חוֹב בַּשְּׁבִיעִית — רוּחַ חֲכָמִים נוֹחָה מִמֶּנּוּ. הַלֹּוֶה מִן הַגֵּר שֶׁנִּתְגַּיְּירוּ בָנָיו עִמּוֹ לֹֹא יַחֲזִיר לְבָנָיו. וְאִם הֶחֱזִיר — רוּחַ חֲכָמִים נוֹחָה מִמֶּנּוּ. כָּל הַמִּטַּלְטְלִין נִקְנִין בִּמְשִׁיכָה, וְכָל הַמְקַיֵּים אֶת דְּבָרוֹ — רוּחַ חֲכָמִים נוֹחָה מִמֶּנּוּ.
One who repays a debt on [the occasion of] the seventh [year], the Sages are pleased with him. One who borrows from a convert whose children converted together with him need not repay the children; but if he did repay [them], the Sages are pleased with him. Any movable property can be acquired by means of meshichah, but whoever keeps his word, the Sages are pleased with him.
