הַפּוֹגֶמֶת כְּתֻבָּתָהּ” כֵּיצַד? הָיְתָה כְתֻבָּתָהּ אֶלֶף זוּז, וְאָמַר לָהּ: ,,הִתְקַבַּלְתְּ כְּתֻבָּתִיךְ”, וְהִיא אוֹמֶרֶת: ,,לֹא הִתְקַבַּלְתִּי אֶלָּא מָנֶה” — לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה. ,,עֵד אֶחָד מְעִידָהּ שֶׁהִיא פְרוּעָה” כֵּיצַד? הָיְתָה כְתֻבָּתָהּ אֶלֶף זוּז, וְאָמַר לָהּ: ,,הִתְקַבַּלְתְּ כְּתֻבָּתִיךְ”, וְהִיא אוֹמֶרֶת: ,,לֹא הִתְקַבַּלְתִּי”, וְעֵד אֶחָד מְעִידָהּ שֶׁהִיא פְרוּעָה — לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה. ,,מִנְּכָסִים מְשֻׁעְבָּדִים” כֵּיצַד? מָכַר נְכָסָיו לַאֲחֵרִים, וְהִיא נִפְרַעַת מִן הַלָּקוֹחוֹת — לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה. ,,מִנִּכְסֵי יְתוֹמִים” כֵּיצַד? מֵת, וְהִנִּיחַ נְכָסָיו לִיתוֹמִים, וְהִיא נִפְרַעַת מִן הַיְתוֹמִים — לֹא תִפָּרַע אֶלָּא בִשְׁבוּעָה. ,,וְשֶׁלֹּא בְּפָנָיו” כֵּיצַד? הָלַךְ לוֹ לִמְדִינַת הַיָּם, וְהִיא נִפְרַעַת שֶׁלֹּא בְּפָנָיו — אֵינָהּ נִפְרַעַת אֶלָּא בִשְׁבוּעָה. רַבִּי שִׁמְעוֹן אוֹמֵר: כָּל זְמַן שֶׁהִיא תוֹבַעַת כְּתֻבָּתָהּ — הַיּוֹרְשִׁין מַשְׁבִּיעִין אוֹתָהּ; וְאִם אֵינָהּ תּוֹבַעַת כְּתֻבָּתָהּ — אֵין הַיּוֹרְשִׁין מַשְׁבִּיעִין אוֹתָהּ.
“[If she] impairs her kesubah” —- how? [If] her kesubah was a thousand zuz, and he said to her: “You have received your kesubah,” and she says: “I have received only a hundred,” she is not paid, except with an oath. “[If] one witness testifies against her that it is paid” —- how? [If] her kesubah was a thousand zuz, and he said to her: “You have received your kesubah,” and she says: “I have not received [it],” and one witness testifies against her that it is paid, she is not paid, except with an oath. “From assigned property” —- how? [If] he sold his property to others, and she seeks to be paid by the purchasers, she is not paid, except with an oath. “From the property of orphans” —- how? [If] he died, and left his property to orphans, and she seeks to be paid by the orphans, she is not paid, except with an oath. “Or in his absence” —- how? [If] he went over-seas, and she seeks to be paid in his absence, she is not paid, except with an oath. R’ Shimon says: Whenever she claims her kesubah, the heirs can impose an oath upon her; but if she does not claim her kesubah, the heirs cannot impose an oath upon her.

הוֹצִיאָה גֵט, וְאֵין עִמּוֹ כְתֻבָּה — גּוֹבָה כְתֻבָּתָהּ. כְּתֻבָּה, וְאֵין עִמָּהּ גֵּט — הִיא אוֹמֶרֶת: ,,אָבַד גִּטִּי”, וְהוּא אוֹמֵר: ,,אָבַד שׁוֹבְרִי”; וְכֵן בַּעַל חוֹב שֶׁהוֹצִיא שְׁטָר חוֹב, וְאֵין עִמּוֹ פְּרוֹזְבּוּל — הֲרֵי אֵלּוּ לֹא יִפָּרְעוּ. רַבָּן שִׁמְעוֹן בֶּן גַּמְלִיאֵל אוֹמֵר: מִן הַסַּכָּנָה וְאֵילָךְ — אִשָּׁה גוֹבָה כְתֻבָּתָהּ שֶׁלֹּא בְגֵט, וּבַעַל חוֹב גּוֹבֶה שֶׁלֹּא בִּפְרוֹזְבּוּל. שְׁנֵי גִטִּין וּשְׁתֵּי כְתֻבּוֹת — גּוֹבָה שְׁתֵּי כְתֻבּוֹת. שְׁתֵּי כְתֻבּוֹת וְגֵט אֶחָד, אוֹ כְתֻבָּה וּשְׁנֵי גִטִּין, אוֹ כְתֻבָּה וְגֵט וּמִיתָה — אֵינָהּ גּוֹבָה אֶלָּא כְתֻבָּה אַחַת, שֶׁהַמְּגָרֵשׁ אֶת אִשְׁתּוֹ וְהֶחֱזִירָהּ — עַל מְנָת כְּתֻבָּה הָרִאשׁוֹנָה מַחֲזִירָהּ. קָטֹן שֶׁהִשִּׂיאוֹ אָבִיו — כְּתֻבָּתָהּ קַיֶּמֶת, שֶׁעַל מְנָת כֵּן קִיְּמָהּ. גֵּר שֶׁנִּתְגַּיֵּר וְאִשְׁתּוֹ עִמּוֹ — כְּתֻבָּתָהּ קַיֶּמֶת, שֶׁעַל מְנָת כֵּן קִיְּמָהּ.
[If] she produced a bill of divorce, but not a kesubah, she can collect her kesubah. [If she produced] a kesubah, but not a bill of divorce —- she says: “My bill of divorce was lost,” and he says: “My quittance was lost”; and similarly, a creditor who produced a note of indebtedness, but not a prozbul —- these are not paid. Rabban Shimon ben Gamliel says: Since the time of danger, a woman can collect her kesubah without a bill of divorce, and a creditor can collect without a prozbul. [If she produced] two bills of divorce and two kesubos, she collects two kesubos; two kesubos and one bill of divorce; or a kesubah and two bills of di-vorce; or a kesubah, a bill of divorce, and [proof of] death —- she collects no more than one kesubah, for one who divorces his wife and remarries her, on the condition of the first kesubah he remarries her. A minor whose father had married him off —- her kesubah remains valid, for he kept her on that condition. [If] a man converted together with his wife, her marriage contract remains valid, for he kept her on that condition.
