הָאִשָּׁה שֶׁהָלַךְ בַּעֲלָהּ לִמְדִינַת הַיָּם, וּבָאוּ וְאָמְרוּ לָהּ ,,מֵת בַּעֲלִיךְ”, וְנִסֵּת, וְאַחַר כָּךְ בָּא בַעֲלָהּ — תֵּצֵא מִזֶּה וּמִזֶּה, וּצְרִיכָה גֵט מִזֶּה וּמִזֶּה. וְאֵין לָהּ כְּתֻבָּה וְלֹא פֵרוֹת וְלֹא מְזוֹנוֹת וְלֹא בְלָאוֹת, לֹא עַל זֶה, וְלֹא עַל זֶה; אִם נָטְלָה מִזֶּה וּמִזֶּה — תַּחֲזִיר. וְהַוָּלָד מַמְזֵר מִזֶּה וּמִזֶּה, וְלֹא זֶה וָזֶה מִטַּמְּאִין לָהּ, וְלֹא זֶה וָזֶה זַכָּאִין לֹא בִמְצִיאָתָהּ, וְלֹא בְמַעֲשֵׂה יָדֶיהָ, וְלֹא בַהֲפָרַת נְדָרֶיהָ. הָיְתָה בַת יִשְׂרָאֵל — נִפְסְלָה מִן הַכְּהֻנָּה; וּבַת לֵוִי — מִן הַמַּעֲשֵׂר, וּבַת כֹּהֵן — מִן הַתְּרוּמָה. וְאֵין יוֹרְשִׁים שֶׁל זֶה וְיוֹרְשִׁים שֶׁל זֶה יוֹרְשִׁים אֶת כְּתֻבָּתָהּ. וְאִם מֵתוּ — אָחִיו שֶׁל זֶה וְאָחִיו שֶׁל זֶה חוֹלְצִין וְלֹא מְיַבְּמִין. רַבִּי יוֹסֵי אוֹמֵר: כְּתֻבָּתָהּ עַל נִכְסֵי בַעֲלָהּ הָרִאשׁוֹן. רַבִּי אֶלְעָזָר אוֹמֵר: הָרִאשׁוֹן זַכַּאי בִּמְצִיאָתָהּ וּבְמַעֲשֵׂה יָדֶיהָ, וּבַהֲפָרַת נְדָרֶיהָ. וְרַבִּי שִׁמְעוֹן אוֹמֵר: בִּיאָתָהּ אוֹ חֲלִיצָתָהּ מֵאָחִיו שֶׁל רִאשׁוֹן פּוֹטֶרֶת צָרָתָהּ, וְאֵין הַוָּלָד מִמֶּנּוּ מַמְזֵר. וְאִם נִסֵּת שֶׁלֹּא בִרְשׁוּת — מֻתֶּרֶת לַחֲזוֹר לוֹ.
A woman whose husband went overseas, and they came and told her, “Your husband died,” and she married, and afterward her husband came [back] —- she must leave both of them, and she needs [to receive] a bill of divorce from each, and she receives neither the kesubah [payment], nor [payment for] the fruits, nor sustenance, nor worn property [payment] from either; if she took [payment] from either, she must return [it]. [Her] child by either is a mamzer, neither of them may contaminate himself to her, and neither has rights to her found objects, or the products of her labor, or the nullification of her vows. [If] she was the daughter of a Yisrael, she is disqualified from [marrying into] the priesthood; [if] the daughter of a Levi, [she is disqualified] from [eating] the tithe, and [if] the daughter of a Kohen, [she is disqualified] from [eating] terumah. The heirs of both [men] do not inherit her kesubah. If they should die, the brother of each performs chalitzah, but not yibum. R' Yose says: Her kesubah [claim] is on her first husband's property. R' Elazar says: The first one has the rights to her found objects, the products of her labor, and the nullification of her vows. R' Shimon says: Cohabitation or chalitzah with the first one's brother releases her co-wife, and her child by him is not a mamzer. If she married without sanction [of the court], she may return to him.
