[If] one says to two: “I robbed one of you of a maneh, but I do not know which one of you,” or “The father of one of you deposited a maneh with me, but I do not know which one he is” —- he gives this one a maneh and that one a maneh, be-cause he admitted by himself.

[If] two deposited with one —- one a maneh, and one two hundred [zuz] —- [and] this one says: “The two hundred are mine,” and that one says: “The two hundred are mine,” he gives this one a maneh and that one a maneh, and the remainder should be put away until Elijah comes.  Said R’ Yose: If so, what does the deceiver lose? Rather, everything should be put away until Elijah comes.

And so it is [with] two utensils —- one worth a maneh and one worth a thousand zuz. [If] this one says: “The more expensive one is mine,” and that one says: “The more expensive one is mine,” he gives the smaller one to one of them, and from the larger one he gives the value of the smaller one to the other, and the remainder should be put away until Elijah comes.  Said R’ Yose: If so, what does the deceiver lose? Rather, everything should be put away until Elijah comes.

[If] one deposits produce with another, even if it is becoming ruined, he may not touch it. Rabban Shimon ben Gamliel says: He should sell it in the presence of a court, because he is as one who returns a lost item to the owner.
