קְלִיפֵּי רִמּוֹן וְהַנֵּץ שֶׁלּוֹ, קְלִיפֵּי אֱגוֹזִים, וְהַגַּלְעִינִין יֵשׁ לָהֶם שְׁבִיעִית, וְלִדְמֵיהֶן שְׁבִיעִית.
הַצַּבָּע צוֹבֵעַ לְעַצְמוֹ, וְלֹֹא יִצְבַּע בְּשָׂכָר, שֶׁאֵין עוֹשִׂים סְחוֹרָה בְּפֵירוֹת שְׁבִיעִית, וְלֹֹא בַבְּכוֹרוֹת, וְלֹֹא בַתְּרוּמוֹת, וְלֹֹא בַנְּבֵלוֹת, וְלֹֹא בַטְּרֵפוֹת, וְלֹֹא בַשְּׁקָצִים, וְלֹֹא בָרְמָשִׂים.
וְלֹֹא יִהְיֶה לוֹקֵחַ יַרְקוֹת שָׂדֶה וּמוֹכֵר בַּשּׁוּק, אֲבָל הוּא לוֹקֵט וּבְנוֹ מוֹכֵר עַל יָדוֹ. לָקַח לְעַצְמוֹ וְהוֹתִיר, מוּתָּר לְמָכְרָן.
Rinds of pomegranate and its blossom, husks of nuts, and pits possess seventh [-year sanctity], and money [exchanged] for them possesses seventh [-year sanctity].
The dyer may dye for himself, but he may not dye for payment, because one may not do business with seventh [-year] produce, nor with first-born animals, nor with terumah, nor with unslaughtered carcasses, nor with tereifos, nor with abominations, nor with creeping things.
A person should not take field vegetables and sell them in the market, but he may pick and his son may sell in his place. [If] he took for himself and left over, he is permitted to sell them.
Shevi'is7: 4
לָקַח בְּכוֹר לְמִשְׁתֵּה בְנוֹ אוֹ לָרֶגֶל, וְלֹֹא צָרִיךְ לוֹ, מוּתָּר לְמָכְרוֹ.
צָדֵי חַיָּה, עוֹפוֹת, וְדָגִים, שֶׁנִּזְדַּמְּנוּ לָהֶם מִינֵי טְמֵאִין מוּתָּרִים לְמָכְרָן. רַבִּי יְהוּדָה אוֹמֵר: אַף מִי שֶׁנִּתְמַנָּה לוֹ לְפִי דַרְכּוֹ לוֹקֵחַ וּמוֹכֵר, וּבִלְבַד שֶׁלֹּא תְהֵא אוּמָּנוּתוֹ בְכָךְ. וַחֲכָמִים אוֹסְרִין.
[If] he bought a first-born animal for his son’s [wedding] feast or for the festival, and he did not need it, he is permitted to sell it.
Trappers of wild animals, fowl, or fish, who chanced upon unkosher species are permitted to sell them. R’ Yehudah says: Even someone to whom such [an animal] happened to come his way may take it and sell it, provided that he does not make a specialty of this. But the Sages forbid it.
Shevi'is7: 5
לוּלְבֵי זְרָדִים וְהֶחָרוּבִין יֵשׁ לָהֶם שְׁבִיעִית וְלִדְמֵיהֶן שְׁבִיעִית; יֵשׁ לָהֶן בִּיעוּר וְלִדְמֵיהֶן בִּיעוּר.
לוּלְבֵי הָאֵלָה, וְהַבָּטְנָה, וְהָאֲטָדִין, יֵשׁ לָהֶם שְׁבִיעִית, וְלִדְמֵיהֶן שְׁבִיעִית; אֵין לָהֶם בִּיעוּר וְלֹֹא לִדְמֵיהֶן בִּיעוּר. אֲבָל לֶעָלִין יֵשׁ בִּיעוּר, מִפְּנֵי שֶׁנּוֹשְׁרִין מֵאֲבִיהֶן.
Shoots of the service tree and the carob tree possess seventh [-year sanctity] and money [exchanged] for them possesses seventh [-year sanctity]; they are subject to biur and money [exchanged] for them is subject to biur.
Shoots of the terebinth, pistachio, and thorn, possess seventh [-year sanctity] and money [exchanged] for them possesses seventh [-year sanctity]; [but] they are not subject to biur, nor is money [exchanged] for them subject to biur. But the leaves are subject to biur, because they fall from their branches.
Shevi'is7: 6
הַוֶּורֶד וְהַכֹּפֶר וְהַקְּטָף וְהַלּוֹטֶם, יֵשׁ לָהֶם שְׁבִיעִית, וְלִדְמֵיהֶן שְׁבִיעִית. רַבִּי שִׁמְעוֹן אוֹמֵר: אֵין לַקְּטָף שְׁבִיעִית, מִפְּנֵי שֶׁאֵינוֹ פֶרִי.
The rose, henna, balsam, and stone pine possess seventh [-year sanctity], and money [exchanged] for them possess seventh [-year sanctity]. R’ Shimon says: The balsam does not possess seventh [-year sanctity], because it is not a fruit.
Shevi'is7: 7
וֶרֶד חָדָשׁ שֶׁכְּבָשׁוֹ בְּשֶׁמֶן יָשָׁן — יְלַקֵּט אֶת הַוֶּורֶד; וְיָשָׁן בְּחָדָשׁ חַיָּב בְּבִיעוּר.
חָרוּבִין חֲדָשִׁים שֶׁכְּבָשָׁן בְּיַיִן יָשָׁן, וִישָׁנִים בְּחָדָשׁ, חַיָּיבִין בְּבִיעוּר. זֶה הַכְּלָל: כָּל שֶׁהוּא בְנוֹתֵן טַעַם, חַיָּיב לְבַעֵר — מִין בְּשֶׁאֵינוֹ מִינוֹ; וּמִין בְּמִינוֹ — כָּל שֶׁהוּא. שְׁבִיעִית אוֹסֶרֶת כָּל שֶׁהוּא בְּמִינָהּ; וְשֶׁלֹּא בְמִינָהּ בְּנוֹתֵן טַעַם.
A new rose which was preserved in old oil — one may pick out the rose; but an old [rose] in new [oil] is subject to biur. New carobs which were preserved in old wine, and old [carobs which were preserved] in old wine, and old [carobs which were preserved] in new [wine], are subject to biur. This is the rule: Whatever imparts flavor, one is obligated to perform biur [on it] — [if it is] a mixture of one kind in a different kind; but [if it is] a mixture of one kind in a like kind — [even] the least amount [prohibits]. Seventh [-year produce] prohibits in minute quantities, in a mixture of like kinds; in a mixture of unlike kinds [it prohibits only] when it imparts flavor.
Shevi'is8: 1
כְּלָל גָּדוֹל אָמְרוּ בַּשְּׁבִיעִית: כָּל הַמְיוּחָד לְמַאֲכַל אָדָם, אֵין עוֹשִׂין מִמֶּנּוּ מְלוּגְמָא לְאָדָם, וְאֵין צָרִיךְ לוֹמַר לִבְהֵמָה. וְכָל שֶׁאֵינוֹ מְיוּחָד לְמַאֲכַל אָדָם, עוֹשִׂין מִמֶּנּוּ מְלוּגְמָא לְאָדָם, אֲבָל לֹֹא לִבְהֵמָה. וְכָל שֶׁאֵינוֹ מְיוּחָד לֹֹא לְמַאֲכַל אָדָם וְלֹֹא לְמַאֲכַל בְּהֵמָה — חָשַׁב עָלָיו לְמַאֲכַל אָדָם וּלְמַאֲכַל בְּהֵמָה, נוֹתְנִין עָלָיו חוּמְרֵי אָדָם וְחֻוּמְרֵי בְהֵמָה; חָשַׁב עָלָיו לְעֵצִים, הֲרֵי הוּא כְעֵצִים; כְּגוֹן הַסִּיאָה וְהָאֵזוֹב וְהַקּוֹרָנִית.
A major rule was stated concerning the seventh [year]: Whatever is reserved for human consumption may not be made into a plaster for a person, and surely not for an animal. Whatever is not reserved for human consumption may be made into a plaster for a person, but not for an animal. Whatever is reserved neither for human consumption nor animal consumption — [if] he intended it for human consumption and animal consumption, we apply to it the stringencies of both human [food] and animal [food]; [if] he intended it for [use as] wood then it is [treated] as wood; for example, the savory, the hyssop, and the oregano.
Shevi'is8: 2
שְׁבִיעִית נִיתְּנָה לַאֲכִילָה, וְלִשְׁתִיָּה, וּלְסִיכָה; לֶאֱכוֹל דָּבָר שֶׁדַּרְכּוֹ לֶאֱכוֹל, וְלָסוּךְ דָּבָר שֶׁדַּרְכּוֹ לָסוּךְ. לֹֹא יָסוּךְ יַיִן וְחוֹמֶץ אֲבָל סָךְ הוּא אֶת הַשֶּׁמֶן. וְכֵן בִּתְרוּמָה וּבְמַעֲשֵׂר שֵׁנִי. קַל מֵהֶם שְׁבִיעִית שֶׁנִּתְּנָה לְהַדְלָקַת הַנֵּר.
Seventh [-year produce] was given [to be used] for eating, drinking, and anointing; to eat that which it is customary to eat, and to anoint [with] that with which it is customary to anoint. One may not anoint with wine or vinegar but one may anoint with oil. So too with terumah and maaser sheni. Greater leniency is applied to seventh [-year produce] than to them in that it may be used for kindling a lamp.
Shevi'is8: 3
אֵין מוֹכְרִין פֵּירוֹת שְׁבִיעִית לֹֹא בְמִדָּה,
וְלֹֹא בְמִשְׁקָל, וְלֹֹא בְמִנְיָן; וְלֹֹא תְאֵנִים בְּמִנְיָן, וְלֹֹא יָרָק בְּמִשְׁקָל. בֵּית שַׁמַּאי אוֹמְרִים: אַף לֹֹא אֲגוּדּוֹת. וּבֵית הִלֵּל אוֹמְרִים: אֶת שֶׁדַּרְכּוֹ לֶאֱגוֹד בַּבַּיִת, אוֹגְדִין אוֹתוֹ בַּשּׁוּק, כְּגוֹן הַכְּרֵשִׁין וְנֵץ הֶחָלָב.
One may not sell seventh [-year] produce either by
measure, by weight, or by number; nor figs by number, nor vegetables by weight. Beis Shammai say: Not even [in] bunches. But Beis Hillel say: That which is customarily tied [in bunches] for the house may be tied for the market, for example, leeks and the milky blossom.
Shevi'is8: 4
הָאוֹמֵר לְפוֹעֵל ,,הֵא לָךְ אִיסָּר זֶה וְלַקֵּט לִי יָרָק הַיּוֹם,“ שְׂכָרוֹ מוּתָּר. ,,לַקֵּט לִי בּוֹ יָרָק הַיּוֹם,“ שְׂכָרוֹ אָסוּר. לָקַח מִן הַנַּחְתּוֹם כִּכָּר בְּפוּנְדְיוֹן, ,,כְּשֶׁאֶלְקוֹט יַרְקוֹת שָׂדֶה אָבִיא לָךְ,“ מוּתָּר. לָקַח מִמֶּנוּ סְתָם, לֹֹא יְשַׁלֵּם לוֹ מִדְּמֵי שְׁבִיעִית, שֶׁאֵין פּוֹרְעִין חוֹב מִדְּמֵי שְׁבִיעִית.
. [If] someone says to a worker, ‘‘Here is an issar for you, pick vegetables for me today,’’ his earnings are permissible. [But if one said,] ‘‘Pick vegetables for me today in return for it,‘‘ his earnings are prohibited. [If] one took a loaf worth a pundyon from a baker [and said], ‘‘When I pick field vegetables I will bring you [some],’’ it is permissible. But if he took from him as usual, he may not pay him with seventh [-year] money, for one may not repay a debt with seventh [-year] money.
Shevi'is8: 5
אֵין נוֹתְנִים לֹֹא לְבַיָּיר, וְלֹֹא לְבַלָּן, וְלֹֹא לְסַפָּר, וְלֹֹא לְסַפָּן. אֲבָל נוֹתֵן הוּא לְבַיָּיר לִשְׁתּוֹת. וּלְכוּלָּן הוּא נוֹתֵן מַתְּנַת חִנָּם.
One may not give [seventh-year assets in payment] to a well-digger, nor to a bathhouse keeper, nor to a barber, nor to a boatman. But he may give [these] to a well-digger for drinking [purposes]. He may also give [these] to any of them as a gift.
Shevi'is8: 6
תְּאֵנִים שֶׁל שְׁבִיעִית, אֵין קוֹצִין אוֹתָן בְּמוּקְצֶה, אֲבָל קוֹצֶה אוֹתָם בְּחַרְבָה.
אֵין דּוֹרְכִין עֲנָבִים בְּגַת, אֲבָל דּוֹרֵךְ הוּא בַּעֲרֵיבָה. וְאֵין עוֹשִׂין זֵיתִים בְּבַד וּבְקוֹטֶב, אֲבָל כּוֹתֵשׁ הוּא וּמַכְנִיס לְבוֹדִידָה. רַבִּי שִׁמְעוֹן אוֹמֵר: אַף טוֹחֵן הוּא בְּבֵית הַבַּד וּמַכְנִיס לְבוֹדִידָה.
Figs of the seventh [year] may not be cut with a fig-knife, but one may cut them with a sword.
One may not press grapes in a wine press, but he may press them in a kneading trough. Nor may one press olives in an olive press and with a weighted beam, but he may crush [the olives] and put [them] in a small press. R’ Shimon says: He may even grind [them] in the olive press and put [them] in a small press.
Shevi'is8: 7
אֵין מְבַשְּׁלִין יָרָק שֶׁל שְׁבִיעִית בְּשֶׁמֶן שֶׁל תְּרוּמָה, שֶׁלֹּא יְבִיאֶנוּ לִידֵי פְסוּל. רַבִּי שִׁמְעוֹן מַתִּיר.
וְאַחֲרוֹן אַחֲרוֹן נִתְפָּס בַּשְּׁבִיעִית, וְהַפְּרִי עַצְמוֹ אָסוּר.
One may not cook a vegetable of the seventh [year] in oil which is terumah, so that he not cause it to become unfit. R’ Shimon permits [this].
The very last [object of exchange] is subject to seventh [year sanctity], but the produce itself remains prohibited.
Shevi'is8: 8
אֵין לוֹקְחִים עֲבָדִים, וְקַרְקָעוֹת, וּבְהֵמָה טְמֵאָה מִדְּמֵי שְׁבִיעִית; וְאִם לָקַח, יֹאכַל כְּנֶגְדָּן. אֵין מְבִיאִין קִינֵּי זָבִים, וְקִינֵּי זָבוֹת, וְקִינֵּי יוֹלְדוֹת, מִדְּמֵי שְׁבִיעִית; וְאִם הֵבִיא, יֹאכַל כְּנֶגְדָּן. אֵין סָכִין כֵּלִים בְּשֶׁמֶן שֶׁל שְׁבִיעִית; וְאִם סָךְ, יֹאכַל כְּנֶגְדּוֹ.
One may not purchase slaves, land, or non-kosher animals with seventh [-year] money; if one did, he must eat [produce] of equal value. One may not bring the pair of birds for a zav, the pair of birds for a zavah, or the pair of birds for a woman giving birth, with seventh [-year] money; if one did, he must eat [produce] of equal value. One may not smear utensils with seventh [year] oil; if one did, he must eat [produce] of equal value.
Shevi'is8: 9
עוֹר שֶׁסָּכוֹ בְּשֶׁמֶן שֶׁל שְׁבִיעִית — רַבִּי אֱלִיעֶזֶר אוֹמֵר: יִדָּלֵק. וַחֲכָמִים אוֹמְרִים: יֹאכַל כְּנֶגְדּוֹ. אָמְרוּ לִפְנֵי רַבִּי עֲקִיבָא: אוֹמֵר הָיָה רַבִּי אֱלִיעֶזֶר, עוֹר שֶׁסָּכוֹ בְּשֶׁמֶן שֶׁל שְׁבִיעִית יִדָּלֵק. אָמַר לָהֶם: שְׁתוֹקוּ! לֹֹא אוֹמַר לָכֶם מַה שֶּׁרַבִּי אֱלִיעֶזֶר אוֹמֵר בּוֹ.
A hide which was smeared with seventh [year] oil — R’ Eliezer says: It must be burnt. But the Sages say: One must eat [produce] of equal value. They said before R’ Akiva: R’ Eliezer said that a hide which was smeared with seventh [year] oil must be burnt. He said to them: Be silent! I will not tell you what R’ Eliezer said regarding this.
Shevi'is8: 10
וְעוֹד אָמְרוּ לְפָנָיו: אוֹמֵר הָיָה רַבִּי אֱלִיעֶזֶר הָאוֹכֵל פַּת כּוּתִים כְּאוֹכֵל בְּשַׂר חֲזִיר. אָמַר לָהֶם: שְׁתוֹקוּ! לֹֹא אוֹמַר לָכֶם מַה שֶּׁרַבִּי אֱלִיעֶזֶר אוֹמֵר בּוֹ.
Additionally, they said before him: R’ Eliezer said that one who eats bread of Cutheans is comparable to one who eats pig meat. He said to them: Be silent! I will not tell you what R’ Eliezer said regarding this.
Shevi'is8: 11
מֶרְחָץ שֶׁהוּסְּקָה בְתֶבֶן אוֹ בְקַשׁ שֶׁל שְׁבִיעִית, מוּתָּר לִרְחוֹץ בָּהּ; וְאִם מִתְחַשֵּׁב הוּא, הֲרֵי זֶה לֹֹא יִרְחוֹץ.
[If] a bathhouse was heated with stubble or straw of the seventh [year], one may bathe in it; but if he is a respected person, he should not bathe [in it].
Shevi'is9: 1
הַפֵּיגָם, וְהַיַּרְבּוּזִין הַשּׁוֹטִים, וְהַחֲלַגְלוֹגִית, כּוּסְבָּר שֶׁבֶּהָרִים, וְהַכַּרְפַּס שֶׁבַּנְּהָרוֹת, וְהַגַּרְגֵּר שֶׁל אֲפָר פְּטוּרִין מִן הַמַּעַשְׂרוֹת וְנִלְקָחִין מִכָּל אָדָם בַּשְּׁבִיעִית, שֶׁאֵין כַּיּוֹצֵא בָהֶם נִשְׁמָר. רַבִּי יְהוּדָה אוֹמֵר: סְפִיחֵי חַרְדָּל מוּתָּרִין, שֶׁלֹּא נֶחְשְׁדוּ עֲלֵיהֶן עוֹבְרֵי עֲבֵירָה. רַבִּי שִׁמְעוֹן אוֹמֵר: כָּל הַסְּפִיחִים מוּתָּרִין, חוּץ מִסְּפִיחֵי כְרוּב, שֶׁאֵין כַּיּוֹצֵא בָהֶם בְּיַרְקוֹת שָׂדֶה. וַחֲכָמִים אוֹמְרִים: כָּל הַסְּפִיחִין אֲסוּרִין.
The rue, wild asparagus, purslane, mountain coriander, river celery, and the meadow rocket are exempt from tithes and may be bought from any person in the seventh [year], for no [vegetable] like these is protected. R’ Yehudah says: Aftergrowths of mustard are permitted, because transgressors are not suspected concerning them. R’ Shimon says: All aftergrowths are permissible, except the aftergrowths of cabbage. But the Sages say: All aftergrowths are prohibited.
