הַלּוֹקֵחַ מִן הַפַּלְטֵר — מְעַשֵּׂר מִכָּל טְפוּס וּטְפוּס; דִּבְרֵי רַבִּי מֵאִיר. רַבִּי יְהוּדָה אוֹמֵר: מֵאַחַת עַל הַכֹּל. מוֹדֶה רַבִּי יְהוּדָה
בְּלוֹקֵחַ מִן הַמַּנְפּוֹל, שֶׁהוּא מְעַשֵּׂר מִכָּל אֶחָד וְאֶחָד.
One who buys from a palter must tithe [separately] from each form; these are the words of R’ Meir. R’ Yehudah says: [He may tithe] from one for the whole. [But] R’ Yehu-dah concedes
that if one buys from a monpol, he must tithe [separately] from each and every one.

הַלּוֹקֵח מִן הֶעָנִי, וְכֵן הֶעָנִי שֶׁנָּתְנוּ לוֹ פְרוּסוֹת פַּת אוֹ פִלְחֵי דְבֵלָה — מְעַשֵּׂר מִכָּל אֶחָד וְאֶחָד. וּבַתְּמָרִים וּבַגְּרוֹגְרוֹת — בּוֹלֵל וְנוֹטֵל. אָמַר רַבִּי יְהוּדָה: אֵימָתַי — בִּזְמַן שֶׁהַמַּתָּנָה מְרֻבָּה, אֲבָל בִּזְמַן שֶׁהַמַּתָּנָה מוּעֶטֶת — מְעַשֵּׂר מִכָּל אֶחָד וְאֶחָד.
One who buys from a pauper, and similarly, a pauper who was given pieces of bread or chunks of pressed-fig — tithes from each and every one. But with dates and dried figs — he mixes [them] and takes [maaser]. R’ Yehudah said: When is this so? When the dona-tion is large. But when the donation is small, he tithes from each and every one.
Demai5: 6
הַלּוֹקֵחַ מִן הַסִּיטוֹן וְחָזַר וְלָקַח מִמֶּנּוּ שְׁנִיָּה — לֹא יְעַשֵּׂר מִזֶּה עַל זֶה, אֲפִלּוּ מֵאוֹתוֹ הַסּוּג, אֲפִלּוּ מֵאוֹתוֹ הַמִּין. נֶאֱמָן הַסִּיטוֹן לוֹמַר: ,,מִשֶּׁל אֶחָד הֵם.“
One who buys from a grain wholesaler, and then buys from him a second time, cannot tithe from this [purchase] on behalf of that [one], even [if both are] from the same con-tainer, [and] even [if both are] of the same variety. [However,] the wholesaler is believed to say, ‘‘They are from one [person].’’

הַלּוֹקֵחַ מִבַּעַל הַבַּיִת וְחָזַר וְלָקַח מִמֶּנּוּ שְׁנִיָּה — מְעַשֵּׂר מִזֶּה עַל זֶה, אֲפִלּוּ מִשְּׁתֵּי קֻפּוֹת, אֲפִלּוּ מִשְּׁתֵּי עֲיָרוֹת.
בַּעַל הַבַּיִת שֶׁהָיָה מוֹכֵר יָרָק בַּשּׁוּק: בִּזְמַן שֶׁמְּבִיאִין לוֹ מִגַּנּוֹתָיו — מְעַשֵּׂר מֵאַחַת עַל הַכֹּל; וּמִגַּנּוֹת אֲחֵרוֹת — מְעַשֵּׂר מִכָּל אֶחָד וְאֶחָד.
One who buys from a householder, and then buys from him a second time, may tithe from this [purchase] on behalf of that [one], even [if they are] from two boxes, [and] even [if they are] from two towns.
[If] a householder was selling vegetables in the market: When they bring him from his [own] gardens, [the buyer] may tithe from one [purchase] on behalf of all; [when they bring him] from other gardens, he must tithe from each and every one.

הַלּוֹקֵחַ טֶבֶל מִשְּׁנֵי מְקוֹמוֹת — מְעַשֵּׂר מִזֶּה עַל זֶה, אַף עַל פִּי שֶׁאָמְרוּ: אֵין אָדָם רַשַּׁאי לִמְכֹּר טֶבֶל אֶלָּא לְצֹרֶךְ.
[If] someone buys tevel from two places, he may tithe from this [purchase] on behalf of that [one]. Even though they said [this, nevertheless,] a person is not permitted to sell tevel except for a need.

מְעַשְּׂרִין מִשֶּׁל יִשְׂרָאֵל עַל שֶׁל נָכְרִי, מִשֶּׁל נָכְרִי עַל שֶׁל יִשְׂרָאֵל; מִשֶּׁל יִשְׂרָאֵל עַל שֶׁל כּוּתִים, מִשֶּׁל כּוּתִים עַל שֶׁל כּוּתִים. רַבִּי אֱלִיעֶזֶר אוֹסֵר מִשֶּׁל כּוּתִים עַל שֶׁל כּוּתִים.
One may tithe from [tevel] of a Jew on behalf of [tevel] of a gentile; from [tevel] of a gentile on behalf of [tevel] of a Jew; from [tevel] of a Jew on behalf of [tevel] of a Cuthean; from [tevel] of a Cuthean on behalf of [tevel] of a Cuthean. R’ Eliezer forbids [tithing] from [tevel] of a Cuthean on behalf of [tevel] of a Cuthean.

עָצִיץ נָקוּב — הֲרֵי זֶה כָּאָרֶץ. תָּרַם מֵהָאָרֶץ עַל עָצִיץ נָקוּב, מֵעָצִיץ נָקוּב עַל הָאָרֶץ — תְּרוּמָתוֹ תְּרוּמָה.
מִשֶּׁאֵינוֹ נָקוּב עַל הַנָּקוּב — תְּרוּמָה, וְיַחֲזֹר וְיִתְרֹם.
מִן הַנָּקוּב עַל שֶׁאֵינוֹ נָקוּב — תְּרוּמָה, וְלֹא תֵאָכֵל עַד שֶׁיּוֹצִיא עָלֶיהָ תְּרוּמוֹת וּמַעַשְׂרוֹת.
A perforated plant-pot is like the ground.
[If] one separated terumah from [produce of] the ground on behalf of [produce of] a per-forated plant-pot, or from [produce of] a perforated plant-pot on behalf of [produce of] the ground, his terumah is terumah.
[If he separated terumah] from [produce of] a non-perforated [pot] on behalf of [produce of] a perforated [pot], it is terumah, but he must separate terumah again.
[If he separated terumah] from [produce of] a perforated [pot] on behalf of [pro-duce of] a nonperforated [pot], it is terumah, but it may not be eaten until he takes out terumah and tithes for it.

תָּרַם מִן הַדְּמַאי עַל הַדְּמַאי, מִדְּמַאי עַל הַוַּדַּאי — תְּרוּמָה, וְיַחֲזֹר וְיִתְרֹם.
מִן הַוַּדַּאי עַל הַדְּמַאי — תְּרוּמָה, וְלֹא תֵאָכֵל עַד שֶׁיּוֹצִיא עָלֶיהָ תְּרוּמוֹת וּמַעַשְׂרוֹת.
[If] one separated terumah from demai on behalf of demai, [or] from demai on behalf of definite [tevel], it is terumah but he must separate terumah again.
[If one separated terumah] from definite [tevel] on behalf of demai, it is terumah but it may not be eaten until he takes out terumah and tithes for it.
Demai6: 1
הַמְקַבֵּל שָׂדֶה מִיִּשְׂרָאֵל, מִן הָעוֹבֵד כּוֹכָבִים וּמִן הַכּוּתִי — יְחַלֵּק לִפְנֵיהֶם. הַחוֹכֵר שָׂדֶה מִיִּשְׂרָאֵל — תּוֹרֵם וְנוֹתֵן לוֹ. אָמַר רַבִּי יְהוּדָה: אֵימָתַי — בִּזְמַן שֶׁנָּתַן לוֹ מֵאוֹתָהּ הַשָּׂדֶה וּמֵאוֹתוֹ הַמִּין; אֲבָל אִם נָתַן לוֹ מִשָּׂדֶה אַחֶרֶת אוֹ מִמִּין אַחֵר — מְעַשֵּׂר וְנוֹתֵן לוֹ.
One who contracts a field [as a sharecropper] from a Jew, an idolater, or a Cuthean di-vides [the produce] in their presence. One who leases a field [as a tenant-farmer] from a Jew separates terumah and [then] gives him [his share]. R’ Yehudah said: When [is this so]? When he gave him from that [same] field and from that [same] species; but if he gave him from a different field or from a different species, he tithes and [then] gives him.
Demai6: 2
הַחוֹכֵר שָׂדֶה מִן הָעוֹבֵד כּוֹכָבִים — מְעַשֵּׂר וְנוֹתֵן לוֹ. רַבִּי יְהוּדָה אוֹמֵר: אַף הַמְקַבֵּל שְׂדֵה אֲבוֹתָיו מִן הַנָּכְרִי מְעַשֵּׂר וְנוֹתֵן לוֹ.
One who leases a field [as a tenant-farmer] from an idolater tithes and [then] gives him [his share]. R’ Yehudah says: Also one who sharecrops an ancestral field from an idolater tithes and [then] gives him [his share].
Demai6: 3
כֹּהֵן וְלֵוִי שֶׁקִּבְּלוּ שָׂדֶה מִיִּשְׂרָאֵל — כְּשֵׁם שֶׁחוֹלְקִין בַּחֻלִּין כָּךְ חוֹלְקִין בַּתְּרוּמָה. רַבִּי אֱלִיעֶזֶר אוֹמֵר: אַף הַמַּעַשְׂרוֹת שֶׁלָּהֶן, שֶׁעַל מְנָת כֵּן בָּאוּ.
[If] a Kohen or Levite contracted a field [as a sharecropper] from a Yisrael, just as they divide the chullin, so do they divide the terumah. R’ Eliezer says: The tithes, too, are theirs, for it is on this condition that they came.
Demai6: 4
יִשְׂרָאֵל שֶׁקִּבֵּל מִכֹּהֵן וּמִלֵּוִי — הַמַּעַשְׂרוֹת לַבְּעָלִים. רַבִּי יִשְׁמָעֵאל אוֹמֵר: הַקַּרְתָּנִי שֶׁקִּבֵּל שָׂדֶה מִירוּשַׁלְמִי — מַעֲשֵׂר שֵׁנִי שֶׁל יְרוּשַׁלְמִי. וַחֲכָמִים אוֹמְרִים: יָכוֹל הוּא הַקַּרְתָּנִי לַעֲלוֹת וּלְאָכְלוֹ בִּירוּשָׁלָיִם.
[If] a Yisrael contracted a field [as a sharecropper] from a Kohen or Levite, the tithes be-long to the landowner. R’ Yishmael says: [If] a villager contracted a field as a sharecropper from a Jerusalemite, the second tithe belongs to the Jerusalemite. But the Sages say: The villager himself is able to go up and eat it in Jerusalem.

הַמְקַבֵּל זֵיתִים לְשֶׁמֶן — כְּשֵׁם שֶׁחוֹלְקִין בַּחֻלִּין כָּךְ חוֹלְקִין בַּתְּרוּמָה. רַבִּי יְהוּדָה אוֹמֵר: יִשְׂרָאֵל שֶׁקִּבֵּל מִכֹּהֵן וּמִלֵּוִי זֵיתִים לְשֶׁמֶן לְמַחֲצִית שָׂכָר — הַמַּעַשְׂרוֹת לַבְּעָלִים.
One who contracts olives [as a sharecropper] for [the production of] oil — just as they divide the chullin, so do they divide the terumah. R’ Yehudah says: A Yisrael who con-tracts olives [as a sharecropper] from a Kohen or Levite for [the production of] oil, [or if he contracts] for half the profit, the tithes [belong] to the owner.

בֵּית שַׁמַּאי אוֹמְרִים: לֹא יִמְכֹּר אָדָם אֶת זֵיתָיו אֶלָּא לְחָבֵר. בֵּית הִלֵּל אוֹמְרִים: אַף לַמְעַשֵּׂר. וּצְנוּעֵי בֵית הִלֵּל הָיוּ
נוֹהֲגִין כְּדִבְרֵי בֵית שַׁמַּאי.
Beis Shammai say: A person should not sell his olives except to a chaver. Beis Hillel say: Also to one who tithes. But the pious of Beis Hillel
conducted themselves according to the opinion of Beis Shammai.
Demai6: 7
שְׁנַיִם שֶׁבָּצְרוּ אֶת כַּרְמֵיהֶם לְתוֹךְ גַּת אֶחָת, אֶחָד מְעַשֵּׂר וְאֶחָד שֶׁאֵינוֹ מְעַשֵּׂר — הַמְעַשֵּׂר מְעַשֵּׂר אֶת שֶׁלּוֹ וְחֶלְקוֹ בְּכָל מָקוֹם שֶׁהוּא.
Two [people] who harvested their vineyards into one winepress, [and] one tithes while the other does not tithe, the one who tithes must tithe his and his [fellow’s] share wher-ever it is.
Demai6: 8
שְׁנַיִם שֶׁקִּבְּלוּ שָׂדֶה בַאֲרִיסוּת, אוֹ שֶׁיָּרְשׁוּ אוֹ שֶׁנִּשְׁתַּתְּפוּ — יָכוֹל הוּא לוֹמַר: ,,טֹל אַתָּה חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי; אַתָּה יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי.“ אֲבָל לֹא יֹאמַר לוֹ: ,,טֹל אַתָּה חִטִּים וַאֲנִי שְׂעוֹרִים; טֹל אַתָּה יַיִן וַאֲנִי אֶטֹּל שָׁמֶן.“
Two [people] who received a field as sharecroppers, or who inherited [it], or who be-came partners [in it], one can say [to the other]: ‘‘You take the wheat that is in such-and-such place, and I [will take] the wheat that is in such-and-such place; you the wine that is in such-and-such place, and I the wine that is in such-and-such place.’’ But he should not say to him: ‘‘You take the wheat and I the barley; you take the wine and I will take the oil.’’
Demai6: 9
חָבֵר וְעַם הָאָרֶץ שֶׁיָּרְשׁוּ אֶת אֲבִיהֶם, עַם הָאָרֶץ — יָכוֹל הוּא לוֹמַר לוֹ: ,,טֹל אַתָּה חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי חִטִּים שֶׁבְּמָקוֹם פְּלוֹנִי; אַתָּה יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי וַאֲנִי יַיִן שֶׁבְּמָקוֹם פְּלוֹנִי.“ אֲבָל לֹא יֹאמַר לוֹ: ,,טֹל אַתָּה חִטִּים וַאֲנִי שְׂעוֹרִים; טֹל אַתָּה הַלַּח וַאֲנִי אֶטֹּל אֶת הַיָּבֵשׁ.“
[If] a chaver and an am haaretz inherited their father, an am haaretz, [the chaver] may say to [the am haaretz]: ‘‘You take the wheat that is in such-and-such place, and I the wheat that is in such-and-such place; you the wine that is in such-and-such place, and I the wine that is in such-and-such place.’’ But he may not say to him: ‘‘You take the wheat and I the barley; you take the wet and I will take the dry.’’

גֵּר וְעוֹבֵד כּוֹכָבִים שֶׁיָּרְשׁוּ אֶת אֲבִיהֶם עוֹבֵד כּוֹכָבִים, יָכוֹל הוּא לוֹמַר: ,,טֹל אַתָּה עֲבוֹדָה זָרָה וַאֲנִי מָעוֹת; אַתָּה יַיִן וַאֲנִי פֵרוֹת.“ וְאִם מִשֶּׁבָּאוּ לִרְשׁוּת הַגֵּר — אָסוּר.
[If] a convert and an idolater inherited their father, an idolater, [the convert] may say: ‘‘You take the idols and I the money; you the wine and I the produce.’’ However, if [the idols and wine] have already come into the possession of the convert, it is forbidden.

הַמּוֹכֵר פֵּרוֹת בְּסוּרְיָא, וְאָמַר: ,,מִשֶּׁל אֶרֶץ יִשְׂרָאֵל הֵן“ — חַיָּב לְעַשֵּׂר. ,,מְעֻשָּׂרִין הֵן“ — נֶאֱמָן, שֶׁהַפֶּה שֶׁאָסַר הוּא הַפֶּה שֶׁהִתִּיר. ,,מִשֶּׁלִּי הֵן“ — חַיָּב לְעַשֵּׂר. ,,מְעֻשָּׂרִין הֵן“ — נֶאֱמָן, שֶׁהַפֶּה שֶׁאָסַר הוּא הַפֶּה שֶׁהִתִּיר. וְאִם יָדוּעַ שֶׁיֶּשׁ לוֹ שָׂדֶה אַחַת בְּסוּרְיָא — חַיָּב לְעַשֵּׂר.
[If] someone sells fruits in Surya, and says: ‘‘They are from the Land of Israel,’’ one is ob-ligated to tithe [them]. [But if he adds:] ‘‘They are tithed,’’ he is believed, because the very mouth that has forbidden is the mouth that has permitted. [If he says:] ‘‘They are from my property,’’ one is obligated to tithe [them]. [But if he adds:] ‘‘They are tithed,’’ he is believed, because the very mouth that has forbidden is the mouth that has permitted. If, however, it is known that he has [at least] one field in Surya, one is obligated to tithe [the fruits].
Demai6: 12
עַם הָאָרֶץ שֶׁאָמַר לְחָבֵר: קַח לִי אֲגֻדַּת יָרָק, קַח לִי גְלֻסְקָן אֶחָד — לוֹקֵחַ סְתָם וּפָטוּר.
וְאִם אָמַר: ,,שֶׁלִּי זֶה, וְזֶה שֶׁל חֲבֵרִי,“ וְנִתְעָרְבוּ
— חַיָּב לְעַשֵּׂר, וַאֲפִלּוּ הֵן מֵאָה.
[If] an am haaretz said to a chaver: ‘‘Buy me a bundle of vegetables,’’ (or) ‘‘Buy me a loaf,’’ he buys without specification and is exempt.
But if he said: ‘‘This is mine, and this is my fellow’s,’’ and they became intermin-gled, he is
obligated to tithe, even if there are a hundred.
