אֵין חוֹלְקִין אֶת הֶחָצֵר עַד שֶׁיְהֵא אַרְבַּע אַמּוֹת לָזֶה וְאַרְבַּע אַמּוֹת לָזֶה; וְלֹא אֶת הַשָּׂדֶה עַד שֶׁיְּהֵא בָהּ תִּשְׁעָה קַבִּין לָזֶה וְתִשְׁעָה קַבִּין לָזֶה. רַבִּי יְהוּדָה אוֹמֵר: עַד שֶׁיְּהֵא בָהּ תִּשְׁעַת חֲצָאֵי קַבִּין לָזֶה וְתִשְׁעַת חֲצָאֵי קַבִּין לָזֶה. וְלֹא אֶת הַגִּנָּה עַד שֶׁיְּהֵא בָהּ חֲצִי קַב לָזֶה וַחֲצִי קַב לָזֶה. רַבִּי עֲקִיבָא אוֹמֵר: בֵּית רֹבַע. וְלֹא אֶת הַטְּרַקְלִין, וְלֹא אֶת הַמּוֹרָן, וְלֹא אֶת הַשּׁוֹבָךְ, וְלֹא אֶת הַטַּלִּית, וְלֹא אֶת הַמֶּרְחָץ, וְלֹא אֶת בֵּית הַבַּד, עַד שֶׁיְּהֵא בָהֶן כְּדֵי לָזֶה וּכְדֵי לָזֶה. זֶה הַכְּלָל: כָּל שֶׁיֵּחָלֵק וּשְׁמוֹ עָלָיו — חוֹלְקִין; וְאִם לָאו — אֵין חוֹלְקִין. אֵימָתַי? בִּזְמַן שֶׁאֵין שְׁנֵיהֶם רוֹצִים; אֲבָל בִּזְמַן שֶׁשְּׁנֵיהֶם רוֹצִים — אֲפִלּוּ בְפָחוֹת מִכָּאן יַחֲלֹקוּ. וְכִתְבֵי הַקֹּדֶשׁ, אַף עַל פִּי שֶׁשְּׁנֵיהֶם רוֹצִים — לֹא יַחֲלֹקוּ.

We do not divide a courtyard unless there are four cubits for each one; nor [do we divide] a field unless there are nine kavs for each one. R' Yehudah says: Unless there are nine half-kavs for each one. Nor [do we divide] a garden unless there is half a kav for each one. R' Akiva says: A quarter-kav. Nor [do we divide] a salon, nor a hall, nor a dovecote, nor a cloak, nor a bathhouse, nor an olive press, unless there is enough for this one and enough for that one. This is the rule: Anything which can be divided and [still] retain its name we divide; but if not, we do not divide [it]. When? When they do not both consent; but when they both consent they may divide with even less than this. However, they may not divide Holy Scriptures even if they both consent.
