שְׁנַיִם שֶׁקִּדְּשׁוּ שְׁתֵּי אֲחָיוֹת, זֶה אֵינוֹ יוֹדֵעַ אֵיזוֹ קִדֵּשׁ, וְזֶה אֵינוֹ יוֹדֵעַ אֵיזוֹ קִדֵּשׁ — זֶה נוֹתֵן שְׁנֵי גִטִּין, וְזֶה נוֹתֵן שְׁנֵי גִטִּין. מֵתוּ, לָזֶה אָח, וְלָזֶה אָח — זֶה חוֹלֵץ לִשְׁתֵּיהֶן, וְזֶה חוֹלֵץ לִשְׁתֵּיהֶן. לָזֶה אֶחָד וְלָזֶה שְׁנַיִם — הַיָּחִיד חוֹלֵץ לִשְׁתֵּיהֶן, וְהַשְּׁנַיִם, אֶחָד חוֹלֵץ וְאֶחָד מְיַבֵּם. קָדְמוּ וְכָנְסוּ — אֵין מוֹצִיאִין מִיָּדָם. לָזֶה שְׁנַיִם וְלָזֶה שְׁנַיִם — אָחִיו שֶׁל זֶה חוֹלֵץ לְאֶחָת, וְאָחִיו שֶׁל זֶה חוֹלֵץ לְאֶחָת; אָחִיו שֶׁל זֶה מְיַבֵּם חֲלוּצָתוֹ שֶׁל זֶה, וְאָחִיו שֶׁל זֶה מְיַבֵּם חֲלוּצָתוֹ שֶׁל זֶה. קָדְמוּ שְׁנַיִם וְחָלְצוּ — לֹא יְיַבְּמוּ הַשְּׁנַיִם, אֶלָּא אֶחָד חוֹלֵץ וְאֶחָד מְיַבֵּם. קָדְמוּ וְכָנְסוּ — אֵין מוֹצִיאִין מִיָּדָם.
Two [men] who betrothed two sisters, and neither one knows which one he has betrothed, each of them gives two divorces. [If] they died [and] each left a brother, each performs chalitzah with both. [If] one left one [brother] and the other left two [brothers], the single [brother] performs chalitzah with both; and [of] the two, one performs cha- litzah, and the other [may then] perform yibum. [However, if] they went ahead and married [them], we do not force them to divorce. [If] each left two [brothers], a brother of one performs chalitzah with one [of the sisters] and a brother of the other performs chalitzah with the other [sister]; [then] the two remaining brothers [may] each perform yibum with the [widow] who received chalitzah from the other's brother. [If] both went ahead and performed chalitzah, the other two may not [both] perform yibum, but one must perform chalitzah, and the other [may then] perform yibum. [However, if] they went ahead and married [them], we do not force them to divorce.
Yevamos2: 8
מִצְוָה בַגָּדוֹל לְיַבֵּם; וְאִם קָדַם הַקָּטָן — זָכָה. הַנִּטְעָן עַל הַשִּׁפְחָה וְנִשְׁתַּחְרְרָה, אוֹ עַל הַנָּכְרִית וְנִתְגַּיְּרָה — הֲרֵי זֶה לֹא יִכְנוֹס; וְאִם כָּנַס — אֵין מוֹצִיאִין מִיָּדוֹ. הַנִּטְעָן עַל אֵשֶׁת אִישׁ, וְהוֹצִיאוּהָ מִתַּחַת יָדוֹ — אַף עַל פִּי שֶׁכָּנַס, יוֹצִיא.
The commandment is for the eldest to perform yibum; but if the youngest anticipated [him], he gains [it]. One who is suspected in connection with a slavewoman, and she was [then] freed, or in connection with a non-Jewish woman, and she [then] converted —- may not marry [her]; but if he did marry [her], we do not force him to divorce [her]. One who is suspected in connection with another man's wife and they compelled him to divorce her, even if he married [her], he must divorce [her].
