נוֹתֵן אָדָם מָעָה לְחֶנְוָנִי וּלְנַחְתּוֹם כְּדֵי שֶׁיְּזַכֶּה לוֹ עֵרוּב — דִּבְרֵי רַבִּי אֱלִיעֶזֶר. וַחֲכָמִים אוֹמְרִים: לֹא זָכוּ לוֹ מָעוֹתָיו. וּמוֹדִים בִּשְׁאָר כָּל אָדָם שֶׁזָּכוּ לוֹ מָעוֹתָיו. שֶׁאֵין מְעָרְבִין לְאָדָם אֶלָּא מִדַּעְתּוֹ.
אָמַר רַבִּי יְהוּדָה: בַּמֶּה דְבָרִים אֲמוּרִים? בְּעֵרוּבֵי תְחוּמִין, אֲבָל בְּעֵרוּבֵי חֲצֵרוֹת מְעָרְבִין לְדַעְתּוֹ וְשֶׁלֹּא לְדַעְתּוֹ; לְפִי שֶׁזָּכִין לְאָדָם שֶׁלֹּא בְּפָנָיו, וְאֵין חָבִין לְאָדָם שֶׁלֹּא בְּפָנָיו.
A person may give a ma’ah to a grocer or to a baker in order that he give him possession in an eruv — [these are] the words of R’ Eliezer. But the Sages say: His money does not effect possession. But they concur that in regard to other people his money gives him possession. And we cannot make an eruv for a person except with his consent.
R’ Yehudah said: To what do these words apply? To eruvei techumin, but in regard to eruvei chatzeiros, we may make an eruv with his consent or without his consent; for we may benefit a person in his absence, but we may not disadvantage a person except in his presence.
Eruvin8: 1
כֵּיצַד מִשְׁתַּתְּפִין בִּתְחוּמִין? מֵנִיחַ אֶת הֶחָבִית, וְאוֹמֵר: ,,הֲרֵי זֶה לְכָל בְּנֵי עִירִי — לְכָל מִי שֶׁיֵּלֵךְ לְבֵית הָאֵבֶל אוֹ לְבֵית הַמִּשְׁתֶּה. וְכֹל שֶׁקִּבֵּל עָלָיו מִבְּעוֹד יוֹם, מֻתָּר; מִשֶּׁתֶּחְשַׁךְ, אָסוּר, שֶׁאֵין מְעָרְבִין מִשֶּׁתֶּחְשַׁךְ.
How do we make a communal eruvei techumin? One places a barrel, and declares: ‘‘Let this be for all the people of my town’’ — for whoever will go to a house of mourning or a house of rejoicing. Whoever accepted this while it was yet day is per-mitted; after dark, he is prohibited, because we cannot make an eruv after dark.
Eruvin8: 2
כַּמָּה הוּא שִׁעוּרוֹ? מְזוֹן שְׁתֵּי סְעֻדּוֹת לְכָל אֶחָד; מְזוֹנוֹ לְחֹל וְלֹא לְשַׁבָּת — דִּבְרֵי רַבִּי מֵאִיר. רַבִּי יְהוּדָה אוֹמֵר: לְשַׁבָּת וְלֹא לְחֹל. וְזֶה וְזֶה מִתְכַּוְּנִין לְהָקֵל.
רַבִּי יוֹחָנָן בֶּן בְּרוֹקָה אוֹמֵר: מִכִּכָּר בְּפֻנְדְּיוֹן, מֵאַרְבַּע סְאִין בְּסֶלַע. רַבִּי שִׁמְעוֹן אוֹמֵר: שְׁתֵּי יָדוֹת לְכִכָּר מִשָּׁלֹשׁ לְקַב.
חֶצְיָהּ לְבַיִת הַמְנֻגָּע, וַחֲצִי חֶצְיָהּ לִפְסֹל אֶת הַגְּוִיָּה.
What is its quantity? Food for two meals for each person; of his food for a week-day, but not for the Sabbath — [these are] the words of R’ Meir. R’ Yehudah says: For the Sabbath, but not for a weekday. And both intend to rule leniently.
R’ Yochanan ben Berokah says: A loaf worth a pundyon, when four se’ah cost a sela. R’ Shimon says: Two thirds of a loaf of which there are three to a kav.
Half of it for a house infected with tzaraas, and one fourth of it to render one’s body pasul.
Eruvin8: 3
אַנְשֵׁי חָצֵר וְאַנְשֵׁי מַרְפֶּסֶת שֶׁשָּׁכְחוּ וְלֹא
עֵרְבוּ, כֹּל שֶׁגָּבוֹהַּ עֲשָׂרָה טְפָחִים, לַמַּרְפֶּסֶת; פָּחוֹת מִכָּאן, לֶחָצֵר.
חֻלְיַת הַבּוֹר וְהַסֶּלַע גְּבוֹהִים עֲשָׂרָה טְפָחִים, לַמַּרְפֶּסֶת; פָּחוֹת מִכָּאן, לֶחָצֵר. בַּמֶּה דְבָרִים אֲמוּרִים? בִּסְמוּכָה; אֲבָל בְּמֻפְלֶגֶת, אֲפִלּוּ גָבוֹהַּ עֲשָׂרָה טְפָחִים, לֶחָצֵר. וְאֵיזוֹ הִיא סְמוּכָה? כָּל שֶׁאֵינָהּ רְחוֹקָה אַרְבָּעָה טְפָחִים.
If the residents of a courtyard and the residents of a gallery forgot to make an eruv,
whatever is ten fists high [belongs] to the gallery; less than that, to the courtyard.
The embankment around a pit or a rock which is ten fists high [belongs] to the gallery; less than that, to the courtyard. To what do these words apply? To that which is near; but that which is at a distance, even if it is ten fists high, [belongs] to the courtyard. And what is [considered] near? Whatever is not four fists away.
