Bava Metzia3: 7

הַמַּפְקִיד פֵּרוֹת אֵצֶל חֲבֵרוֹ — הֲרֵי זֶה יוֹצִיא לוֹ חֶסְרוֹנוֹת: לְחִטִּין וּלְאֹרֶז — תִּשְׁעַת חֲצָאֵי קַבִּין לְכוֹר; לִשְׂעוֹרִין וּלְדֹחַן — תִּשְׁעָה קַבִּין לְכוֹר; לְכֻסְּמִין וּלְזֶרַע פִּשְׁתָּן — שָׁלשׁ סְאִין לְכוֹר; הַכֹּל לְפִי הַמִּדָּה, הַכֹּל לְפִי הַזְּמָן. אָמַר רַבִּי יוֹחָנָן בֶּן נוּרִי: וְכִי מָה אִכְפַּת לָהֶן לָעַכְבָּרִין, וַהֲלֹא אוֹכְלוֹת בֵּין מֵהַרְבֵּה וּבֵין מִקִּמְעָא! אֶלָּא אֵינוֹ מוֹצִיא לוֹ חֶסְרוֹנוֹת אֶלָּא לְכוֹר אֶחָד בִּלְבָד. רַבִּי יְהוּדָה אוֹמֵר: אִם הָיְתָה מִדָּה מְרֻבָּה — אֵינוֹ מוֹצִיא לוֹ חֶסְרוֹנוֹת, מִפְּנֵי שֶׁמּוֹתִירוֹת.

[If] one deposits produce with another person, he may deduct for decreases: for wheat and rice, nine half kavs per kor; for barley and for millet, nine kavs per kor; for spelt and for linseed, three se’in per kor; everything according to the measure, everything according to the time. Said R’ Yochanan ben Nuri: What difference does it make to the mice; do they not eat whether from much or from little? Rather, he deducts for decreases for one kor only. R’ Yehudah says: If it had been a large measure, he does not deduct for decreases, because it increases.

Bava Metzia3: 8

יוֹצִיא לוֹ שְׁתוּת לְיַיִן. רַבִּי יְהוּדָה אוֹמֵר: חֹמֶשׁ. יוֹצִיא לוֹ שְׁלשֶׁת לֻגִּין שֶׁמֶן לְמֵאָה: לֹג וּמֶחֱצָה שְׁמָרִים, לֹג וּמֶחֱצָה בֶּלַע. אִם הָיָה שֶׁמֶן מְזֻקָּק — אֵינוֹ מוֹצִיא לוֹ שְׁמָרִים. אִם הָיוּ קַנְקַנִּים יְשָׁנִים — אֵינוֹ מוֹצִיא לוֹ בֶלַע. רַבִּי יְהוּדָה אוֹמֵר: אַף הַמּוֹכֵר שֶׁמֶן מְזֻקָּק לַחֲבֵרוֹ כָּל יְמוֹת הַשָּׁנָה, הֲרֵי זֶה מְקַבֵּל עָלָיו לֹג וּמֶחֱצָה שְׁמָרִים לְמֵאָה.

He may deduct a sixth for wine. R’ Yehudah says: A fifth. He may deduct three lugin of oil per hundred: a log and a half for sediment, and a log and a half for absorption. If it was refined oil, he may not deduct for sediment. If the vessels were old, he may not deduct for absorbtion. R’ Yehudah says: Also [if] one sells refined oil to another [for] all the days of the year, the latter must accept upon himself a log and a half sediment per hundred.

Bava Metzia3: 9

הַמַּפְקִיד חָבִית אֵצֶל חֲבֵרוֹ, וְלֹא יִחֲדוּ לָהּ הַבְּעָלִים מָקוֹם, וְטִלְטְלָהּ, וְנִשְׁבָּרָה, אִם מִתּוֹךְ יָדוֹ נִשְׁבְּרָה — לְצָרְכּוֹ חַיָּב, לְצָרְכָּהּ פָּטוּר. אִם מִשֶּׁהִנִּיחָהּ נִשְׁבְּרָה — בֵּין לְצָרְכּוֹ בֵּין לְצָרְכָּהּ פָּטוּר. יִחֲדוּ לָהּ הַבְּעָלִים מָקוֹם, וְטִלְטְלָהּ, וְנִשְׁבָּרָה, בֵּין מִתּוֹךְ יָדוֹ וּבֵין מִשֶּׁהִנִּיחָהּ — לְצָרְכּוֹ חַיָּב, לְצָרְכָּהּ פָּטוּר.

[If] one deposits a cask with another, and its owner had not designated a place for it, and he moved it, and it broke —- if it broke from his hand [then if he had moved it] for his benefit, he is liable; for its benefit, he is exempt. If it broke after he put it down —- whether [he had moved it] for his benefit or for its benefit, he is exempt. [If] the owner had designated a place for it, and he moved it, and it broke —- whether from his hand or whether after he put it down —- [if he had moved it] for his benefit, he is liable; for its benefit, he is exempt.

Bava Metzia3: 10

הַמַּפְקִיד מָעוֹת אֵצֶל חֲבֵרוֹ, צְרָרָן וְהִפְשִׁילָן לַאֲחוֹרָיו, אוֹ שֶׁמְּסָרָן לִבְנוֹ וּלְבִתּוֹ הַקְּטַנִּים, וְנָעַל בִּפְנֵיהֶם שֶׁלֹּא כָרָאוּי — חַיָּב, שֶׁלֹּא שָׁמַר כְּדֶרֶךְ הַשּׁוֹמְרִים. וְאִם שָׁמַר כְּדֶרֶךְ הַשּׁוֹמְרִים — פָּטוּר.

[If] one deposits money with another [and] he tied it up and slung it behind him, or gave it over to his minor son or daughter, and locked [the door] before them inadequately, he is liable, since he did not watch as shomrim do. But if he watched as shomrim do, he is exempt.
