Bava Metzia3: 12
הַשּׁוֹלֵחַ יָד בְּפִקָּדוֹן — בֵּית שַׁמַּאי אוֹמְרִים: יִלְקֶה בְחָסֵר וּבְיָתֵר. וּבֵית הִלֵּל אוֹמְרִים: כִּשְׁעַת הוֹצָאָה. רַבִּי עֲקִיבָא אוֹמֵר: כִּשְׁעַת הַתְּבִיעָה.  הַחוֹשֵׁב לִשְׁלוֹחַ יָד בְּפִקָּדוֹן — בֵּית שַׁמַּאי אוֹמְרִים: חַיָּב. וּבֵית הִלֵּל אוֹמְרִים: אֵינוֹ חַיָּב עַד שֶׁיִּשְׁלַח בּוֹ יָד, שֶׁנֶּאֱמַר: ,,אִם לֹא שָׁלַח יָדוֹ בִּמְלֶאכֶת רֵעֵהוּ”. כֵּיצַד? הִטָּה אֶת הֶחָבִית וְנָטַל הֵימֶנָּה רְבִיעִית, וְנִשְׁבְּרָה — אֵינוֹ מְשַׁלֵּם אֶלָּא רְבִיעִית. הִגְבִּיהָהּ וְנָטַל הֵימֶנָּה רְבִיעִית, וְנִשְׁבְּרָה — מְשַׁלֵּם דְּמֵי כֻלָּהּ.
[If] one uses a deposit for his own purposes —- Beis Shammai say: He must suffer whether it loses [value] or it gains. Beis Hillel say: As of the time of its being taken out. R’ Akiva says: As of the time of the claim.  [If] one intends to take a deposit for his own use —- Beis Shammai say: He is liable. Beis Hillel say: He is not liable until he uses it for his own purposes, as it is said (Exodus 22:7): if he has not put forth his hand on the other’s goods. How? [If] he tilted the cask and took a quar-ter [of a log] from it, and it broke, he pays only for the quarter [of a log]. [If] he lifted it and took a quarter [of a log] from it, and it broke, he must pay its entire value.
